House Comm: RCS . 04/04/2017 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Ethics and Elections (Hutson) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete everything after the enacting clause 4 and insert: 5 Section 1. Subsection (2) of section 98.075, Florida 6 Statutes, is amended to read: 7 98.075 Registration records maintenance activities; 8 ineligibility determinations.— 9 (2) DUPLICATE REGISTRATION.— 10 (a) The department shall identify those voters who are 11 registered more than once within the state or those applicants 12 whose registration applications within the state would result in 13 duplicate registrations. The most recent application shall be 14 deemed an update to the voter registration record. 15 (b)1. The department may enter into interstate agreements 16 to share and exchange information in order to verify voter 17 registration information. The department shall provide such 18 information to the supervisors to conduct registration list 19 maintenance activities. 20 2. The department may only participate in an interstate 21 agreement that is controlled and operated by the participating 22 states. The interstate agreement may not be operated or 23 controlled by the Federal Government or any other entity acting 24 on behalf of the Federal Government. The department must be able 25 to withdraw from any interstate agreement entered into at any 26 time. 27 3. If the department enters into an interstate agreement, 28 the department must submit a report to the Governor, the 29 President of the Senate, and the Speaker of the House of 30 Representatives by December 1 of each year. The report must 31 describe the agreement and provide information on the total 32 number of voters removed from the voter registration system as a 33 result of the agreement and the reasons for their removal. 34 Section 2. This act shall take effect July 1, 2017. 35 36 ================= T I T L E A M E N D M E N T ================ 37 And the title is amended as follows: 38 Delete everything before the enacting clause 39 and insert: 40 A bill to be entitled 41 An act relating to voter registration list 42 maintenance; amending s. 98.075, F.S.; authorizing the 43 Department of State to enter into certain interstate 44 agreements to verify voter registration information; 45 requiring the department to share certain information 46 with the supervisors of elections; establishing 47 requirements for participation in such agreements; 48 establishing reporting requirements; providing an 49 effective date.
