Florida Senate - 2017 CS for SB 282 By the Committee on Community Affairs; and Senator Steube 578-02733-17 2017282c1 1 A bill to be entitled 2 An act relating to towing and storage fees; amending 3 s. 323.002, F.S.; prohibiting counties and 4 municipalities from imposing additional charges, 5 costs, expenses, fines, fees, or penalties on a 6 registered owner or lienholder of a vehicle; providing 7 an exception; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Subsection (5) is added to section 323.002, 12 Florida Statutes, to read: 13 323.002 County and municipal wrecker operator systems; 14 penalties for operation outside of system.— 15 (5)(a) Except as provided in paragraph (b), a county or 16 municipality may not adopt or maintain in effect an ordinance or 17 rule that imposes a charge, cost, expense, fine, fee, or 18 penalty, other than the reasonable costs of towing and storage 19 incurred by an authorized wrecker operator, on the registered 20 owner or lienholder of a vehicle removed and impounded by an 21 authorized wrecker operator under this chapter. 22 (b) A county or municipality may impose a reasonable fee or 23 charge for towing and storage expenses, not to exceed the 24 maximum rates approved by ordinance or rule under s. 125.0103 or 25 s. 166.043, on the legal owner of a vehicle if a county or 26 municipal law enforcement officer has caused the owner’s vehicle 27 to be towed to and impounded at a facility owned by the county 28 or municipality. 29 Section 2. This act shall take effect July 1, 2017.
