The Committee on Appropriations (Richter) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete lines 965 - 995
4 and insert:
5 559.9191 Reimbursement from insurers; repair or replacement
6 of motor vehicle glass.—
7 (1) A motor vehicle repair shop may not directly seek
8 reimbursement, payment, or benefits from an insurer for motor
9 vehicle glass repair or replacement unless all of the following
10 conditions are satisfied:
11 (2) The customer under whose insurance policy the motor
12 vehicle glass repair or replacement payment will be sought signs
13 a document containing the following language in at least 16
14 point, boldfaced type: “I UNDERSTAND THAT I AM ASSIGNING THE
15 BENEFITS OF MY INSURANCE POLICY TO A MOTOR VEHICLE REPAIR SHOP
16 THAT MAY SEEK REIMBURSEMENT FOR THE REPAIR OR REPLACEMENT OF MY
17 MOTOR VEHICLE GLASS FROM MY INSURANCE COMPANY. I ALSO UNDERSTAND
18 THAT IF THE CHARGES ARE NOT FULLY COVERED OR THE COST OF THE
19 MOTOR VEHICLE GLASS REPAIR OR REPLACEMENT IS NOT FULLY
20 REIMBURSED BY MY INSURANCE BENEFITS, THE MOTOR VEHICLE REPAIR
21 SHOP MAY SEEK REIMBURSEMENT FROM ME, PERSONALLY, OR TAKE LEGAL
22 ACTION AGAINST MY INSURANCE COMPANY. I UNDERSTAND THAT I HAVE
23 THE RIGHT TO CONSULT MY INSURANCE COMPANY OR AGENT ABOUT
24 ALTERNATIVE OPTIONS BEFORE SIGNING THIS DOCUMENT.”
25 (3) The motor vehicle repair shop seeks reimbursement only
26 for the replacement or repair of motor vehicle glass detailed in
27 the repair invoice required by s. 559.911.
