1 A bill to be entitled
2 An act relating to the organizational structure of the
3 Department of Environmental Protection; amending s.
4 20.255, F.S.; deleting a provision requiring certain
5 offices within the department; establishing the Office
6 of the Secretary; authorizing the secretary to
7 establish offices within divisions or the Office of
8 the Secretary as necessary to promote the efficient
9 and effective operation of the department; requiring
10 the appointment of a general counsel; providing an
11 exemption for certain managers and directors from part
12 II of ch. 110, F.S.; establishing the Division of
13 Water Restoration Assistance within the department;
14 providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Subsections (2) and (3) of section 20.255,
19 Florida Statutes, are amended to read:
20 20.255 Department of Environmental Protection.—There is
21 created a Department of Environmental Protection.
22 (2)(a) There shall be three deputy secretaries who are to
23 be appointed by and shall serve at the pleasure of the
24 secretary. The secretary may assign any deputy secretary the
25 responsibility to supervise, coordinate, and formulate policy
26 for any division, office, or district. The following special
27 offices are established and headed by managers, each of whom is
28 to be appointed by and serve at the pleasure of the secretary:
29 1. Office of Chief of Staff;
30 2. Office of General Counsel;
31 3. Office of Inspector General;
32 4. Office of External Affairs;
33 5. Office of Legislative Affairs;
34 6. Office of Intergovernmental Programs; and
35 7. Office of Greenways and Trails.
36 8. Office of Emergency Response.
37 (b) The Office of the Secretary is established. The
38 secretary may establish offices within divisions or within the
39 Office of the Secretary to promote the efficient and effective
40 operation of the department.
41 (c) The secretary shall appoint a general counsel who is
42 directly responsible to and serves at the pleasure of the
43 secretary. The general counsel is responsible for all legal
44 matters of the department.
45 (d)(b) There shall be six administrative districts involved
46 in regulatory matters of waste management, water resource
47 management, wetlands, and air resources, which shall be headed
48 by managers, each of whom is to be appointed by and serve at the
49 pleasure of the secretary. Divisions of the department may have
50 one assistant or two deputy division directors, as required to
51 facilitate effective operation.

53 The directors managers of all divisions, managers of all and
54 offices, specifically named in this section and the managers
55 directors of the six administrative districts are exempt from
56 part II of chapter 110 and are included in the Senior Management
57 Service in accordance with s. 110.205(2)(j).
58 (3) The following divisions of the Department of
59 Environmental Protection are established:
60 (a) Division of Administrative Services.
61 (b) Division of Air Resource Management.
62 (c) Division of Water Resource Management.
63 (d) Division of Environmental Assessment and Restoration.
64 (e) Division of Waste Management.
65 (f) Division of Recreation and Parks.
66 (g) Division of State Lands, the director of which is to be
67 appointed by the secretary of the department, subject to
68 confirmation by the Governor and Cabinet sitting as the Board of
69 Trustees of the Internal Improvement Trust Fund.
70 (h) Division of Water Restoration Assistance.

72 In order to ensure statewide and intradepartmental consistency,
73 the department’s divisions shall direct the district offices and
74 bureaus on matters of interpretation and applicability of the
75 department’s rules and programs.
76 Section 2. This act shall take effect July 1, 2016.
