Florida Senate - 2017 SB 1072 By Senator Hutson 7-01745-17 20171072__ 1 A bill to be entitled 2 An act relating to public records; specifying that 3 certain voter registration information and data from 4 another state obtained by the Secretary of State, 5 which is confidential under the laws of such state, is 6 confidential and exempt from public records 7 requirements; providing a statement of public 8 necessity; providing a contingent effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Information and data received by the Secretary 13 of State relating to the statewide voter registration system 14 pursuant to s. 97.012(17), Florida Statutes, and that is 15 confidential in its state of origin, is confidential and exempt 16 from s. 119.07(1), Florida Statutes, and s. 24(a), Article I of 17 the State Constitution. 18 Section 2. The Legislature finds that it is a public 19 necessity that voter registration information received from 20 other states in conjunction with an information sharing 21 agreement associated with the maintenance of the statewide voter 22 registration system be made confidential and exempt from s. 23 119.07(1), Florida Statutes, and s. 24(a), Article I of the 24 State Constitution, to the extent that the information received 25 is confidential in the state from which it is received. 26 Participating in agreements to share information and data with 27 other states is critical to ensuring the statewide voter 28 registration system does not contain ineligible voters. 29 Maintaining a statewide voter registration system with only 30 legally qualified voters is critical to fair elections in this 31 state. 32 Section 3. This act shall take effect on the same date that 33 SB ___ or similar legislation takes effect, if such legislation 34 is adopted in the same legislative session or an extension 35 thereof and becomes a law.
