Florida Senate - 2017 SB 1236 By Senator Rouson 19-01372-17 20171236__ 1 A bill to be entitled 2 An act relating to school district instructional and 3 administrative personnel; creating s. 1012.08, F.S.; 4 providing that certain school district employees have 5 a cause of action under the Whistle-blower’s Act for 6 the disclosure of certain information; providing an 7 effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Section 1012.08, Florida Statutes, is created to 12 read: 13 1012.08 Protection for disclosures by school district 14 instructional and administrative personnel.—An employee of a 15 school district whose professional responsibilities are defined 16 in s. 1012.01(2) and (3) who is discharged, demoted, suspended, 17 threatened, harassed, or in any other manner discriminated 18 against in the terms and conditions of employment by his or her 19 employer because the employee discloses the improper use of 20 school district practices or procedures deemed to be school 21 related fraud, a suspected violation of law or rule, the 22 dishonest reporting or misrepresentation of the employee’s 23 services, or an activity or incident that has had a negative 24 effect on the education of students or a school’s performance 25 shall have a cause of action under s. 112.3187. 26 Section 2. This act shall take effect July 1, 2017.
