1 A bill to be entitled
2 An act relating to warnings for lottery games;
3 amending s. 24.107, F.S.; requiring every
4 advertisement or promotion of lottery games to include
5 a specified warning; providing requirements for the
6 warning; amending s. 24.111, F.S.; requiring contracts
7 entered into between the Department of the Lottery and
8 a vendor of lottery tickets to include a provision
9 that requires the vendor to place or print a specified
10 warning on all lottery tickets; providing requirements
11 for the warning; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Subsection (3) is added to section 24.107,
16 Florida Statutes, to read:
17 24.107 Advertising and promotion of lottery games.—
18 (3) Beginning January 1, 2018, every advertisement or
19 promotion of lottery games under this chapter shall include a
20 warning, which must:
21 (a) If on television, the Internet, or other electronic
22 medium, be typed in black font on a white background and occupy
23 no less than 10 percent of the surface area of the advertisement
24 or promotion.
25 (b) If in print, including a newspaper, magazine, or
26 billboard, be typed in black font on a white background and
27 occupy no less than 10 percent of the surface area of the
28 advertisement or promotion.
29 (c) If on radio, be audibly announced at the conclusion of
30 the advertisement or promotion.
31 (d) Contain one of the following messages, with each
32 message appearing in an equal number of advertisements and
33 promotions:
34 1. “WARNING: GAMBLING CAN BE ADDICTIVE.”
35 2. “WARNING: LOTTERY GAMES MAY BE ADDICTIVE.”
36 3. “WARNING: LOTTERY GAMES ARE A FORM OF GAMBLING.”
37 4. “WARNING: YOUR ODDS OF WINNING THE TOP PRIZE ARE
38 EXTREMELY LOW.”
39 5. “WARNING: GAMBLING CAN CAUSE FINANCIAL PROBLEMS.”
40 6. “WARNING: PLAYING THE LOTTERY CONSTITUTES GAMBLING.”
41 Section 2. Subsection (8) is added to section 24.111,
42 Florida Statutes, to read:
43 24.111 Vendors; disclosure and contract requirements.—
44 (8) Beginning January 1, 2018, every contract subject to
45 this section shall contain a provision that requires the vendor
46 to place or print a warning on every lottery ticket sold under
47 this chapter. The required warning must:
48 (a) Appear on the face of each lottery ticket.
49 (b) Be typed in black font on a white background.
50 (c) Occupy no less than 10 percent of the total face of the
51 lottery ticket.
52 (d) Contain one of the following messages, with each
53 message appearing on an equal number of lottery tickets:
54 1. “WARNING: GAMBLING CAN BE ADDICTIVE.”
55 2. “WARNING: LOTTERY GAMES MAY BE ADDICTIVE.”
56 3. “WARNING: LOTTERY GAMES ARE A FORM OF GAMBLING.”
57 4. “WARNING: YOUR ODDS OF WINNING THE TOP PRIZE ARE
58 EXTREMELY LOW.”
59 5. “WARNING: GAMBLING CAN CAUSE FINANCIAL PROBLEMS.”
60 6. “WARNING: PLAYING THE LOTTERY CONSTITUTES GAMBLING.”
61 (e) Appear on every lottery ticket printed under this
62 chapter on or after January 1, 2018.
63 Section 3. This act shall take effect January 1, 2018.
