    1                        A bill to be entitled                      
    2         An act relating to the use of tobacco products in
    3         motor vehicles; creating s. 316.6136, F.S.;
    4         prohibiting a person from smoking a tobacco product in
    5         a motor vehicle in which a child under 13 years of age
    6         is present; providing penalties; defining the term
    7         “smoking”; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Section 316.6136, Florida Statutes, is created
   12  to read:
   13         316.6136 Smoking in vehicle in which a child under 13 years
   14  of age is present; prohibition.—A person may not smoke a tobacco
   15  product in a motor vehicle in which a child under 13 years of
   16  age is present. A person who violates this section commits a
   17  nonmoving violation, punishable as provided in chapter 318. As
   18  used in this section, the term “smoking” has the same meaning as
   19  defined in s. 386.203.
   20         Section 2. This act shall take effect October 1, 2016.
