       The Committee on Health Policy (Garcia) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Section 458.352, Florida Statutes, is created to
    6  read:
    7         458.352 Hair restoration or transplant.—
    8         (1) As used in this section, the term “hair restoration or
    9  transplant” means a surgical procedure that removes hair
   10  follicles after they have been cored by a hollow punch or
   11  robotic instrument, dissects hair follicles off of the body from
   12  a strip of tissue, or extracts or removes hair follicles from
   13  one location on a living human body for the purpose of
   14  redistributing the hair follicles to another location on such
   15  body.
   16         (2) A person who is not licensed under this chapter or
   17  chapter 459 or certified under s. 464.012 may not perform a hair
   18  restoration or transplant or make incisions for the purpose of
   19  performing a hair restoration or transplant. This subsection
   20  does not restrict a physician’s ability to delegate or supervise
   21  an advanced registered nurse practitioner or a physician
   22  assistant in the performance of hair restoration or transplant
   23  services.
   24         Section 2. Section 459.027, Florida Statutes, is created to
   25  read:
   26         459.027 Hair restoration or transplant.—
   27         (1) As used in this section, the term “hair restoration or
   28  transplant” means a surgical procedure that removes hair
   29  follicles after they have been cored by a hollow punch or
   30  robotic instrument, dissects hair follicles off of the body from
   31  a strip of tissue, or extracts or removes hair follicles from
   32  one location on a living human body for the purpose of
   33  redistributing the hair follicles to another location on such
   34  body.
   35         (2) A person who is not licensed under this chapter or
   36  chapter 458 or certified under s. 464.012 may not perform a hair
   37  restoration or transplant or make incisions for the purpose of
   38  performing a hair restoration or transplant. This subsection
   39  does not restrict a physician’s ability to delegate or supervise
   40  an advanced registered nurse practitioner or a physician
   41  assistant in the performance of hair restoration or transplant
   42  services.
   43         Section 3. This act shall take effect July 1, 2017.

   49                        A bill to be entitled                      
   50         An act relating to hair restoration or transplant;
   51         creating ss. 458.352 and 459.027, F.S.; defining the
   52         term “hair restoration or transplant”; prohibiting a
   53         person who is not licensed under ch. 458, F.S., or ch.
   54         459, F.S., or certified under s. 464.012, F.S., from
   55         performing a hair restoration or transplant or making
   56         incisions for the purpose of performing a hair
   57         restoration or transplant; providing construction;
   58         providing an effective date.
