Senator Richter moved the following:
1 Senate Amendment (with title amendment)

3 Delete lines 256 - 303
4 and insert:
5 o. The home addresses, telephone numbers, dates of birth,
6 and photographs of current or former emergency medical
7 technicians or paramedics certified under chapter 401; the
8 names, home addresses, telephone numbers, dates of birth, and
9 places of employment of the spouses and children of such
10 emergency medical technicians or paramedics; and the names and
11 locations of schools and day care facilities attended by the
12 children of such emergency medical technicians or paramedics are
13 exempt from s. 119.07(1) and s. 24(a), Art. I of the State
14 Constitution. This sub-subparagraph is subject to the Open
15 Government Sunset Review Act in accordance with s. 119.15 and
16 shall stand repealed on October 2, 2021, unless reviewed and
17 saved from repeal through reenactment by the Legislature.
18 3. An agency that is the custodian of the information
19 specified in subparagraph 2. and that is not the employer of the
20 officer, employee, justice, judge, or other person specified in
21 subparagraph 2. shall maintain the exempt status of that
22 information only if the officer, employee, justice, judge, other
23 person, or employing agency of the designated employee submits a
24 written request for maintenance of the exemption to the
25 custodial agency.
26 4. The exemptions in this paragraph apply to information
27 held by an agency before, on, or after the effective date of the
28 exemption.
29 5. Except as otherwise expressly provided in this
30 paragraph, this paragraph is subject to the Open Government
31 Sunset Review Act in accordance with s. 119.15, and shall stand
32 repealed on October 2, 2017, unless reviewed and saved from
33 repeal through reenactment by the Legislature.
34 Section 2. The Legislature finds that it is a public
35 necessity to exempt from public records requirements the home
36 addresses, telephone numbers, dates of birth, and photographs of
37 current or former nonsworn investigative personnel of the
38 Department of Financial Services whose duties include the
39 investigation of fraud, theft, workers’ compensation coverage
40 requirements and compliance, other related criminal activities,
41 or state regulatory requirement violations; the names, home
42 addresses, telephone numbers, dates of birth, and places of
43 employment of the spouses and children of such personnel; and
44 the names and locations of schools and day care facilities
45 attended by the children of such personnel. The efforts of such
46 personnel can lead to arrests and prosecutions for crimes up to
47 and including first degree felony violations and can also result
48 in the loss of commerce and property, the assessment of monetary
49 fines, or the suspension or loss of professional licenses. The
50 department has documented numerous instances of personnel who
51 have been threatened and who have feared repercussions as a
52 result of carrying out their duties. These threats have included
53 weapons being brandished, verbal threats made to harm them or
54 their family members, harassment, and intimidation. The
55 Legislature finds that the release of such personal identifying
56 and location information might place these nonsworn
57 investigative personnel of the department and their family
58 members in danger of physical and emotional harm from
59 disgruntled individuals who have contentious reactions to
60 actions taken by such personnel, or whose business or
61 professional practices have come under the scrutiny of such
62 personnel. The Legislature further finds that the harm that may
63 result from the release of such personal identifying and
64 location information outweighs any public benefit that may be
65 derived from the disclosure of the information.
66 Section 3. The Legislature finds that it is a public
67 necessity that the home addresses, telephone numbers, dates of
68 birth, and photographs of current or former emergency medical
69 technicians or paramedics certified under chapter 401, Florida
70 Statutes; the names, home addresses, telephone numbers, dates of
71 birth, and places of employment of the spouses and children of
72 such emergency medical technicians or paramedics; and the names
73 and locations of schools and day care facilities attended by the
74 children of such emergency medical technicians or paramedics be
75 made confidential and exempt from public records requirements.
76 The Legislature finds that the release of such identifying and
77 location information may place such emergency medical
78 technicians or paramedics and their family members in danger of
79 physical and emotional harm from disgruntled individuals who
80 have contentious reactions to actions carried out by the
81 emergency medical technicians or paramedics. The Legislature
82 further finds that the harm that may result from the release of
83 such identifying and location information outweighs any public
84 benefit derived from disclosure of such information.

89 and insert:
90 personnel; providing an exemption from public records
91 requirements for certain identifying information of
92 current or former emergency medical technicians or
93 paramedics certified under ch. 401, F.S., and the
94 spouses and children of such medical technicians or
95 paramedics; providing for future review and repeal of
96 the exemptions; providing statements of public
97 necessity; providing an effective date.
