House Comm: RCS . 04/04/2017 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Health Policy (Bradley) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Between lines 66 and 67 4 insert: 5 (1) LEGISLATIVE INTENT.— 6 (a) It is the intent of the Legislature to implement s. 29, 7 Art. X of the State Constitution by creating a unified 8 regulatory structure within the framework of this section for 9 the acquisition, cultivation, possession, processing, transfer, 10 transportation, sale, distribution, and dispensing of marijuana, 11 products containing marijuana, related supplies, and educational 12 materials to qualifying patients or their caregivers. 13 (b) The Legislature intends that all rules adopted by the 14 Department of Health to implement this section be adopted 15 pursuant to s. 120.536(1) or s. 120.54. The Legislature intends 16 that the department use emergency rulemaking procedures pursuant 17 to s. 120.54(4) to adopt rules under this section if necessary 18 to meet any deadline for rulemaking established in s. 29, Art. X 19 of the State Constitution. 20 (c) Further, the Legislature intends that all registrations 21 for the purposes specified in paragraph (a) be issued solely in 22 accordance with the requirements of this section and all rules 23 adopted under this section. 24 25 ================= T I T L E A M E N D M E N T ================ 26 And the title is amended as follows: 27 Between lines 3 and 4 28 insert: 29 providing legislative intent;
