       Senator Clemens moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 621 - 636
    4  and insert:
    5  guardian; patients who are eligible to receive marijuana for
    6  medical use in their state of permanent residence and hold a
    7  valid patient identification card or its equivalent; and
    8  caregivers registered pursuant to subsection (6).
    9         1. Before issuing an identification card to a patient, the
   10  department must determine that:
   11         a. The patient is a permanent resident of the state or, for
   12  a patient under the age of 18, the patient’s parent or legal
   13  guardian is a permanent resident of the state. The patient, or
   14  the parent or legal guardian of the patient, must prove
   15  permanent residency by providing the department with a copy of a
   16  valid Florida driver license or Florida identification card, a
   17  copy of a utility bill in his or her name issued within the
   18  prior 90 days which shows an address in this state, or a copy of
   19  his or her Florida voter information card.
   20         b. If the patient is not a permanent resident of the state
   21  and he or she is eligible to receive marijuana in his or her
   22  state of permanent residence:
   23         (I) The patient, or the parent or legal guardian of the
   24  patient holds a valid patient identification card or its
   25  equivalent issued within his or her state of permanent residence
   26  to the department; or
   27         (II) The patient has been issued a physician certification
   28  that meets the requirements of subsection (3), and he or she
   29  will be remaining in this state for at least
