4 state minimum wage; providing an effective date.

6 Be It Enacted by the Legislature of the State of Florida:

8 Section 1. Subsection (4) of section 448.110, Florida
9 Statutes, is amended to read:
10 448.110 State minimum wage; annual wage adjustment;
11 enforcement.—
12 (4)(a) Beginning September 30, 2017, and each September 30
13 thereafter through 2021, 2005, and annually on September 30
14 thereafter, the Department of Economic Opportunity shall
15 calculate an adjusted state minimum wage rate by increasing the
16 state minimum wage by the rate of inflation for the 12 months
17 prior to September 1 of that year plus $1 in 2017 and an
18 additional $1.50 for each subsequent year. Beginning September
19 30, 2022, and each September 30 thereafter, the Department of
20 Economic Opportunity shall increase the minimum wage by the rate
21 of inflation for the 12 months prior to September 1 of that
22 year. In calculating the adjusted state minimum wage, the
23 Department of Economic Opportunity shall use the Consumer Price
24 Index for Urban Wage Earners and Clerical Workers, not
25 seasonally adjusted, for the South Region or a successor index
26 as calculated by the United States Department of Labor. Each
27 adjusted state minimum wage rate shall take effect on the
28 following January 1, with the initial adjusted minimum wage rate
29 to take effect on January 1, 2018 2006.
30 (b) The Department of Revenue and the Department of
31 Economic Opportunity shall annually publish the amount of the
32 adjusted state minimum wage and the effective date. Publication
33 shall occur by posting the adjusted state minimum wage rate and
34 the effective date on the Internet home pages of the Department
35 of Economic Opportunity and the Department of Revenue by October
36 15 of each year. In addition, to the extent funded in the
37 General Appropriations Act, the Department of Economic
38 Opportunity shall provide written notice of the adjusted rate
39 and the effective date of the adjusted state minimum wage to all
40 employers registered in the most current reemployment assistance
41 database. Such notice shall be mailed by November 15 of each
42 year using the addresses included in the database. Employers are
43 responsible for maintaining current address information in the
44 reemployment assistance database. The Department of Economic
45 Opportunity is not responsible for failure to provide notice due
46 to incorrect or incomplete address information in the database.
47 The Department of Economic Opportunity shall provide the
48 Department of Revenue with the adjusted state minimum wage rate
49 information and effective date in a timely manner.
50 Section 2. This act shall take effect July 1, 2017.
