    1         Senate Amendment to Amendment (588642) (with title
    2  amendment)

    4         Delete lines 2248 - 2263
    5  and insert:
    6         Section 47. Section 316.87, Florida Statutes, is created to
    7  read:
    8         316.87 Nonemergency medical transportation services.—To
    9  ensure the availability of nonemergency medical transportation
   10  services throughout the state, a provider licensed by the county
   11  or operating under a permit issued by the county may not be
   12  required to use a vehicle that is larger than needed to
   13  transport the number of persons being transported or that is
   14  inconsistent with the medical condition of the individuals
   15  receiving the nonemergency medical transportation services. This
   16  section does not apply to the procurement, contracting, or
   17  provision of paratransit transportation services, directly or
   18  indirectly, by a county or an authority, pursuant to the
   19  Americans with Disabilities Act of 1990, as amended.
