       Senator Garcia moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 1065 and 1066
    4  insert:
    5         Section 23. Section 465.0275, Florida Statutes, is amended
    6  to read:
    7         465.0275 Emergency prescription refill.—In the event a
    8  pharmacist receives a request for a prescription refill and the
    9  pharmacist is unable to readily obtain refill authorization from
   10  the prescriber, the pharmacist may dispense a one-time emergency
   11  refill of up to a 6-day supply a 72-hour supply of the
   12  prescribed medication, with the exception of those areas or
   13  counties included in an emergency order or proclamation of a
   14  state of emergency declared by the Governor, in which the
   15  executive order may authorize the pharmacist to dispense up to a
   16  30-day supply, providing that:
   17         (1) The prescription is not for a medicinal drug listed in
   18  Schedule II appearing in chapter 893.
   19         (2) The medication is essential to the maintenance of life
   20  or to the continuation of therapy in a chronic condition.
   21         (3) In the pharmacist’s professional judgment, the
   22  interruption of therapy might reasonably produce undesirable
   23  health consequences or may cause physical or mental discomfort.
   24         (4) The dispensing pharmacist creates a written order
   25  containing all of the prescription information required by this
   26  chapter and chapters 499 and 893 and signs that order.
   27         (5) The dispensing pharmacist notifies the prescriber of
   28  the emergency dispensing within a reasonable time after such
   29  dispensing.
