Senator Garcia moved the following:

4 insert:
5 Section 3. Section 366.921, Florida Statutes, is created to
6 read:
7 366.921 Net metering for local governments.—
8 (1) As used in this section, the term:
9 (a) “Local government net metering program” means a billing
10 program using a retail metering and billing methodology whereby
11 a qualifying customer is allowed, at the customer’s option, to
12 offset, by means of power generation, any electricity purchases
13 from the utility for such customer’s retail metered locations
14 within the service area of the utility. Such power generation
15 need not occur at the same site as a location that receives an
16 electricity offset, but such power generation must occur within
17 the service area of the utility.
18 (b) “Qualifying customer” means a local governmental entity
19 in this state which owns a waste-to-energy facility.
20 (2) In order for a utility to qualify for cost recovery by
21 adjustment clause for gas reserve investments referenced in s.
22 366.04(2)(d), the utility must have one or more qualifying
23 customers participating in its local government net metering
24 program.
25 (3) By January 1, 2018, each public utility must develop a
26 local government net metering program.
27 (4) The commission may adopt rules to administer this
28 section, but may not limit:
29 (a) The amount of energy, energy capacity, energy demand,
30 or energy needs eligible for net metering under this section.
31 (b) The number or locations of the meters selected by the
32 qualifying customer to be net metered under this section.

37 and insert:
38 analysis of projects; creating s. 366.921, F.S.;
39 defining terms; requiring a utility, in order to
40 qualify for certain cost recovery for gas reserve
41 investments, to have one or more local governmental
42 entities that own waste-to-energy facilities
43 participating in its net metering program; requiring
44 public utilities to create a local government net
45 metering program by a certain date; authorizing the
46 commission to adopt rules, subject to specified
47 limitations; providing an effective date.
