House Comm: RCS . 04/04/2017 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Health Policy (Bradley) recommended the following: 1 Senate Amendment 2 3 Delete lines 502 - 522 4 and insert: 5 (d) By October 3, 2017, register five additional MMTCs with 6 at least one of the MMTCs being an applicant that is a 7 recognized class member of Pigford v. Glickman, 185 F.R.D. 82 8 (D.D.C. 1999), or In re Black Farmers Litig., 856 F. Supp. 2d 1 9 (D.D.C. 2011), and a member of the Black Farmers and 10 Agriculturalists Association. 11 (e) Within 6 months after each instance of the registration 12 of 75,000 qualifying patients with the compassionate use 13 registry, register four additional MMTCs if a sufficient number 14 of MMTC applicants meet the registration requirements 15 established in this section and by department rule. 16 (f) Not issue more than one registration as an MMTC to a 17 person or an entity. 18 (g)The department shallDevelop an application form for 19 registration as an MMTC and impose an initial application and 20 biennial renewal fee that is sufficient to cover the costs of 21 administering this section. To be registered as an MMTC, thean22 applicantfor approval as a dispensing organizationmust be able 23 to demonstrate: 24 1. That the applicant has been registered to do business in 25 this state for the previous 5 consecutive years before 26 submitting the application.
