    1                        A bill to be entitled                      
    2         An act relating to prostitution; amending s. 39.01,
    3         F.S.; revising the definition of the term “sexual
    4         abuse of a child” to delete references to prostitution
    5         offenses; providing an effective date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. Paragraph (g) of subsection (69) of section
   10  39.01, Florida Statutes, is amended to read:
   11         39.01 Definitions.—When used in this chapter, unless the
   12  context otherwise requires:
   13         (69) “Sexual abuse of a child” for purposes of finding a
   14  child to be dependent means one or more of the following acts:
   15         (g) The sexual exploitation of a child, which includes the
   16  act of a child offering to engage in or engaging in
   17  prostitution, provided that the child is not under arrest or is
   18  not being prosecuted in a delinquency or criminal proceeding for
   19  a violation of any offense in chapter 796 based on such
   20  behavior; or allowing, encouraging, or forcing a child to:
   21         1. Solicit for or engage in prostitution;
   22         1.2. Engage in a sexual performance, as defined by chapter
   23  827; or
   24         2.3. Participate in the trade of human trafficking as
   25  provided in s. 787.06(3)(g).
   26         Section 2. This act shall take effect July 1, 2016.
