The Committee on Health Policy (Garcia) recommended the
following:
1 Senate Substitute for Amendment (113088) (with title
2 amendment)

4 Delete everything after the enacting clause
5 and insert:
6 Section 1. Section 458.352, Florida Statutes, is created to
7 read:
8 458.352 Hair restoration or transplant.—
9 (1) As used in this section, the term “hair restoration or
10 transplant” means a surgical procedure that removes hair
11 follicles from the body by coring with a hollow punch and
12 removing the tissue or robotic instrument, by removing or
13 dissecting a strip of tissue from the body containing hair
14 follicles that may be dissected off the strip of tissue, or by
15 extracting or removing hair follicles from one location on a
16 living human body, for the purpose of redistributing the hair
17 follicles to another location on the same human body.
18 (2) A person who is not licensed under this chapter or
19 chapter 459 or certified under s. 464.012 may not perform a hair
20 restoration or transplant or make incisions for the purpose of
21 performing a hair restoration or transplant. This subsection
22 does not restrict a physician’s ability to delegate or supervise
23 an advanced registered nurse practitioner or a physician
24 assistant in the performance of hair restoration or transplant
25 services.
26 Section 2. Section 459.027, Florida Statutes, is created to
27 read:
28 459.027 Hair restoration or transplant.—
29 (1) As used in this section, the term “hair restoration or
30 transplant” means a surgical procedure that removes hair
31 follicles by coring with a hollow punch and removing the tissue
32 or robotic instrument, by removing or dissecting a strip of
33 tissue from the body containing hair follicles that may be
34 dissected off the strip of tissue, or by extracting or removing
35 hair follicles from one location on a living human body, for the
36 purpose of redistributing the hair follicles to another location
37 on the same human body.
38 (2) A person who is not licensed under this chapter or
39 chapter 458 or certified under s. 464.012 may not perform a hair
40 restoration or transplant or make incisions for the purpose of
41 performing a hair restoration or transplant. This subsection
42 does not restrict a physician’s ability to delegate or supervise
43 an advanced registered nurse practitioner or a physician
44 assistant in the performance of hair restoration or transplant
45 services.
46 Section 3. This act shall take effect July 1, 2017.

51 and insert:
52 A bill to be entitled
53 An act relating to hair restoration or transplant;
54 creating ss. 458.352 and 459.027, F.S.; defining the
55 term “hair restoration or transplant”; prohibiting a
56 person who is not licensed under ch. 458, F.S., or ch.
57 459, F.S., or certified under s. 464.012, F.S., from
58 performing a hair restoration or transplant or making
59 incisions for the purpose of performing a hair
60 restoration or transplant; providing construction;
61 providing an effective date.
