    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating s. 945.21504,
    3         F.S.; creating the Federal Law Enforcement Trust Fund
    4         within the Department of Corrections; authorizing
    5         sources of funds; specifying that balances in the
    6         trust fund carry over to the following fiscal year;
    7         exempting the trust fund from specified service
    8         charges; providing for future review and termination
    9         or re-creation of the trust fund; providing an
   10         effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Section 945.21504, Florida Statutes, is created
   15  to read:
   16         945.21504 Federal Law Enforcement Trust Fund.—
   17         (1) The Federal Law Enforcement Trust Fund is created
   18  within the Department of Corrections. The department may deposit
   19  into the trust fund receipts and revenues received as a result
   20  of federal criminal, administrative, or forfeiture proceedings
   21  and receipts and revenues received from federal asset-sharing
   22  programs to support law enforcement activities within the
   23  department.
   24         (2) Notwithstanding s. 216.301 and pursuant to s. 216.351,
   25  any balance in the trust fund at the end of any fiscal year will
   26  remain in the trust fund and be available for carrying out the
   27  purposes of the trust fund. The trust fund is exempt from the
   28  service charges imposed by s. 215.20.
   29         (3) In accordance with s. 19(f)(2), Art. III of the State
   30  Constitution, the Federal Law Enforcement Trust Fund shall,
   31  unless terminated sooner, be terminated on July 1, 2021. Before
   32  its scheduled termination, the trust fund shall be reviewed as
   33  provided under s. 215.3206(1) and (2).
   34         Section 2. This act shall take effect July 1, 2017.
