       Senator Clemens moved the following:
       
    1         Senate Amendment to Amendment (416182) (with title
    2  amendment)
    3  
    4         Delete lines 24 - 50
    5  and insert:
    6         1. Contains any aesthetic condition that causes a violation
    7  of registered corporate trademarks, service marks, and logos on
    8  real property or improvements thereon used in activities
    9  conducted under chapter 526 or in carrying out business
   10  activities defined as a franchise by Federal Trade Commission
   11  regulations in 16 C.F.R. ss. 436.1, et. seq.; or
   12         2. Imposes any requirement on the design of signage
   13  advertising the retail price of gasoline in accordance with ss.
   14  526.111 and 526.121 which prevents the signage from being
   15  visible to drivers of approaching motor vehicles in any lane of
   16  traffic in either direction on a roadway abutting the gas
   17  station premises and which meets height, width, and spacing
   18  standards for Series C, D, or E signs, as applicable, published
   19  in the latest edition of Standard Alphabets for Highway Signs
   20  and Pavement Markings published by the Federal Highway
   21  Administration, Office of Traffic Operations.
   22         (b) This subsection does not affect the applicability of
   23  any requirement of the Florida Building Code.
   24         (c) Any ordinance or other requirement adopted, enforced,
   25  or imposed in violation of paragraph (a) is hereby preempted and
   26  superseded by this section.
   27         (d) This subsection does not apply to property located in a
   28  designated historic district, or to a political subdivision sign
   29  regulation or ordinance that does not require the alteration of
   30  a registered mark.
