    1                        A bill to be entitled                      
    2         An act relating to public educational facilities;
    3         amending s. 1013.40, F.S.; authorizing certain Florida
    4         College System institutions to construct dormitories
    5         for up to 300 beds for students; prohibiting the use
    6         of state funds and tuition and fee revenues for
    7         construction, debt service payments, maintenance, or
    8         operation of such dormitories; prohibiting additional
    9         beds constructed after a specified date from being
   10         financed through a bond issue; providing an effective
   11         date.

   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Subsection (4) of section 1013.40, Florida
   16  Statutes, is amended to read:
   17         1013.40 Planning and construction of Florida College System
   18  institution facilities; property acquisition.—
   19         (4) The campus of a Florida College System institution
   20  within a municipality designated as an area of critical state
   21  concern, as defined in s. 380.05, and having a comprehensive
   22  plan and land development regulations containing a building
   23  permit allocation system that limits annual growth, may
   24  construct dormitories for up to 300 100 beds for Florida College
   25  System institution students. Such dormitories are shall be
   26  exempt from the building permit allocation system and may be
   27  constructed up to 45 feet in height if the dormitories provided
   28  that they are otherwise consistent with the comprehensive plan,
   29  the Florida College System institution has a hurricane
   30  evacuation plan that requires all dormitory occupants to be
   31  evacuated 48 hours in advance of tropical force winds, and that
   32  transportation is provided for dormitory occupants during an
   33  evacuation. State funds and tuition and fee revenues may not be
   34  used for construction, debt service payments, maintenance, or
   35  operation of such dormitories. Additional dormitory beds
   36  constructed after July 1, 2016, may not be financed through the
   37  issuance of a bond.
   38         Section 2. This act shall take effect July 1, 2016.
