The Committee on Appropriations (Hays) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Subsections (2) and (3) of section 20.255,
6 Florida Statutes, are amended to read:
7 20.255 Department of Environmental Protection.—There is
8 created a Department of Environmental Protection.
9 (2)(a) There shall be three deputy secretaries who are to
10 be appointed by and shall serve at the pleasure of the
11 secretary. The secretary may assign any deputy secretary the
12 responsibility to supervise, coordinate, and formulate policy
13 for any division, office, or district. The following special
14 offices are established and headed by managers, each of whom is
15 to be appointed by and serve at the pleasure of the secretary:
16 1. Office of Chief of Staff;
17 2. Office of General Counsel;
18 3. Office of Inspector General;
19 4. Office of External Affairs;
20 5. Office of Legislative Affairs;
21 6. Office of Intergovernmental Programs; and
22 7. Office of Greenways and Trails.
23 8. Office of Emergency Response.
24 (b) The Office of the Secretary is established. The
25 secretary may establish offices within divisions or within the
26 Office of the Secretary to promote the efficient and effective
27 operation of the department.
28 (c) The secretary shall appoint a general counsel who is
29 directly responsible to and serves at the pleasure of the
30 secretary. The general counsel is responsible for all legal
31 matters of the department.
32 (d)(b) There shall be six administrative districts involved
33 in regulatory matters of waste management, water resource
34 management, wetlands, and air resources, which shall be headed
35 by managers, each of whom is to be appointed by and serve at the
36 pleasure of the secretary. Divisions of the department may have
37 one assistant or two deputy division directors, as required to
38 facilitate effective operation.

40 The directors managers of all divisions, managers of all and
41 offices, specifically named in this section and the managers
42 directors of the six administrative districts are exempt from
43 part II of chapter 110 and are included in the Senior Management
44 Service in accordance with s. 110.205(2)(j).
45 (3) The following divisions of the Department of
46 Environmental Protection are established:
47 (a) Division of Administrative Services.
48 (b) Division of Air Resource Management.
49 (c) Division of Water Resource Management.
50 (d) Division of Environmental Assessment and Restoration.
51 (e) Division of Waste Management.
52 (f) Division of Recreation and Parks.
53 (g) Division of State Lands, the director of which is to be
54 appointed by the secretary of the department, subject to
55 confirmation by the Governor and Cabinet sitting as the Board of
56 Trustees of the Internal Improvement Trust Fund.
57 (h) Division of Water Restoration Assistance.

59 In order to ensure statewide and intradepartmental consistency,
60 the department’s divisions shall direct the district offices and
61 bureaus on matters of interpretation and applicability of the
62 department’s rules and programs.
63 Section 2. This act shall take effect July 1, 2016.

72 20.255, F.S.; deleting a provision requiring certain
73 offices within the department; establishing the Office
74 of the Secretary; authorizing the secretary to
75 establish offices within divisions or the Office of
76 the Secretary as necessary to promote the efficient
77 and effective operation of the department; requiring
78 the appointment of a general counsel; providing an
79 exemption for certain managers and directors from part
80 II of ch. 110, F.S.; establishing the Division of
81 Water Restoration Assistance within the department;
82 providing an effective date.
