Senator Bullard moved the following:

4 and insert:
5 (c) Award dispensing licenses to all qualified nurseries
6 that timely submitted applications pursuant to paragraph (b) on
7 or before July 8, 2016, and were found to have satisfied the
8 threshold provisions contained within part II of the Department
9 of Health Application for Low-THC Cannabis Dispensing
10 Organization Approval. The department shall notify the
11 qualifying nurseries of the award of a dispensing license by
12 July 11, 2016. The department’s award of such licenses is final
13 and not subject to legal challenge by third parties pursuant to
14 chapter 120.
15 (d) Authorize the establishment of five additional
16 dispensing organizations without regard to the five regions and
17 to paragraph (b). An applicant for approval must demonstrate its
18 technological ability to cultivate and produce low-THC cannabis.
19 An applicant that applied in more than one region, or an
20 applicant that is corporately affiliated with another applicant
21 or licensee, may receive only one license. As used in this
22 paragraph, the term “corporately affiliated” means applicants
23 that are related to each other in a significant way or manner or
24 that have a legal affiliation with any owner, investor, or
25 related party.
26 (e) Allow a dispensing organization to make a wholesale
27 purchase of low-THC cannabis or medical cannabis from, or a
28 distribution of low-THC cannabis or medical cannabis to, another
29 dispensing organization.
30 (f)(c) Monitor physician registration and ordering of low
31 THC cannabis, medical cannabis, or a cannabis delivery device
32 for ordering practices that could facilitate unlawful diversion
33 or misuse of low-THC cannabis, medical cannabis, or a cannabis
34 delivery device and take disciplinary action as indicated.
35 (g) Require a licensee selected under this section to
36 deliver an updated plan to fulfill the department’s requirements
37 before it may commence cultivation of medical cannabis.
38 (h) Adopt new rules for medical cannabis cultivation and
39 distribution and for the necessary protocols for product safety,
40 facility security, whole plant cultivation, and final product
41 delivery for licensees.
