House Comm: RCS . 02/25/2016 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Appropriations (Galvano) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 108 - 139 4 and insert: 5 836.12 Threats.— 6 (1) As used in this section, the term: 7 (a) “Family member” means: 8 1. An individual related to another individual by blood or 9 marriage; or 10 2. An individual who stands in loco parentis to another 11 individual. 12 (b) “Law enforcement officer” means: 13 1. A law enforcement officer as defined in s. 943.10; or 14 2. A federal law enforcement officer as defined in s. 15 901.1505. 16 (2) Any person who threatens a law enforcement officer, a 17 state attorney, an assistant state attorney, a firefighter, a 18 judge, or an elected official, or a family member of such 19 persons, with death or serious bodily harm commits a misdemeanor 20 of the first degree, punishable as provided in s. 775.082 or s. 21 775.083. 22 (3) A person who commits a second or subsequent violation 23 of subsection (2) commits a felony of the third degree, 24 punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 25 26 ================= T I T L E A M E N D M E N T ================ 27 And the title is amended as follows: 28 Delete lines 3 - 11 29 and insert: 30 threats of violence; amending ss. 790.163 and 790.164, 31 F.S.; creating the crime of falsely reporting the use 32 of firearms in a violent manner against a person or 33 persons; creating s. 836.12, F.S.; defining the terms 34 “family member” and “law enforcement officer”; 35 providing criminal penalties for a person who 36 threatens specified persons with death or serious 37 bodily harm; amending s. 921.0022, F.S.; conforming
