       Senator Bean moved the following:
       
    1         Senate Amendment to House Amendment (533707) to Senate
    2  Amendment (with title amendment)
    3  
    4         Delete lines 47 - 102
    5  and insert:
    6  the council under this section. The council may conduct its
    7  meetings via teleconference.
    8         (a)Members of the council shall serve without compensation
    9  and are not entitled to reimbursement for per diem or travel
   10  expenses. The council shall consist of 15 members, as follows:
   11         1.The Secretary of Health Care Administration, or his or
   12  her designee, who shall serve as the chair of the council.
   13         2.The State Surgeon General or his or his designee.
   14         3.The following members appointed by the Secretary of
   15  Health Care Administration:
   16         a.Two representatives of health insurers that offer
   17  coverage for telehealth services.
   18         b.Two representatives of organizations that represent
   19  health care facilities, one of whom shall be a representative of
   20  a hospital.
   21         c.Two representatives of entities that create or sell
   22  telehealth products.
   23         d.One representative of an organization that represents
   24  telehealth stakeholders.
   25         e.Two representatives of long-term care services, one of
   26  whom shall be a representative of a nursing home and one of whom
   27  shall be a representative from a home health agency or
   28  community-based health services program.
   29         4.The following members appointed by the State Surgeon
   30  General:
   31         a.Two health care practitioners, each of whom practices in
   32  a different area of medicine.
   33         b.Two representatives of organizations that represent
   34  health care practitioners.
   35         (b)The council shall review the surveys and research
   36  findings required by this section and make recommendations to
   37  increase the use and accessibility of services provided via
   38  telehealth, including the identification of any barriers to
   39  implementing or accessing services provided via telehealth, in a
   40  report that shall be submitted to the Governor, the President of
   41  the Senate, and the Speaker of the House of Representatives on
   42  or before October 31, 2017.
   43         (3)The Agency for Health Care Administration shall compile
   44  the surveys and research findings required by this section and
   45  submit a report of such findings to the Governor, the President
   46  of the Senate, and the Speaker of the House of Representatives
   47  on or before December 31, 2016.
   48         (4)The Department of Health shall survey all health care
   49  practitioners, as defined in s. 456.001, upon and as a condition
   50  of licensure renewal to compile the information required
   51  pursuant to this section. The Department of Health and the
   52  Office of Insurance Regulation shall submit their survey and
   53  research findings to the agency and shall assist the agency in
   54  compiling the information to prepare the report.
   55         (5)The Agency for Health Care Administration, the
   56  Department of Health, and the Office of Insurance Regulation may
   57  assess fines under ss. 408.813(2)(d), 456.072(2)(d), and
   58  624.310(5), Florida Statutes, respectively, against a health
   59  care facility, health maintenance organization, health care
   60  practitioner, and health insurer for failure to complete the
   61  surveys required under this section.
   62         (6)This section expires June 30, 2018.
   63         Section 2. Subsection (1) of section 636.202, Florida
   64  Statutes, is amended to read:
   65         636.202 Definitions.—As used in this part, the term:
   66         (1) “Discount medical plan” means a business arrangement or
   67  contract in which a person, in exchange for fees, dues, charges,
   68  or other consideration, provides access for plan members to
   69  providers of medical services and the right to receive medical
   70  services from those providers at a discount. The term “discount
   71  medical plan” does not include any product regulated under
   72  chapter 627, chapter 641, or part I of this chapter, or any
   73  medical services provided through a telecommunications medium
   74  that does not offer a discount to the plan member for those
   75  medical services.
