       The Committee on Rules (Latvala) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 49 and 50
    4  insert:
    5         Section 2. Section 366.97, Florida Statures, is created to
    6  read:
    7         366.97 Cost recovery calculations for gas reserve
    8  investments.—
    9         (1) The commission shall annually determine if a public
   10  utility’s natural gas reserve investments produced a savings to
   11  customers in the previous year.
   12         (2) In the event that such investment does not provide a
   13  savings to the customers in the previous year, the amount of the
   14  following year’s cost recovery must be adjusted to remove the
   15  amount of return the company earned in the previous year, if
   16  any.

   19  And the title is amended as follows:
   20         Delete line 9
   21  and insert:
   22         investments; creating s. 366.97, F.S.; requiring the
   23         Public Service Commission to annually determine
   24         whether its natural gas reserve investments provided
   25         cost savings during the previous year; providing for
   26         cost recovery adjustments for natural gas reserve
   27         investments; providing an effective date.
