       Senator Altman moved the following:
       
    1         Senate Amendment to Amendment (588642) (with title
    2  amendment)
    3  
    4         Between lines 833 and 834
    5  insert:
    6         Section 12. Paragraph (a) of subsection (1) of section
    7  330.30, Florida Statutes, is amended to read:
    8         330.30 Approval of airport sites; registration and
    9  licensure of airports.—
   10         (1) SITE APPROVALS; REQUIREMENTS, EFFECTIVE PERIOD,
   11  REVOCATION.—
   12         (a) Except as provided in subsection (3), the owner or
   13  lessee of any proposed airport shall, prior to site acquisition
   14  or construction or establishment of the proposed airport, obtain
   15  approval of the airport site from the department. Applications
   16  for approval of a site shall be made in a form and manner
   17  prescribed by the department. The department shall grant the
   18  site approval if it is satisfied:
   19         1. That the site has adequate area allocated for the
   20  airport as proposed.
   21         2. That the proposed airport will conform to licensing or
   22  registration requirements. and
   23         3. That the proposed airport will comply with the
   24  applicable local government land development regulations or
   25  zoning requirements, except helicopter sites on private
   26  residential property which are only for their owners’ personal
   27  use and composed of 2.5 or more contiguous acres.
   28         4.3. That all affected airports, local governments, and
   29  property owners have been notified and any comments submitted by
   30  them have been given adequate consideration, except helicopter
   31  sites on private residential property which are only for their
   32  owners’ personal use and composed of 2.5 or more contiguous
   33  acres.
   34         5.4. That safe air-traffic patterns can be established for
   35  the proposed airport with all existing airports and approved
   36  airport sites in its vicinity.
