1 A bill to be entitled
2 An act relating to procurement procedures for
3 educational institutions; amending s. 1010.04, F.S.;
4 requiring each district school board and Florida
5 College System institution board of trustees to review
6 certain agreements and contracts before purchasing
7 nonacademic commodities and contractual services under
8 certain circumstances to determine whether the use of
9 the agreements and contracts is economically
10 advantageous; requiring that bid specifications
11 include a specified statement; authorizing each
12 district school board to also use specified
13 cooperative state purchasing programs; authorizing
14 specified educational institutions to make purchases
15 through an online procurement system, an electronic
16 auction service, or other efficient procurement tool;
17 providing an effective date.

19 Be It Enacted by the Legislature of the State of Florida:

21 Section 1. Subsections (1) and (2) of section 1010.04,
22 Florida Statutes, are amended to read:
23 1010.04 Purchasing.—
24 (1)(a) Purchases and leases by school districts and Florida
25 College System institutions shall comply with the requirements
26 of law and rules of the State Board of Education.
27 (b) Before purchasing nonacademic commodities and
28 contractual services, each district school board and Florida
29 College System institution board of trustees shall review the
30 purchasing agreements and state term contracts available under
31 s. 287.056 to determine whether it is in the school board’s or
32 the board of trustees’ economic advantage to use the agreements
33 and contracts. Each bid specification for nonacademic
34 commodities and contractual services must include a statement
35 indicating that the purchasing agreements and state term
36 contracts available under s. 287.056 have been reviewed. Each
37 district school board may also use the cooperative state
38 purchasing programs managed through the regional consortium
39 service organizations pursuant to their authority under s.
40 1001.451(3).
41 (c)(b) Purchases and leases by state universities shall
42 comply with the requirements of law and regulations of the Board
43 of Governors.
44 (2) Each district school board and Florida College System
45 institution board of trustees shall adopt rules, and each
46 university board of trustees shall adopt regulations, to be
47 followed in making purchases. Purchases may be made through an
48 online procurement system, an electronic auction service, or
49 other efficient procurement tool.
50 Section 2. This act shall take effect July 1, 2016.
