Subsection (3) is added to section 24.107, 6 Florida Statutes, to read: 7 24.107 Advertising and promotion of lottery games.— 8 (3) Beginning January 1, 2018, every advertisement or 9 promotion of lottery games under this chapter shall include a 10 warning, which must: 11 (a) If on television, the Internet, or other electronic 12 medium, be typed in black font on a white background and occupy 13 no less than 10 percent of the surface area of the advertisement 14 or promotion. 15 (b) If in print, including a newspaper, magazine, or 16 billboard, be typed in black font on a white background and 17 occupy no less than 10 percent of the surface area of the 18 advertisement or promotion. 19 (c) If on radio, be audibly announced at the conclusion of 20 the advertisement or promotion. 21 (d) Contain one of the following messages, with each 22 message appearing in an equal number of advertisements and 23 promotions: 24 1. “WARNING: GAMBLING CAN BE ADDICTIVE.” 25 2. “WARNING: LOTTERY GAMES MAY BE ADDICTIVE.” 26 3. “WARNING: LOTTERY GAMES ARE A FORM OF GAMBLING.” 27 4. “WARNING: YOUR ODDS OF WINNING THE TOP PRIZE ARE 28 EXTREMELY LOW.” 29 5. “WARNING: GAMBLING CAN CAUSE FINANCIAL PROBLEMS.” 30 6. “WARNING: PLAYING THE LOTTERY CONSTITUTES GAMBLING.” 31 Section 2. Subsection (8) is added to section 24.111, 32 Florida Statutes, to read: 33 24.111 Vendors; disclosure and contract requirements.— 34 (8) Beginning January 1, 2018, every contract subject to 35 this section shall contain a provision that requires the vendor 36 to place or print a warning on every lottery ticket sold under 37 this chapter. The required warning must: 38 (a) Appear on the face of each lottery ticket. 39 (b) Be typed in black font on a white background. 40 (c) Occupy no less than 10 percent of the total face of the 41 lottery ticket. 42 (d) Contain one of the following messages, with each 43 message appearing on an equal number of lottery tickets: 44 1. “WARNING: GAMBLING CAN BE ADDICTIVE.” 45 2. “WARNING: LOTTERY GAMES MAY BE ADDICTIVE.” 46 3. “WARNING: LOTTERY GAMES ARE A FORM OF GAMBLING.” 47 4. “WARNING: YOUR ODDS OF WINNING THE TOP PRIZE ARE 48 EXTREMELY LOW.” 49 5. “WARNING: GAMBLING CAN CAUSE FINANCIAL PROBLEMS.” 50 6. “WARNING: PLAYING THE LOTTERY CONSTITUTES GAMBLING.” 51 (e) Appear on every lottery ticket printed under this 52 chapter on or after January 1, 2018. 53 Section 3. Subsections (10) through (15) of section 24.112, 54 Florida Statutes, are renumbered as subsections (11) through 55 (16), respectively, and a new subsection (10) is added to that 56 section, to read: 57 24.112 Retailers of lottery tickets; authorization of 58 vending machines to dispense lottery tickets.— 59 (10) Beginning January 1, 2018, every contract in effect 60 pursuant to this section shall contain a provision that requires 61 the retailer to prominently display a sign, provided by the 62 department, at or near the lottery ticket point of sale which 63 contains the following message: “WARNING: GAMBLING CAN BE 64 ADDICTIVE.” 65 Section 4. This act shall take effect January 1, 2018. 66 67 ================= T I T L E A M E N D M E N T ================ 68 And the title is amended as follows: 69 Delete everything before the enacting clause 70 and insert: 71 A bill to be entitled 72 An act relating to warnings for lottery games; 73 amending s. 24.107, F.S.; requiring every 74 advertisement or promotion of lottery games to include 75 a specified warning; providing requirements for the 76 warning; amending s. 24.111, F.S.; requiring contracts 77 entered into between the Department of the Lottery and 78 a vendor of lottery tickets to include a provision 79 that requires the vendor to place or print a specified 80 warning on all lottery tickets; providing requirements 81 for the warning; amending s. 24.112, F.S.; requiring 82 contracts entered into between the department and a 83 retailer of lottery tickets to include a provision 84 that requires the retailer to prominently display a 85 sign, provided by the department, with a specified 86 warning at the point of sale; providing an effective 87 date.
