6 Section 21. Section 320.08053, Florida Statutes, is amended
7 to read:
8 320.08053 Establishment of Requirements for requests to
9 establish specialty license plates.—
10 (1) If a specialty license plate requested by an
11 organization is approved by law, the organization must submit
12 the proposed art design for the specialty license plate to the
13 department, in a medium prescribed by the department, as soon as
14 practicable, but no later than 60 days after the act approving
15 the specialty license plate becomes a law.
16 (2)(a) Within 120 days following the specialty license
17 plate becoming law, the department shall establish a method to
18 issue a specialty license plate voucher to allow for the presale
19 of the specialty license plate. The processing fee as prescribed
20 in s. 320.08056, the service charge and branch fee as prescribed
21 in s. 320.04, and the annual use fee as prescribed in s.
22 320.08056 shall be charged for the voucher. All other applicable
23 fees shall be charged at the time of issuance of the license
24 plates.
25 (b) Within 24 months after the presale specialty license
26 plate voucher is established, the approved specialty license
27 plate organization must record with the department a minimum of
28 3,000 1,000 voucher sales before manufacture of the license
29 plate may begin commence. If, at the conclusion of the 24-month
30 presale period, the minimum sales requirement has requirements
31 have not been met, the specialty plate is deauthorized and the
32 department shall discontinue development of the plate and
33 discontinue issuance of the presale vouchers. Upon
34 deauthorization of the license plate, a purchaser of the license
35 plate voucher may use the annual use fee collected as a credit
36 towards any other specialty license plate or apply for a refund
37 on a form prescribed by the department.
38 (3)(a) If the Legislature has approved 125 or more
39 specialty license plates, the department may not make any new
40 specialty license plates available for design, presale, or
41 issuance until a sufficient number of plates are discontinued
42 pursuant to s. 320.08056(8) such that the number of plates being
43 issued is reduced to fewer than 125.
44 (b) New specialty license plates that have been approved by
45 law but are awaiting issuance under paragraph (a) shall be
46 issued in the order they appear in s. 320.08056(4) provided that
47 they have met the statutorily required pre-sale requirements.
48 All other provisions of this section must also be met before a
49 plate is issued.
50 Section 22. Subsection (2) is amended, present paragraphs
51 (ff) through (ddd), present paragraphs (fff) through (ppp), and
52 present paragraphs (sss) through (eeee) of subsection (4) of
53 section 320.08056, Florida Statutes, are redesignated as
54 paragraphs (ee) through (ccc), paragraphs (ddd) through (nnn),
55 and paragraphs (ooo) through (aaaa), respectively, and present
56 paragraphs (ee), (eee), (qqq), and (rrr) of that subsection are
57 amended, and new paragraphs (bbbb) through (eeee) and paragraphs
58 (ffff) through (eeeee) are added to that subsection, paragraphs
59 (c), (d), (e), and (f) are added to subsection (8) of that
60 section, and paragraph (a) of subsection (10) of that section is
61 amended, to read:
62 320.08056 Specialty license plates.—
63 (2)(a) The department shall issue a specialty license plate
64 to the owner or lessee of any motor vehicle, except a vehicle
65 registered under the International Registration Plan, a
66 commercial truck required to display two license plates pursuant
67 to s. 320.0706, or a truck tractor, upon request and payment of
68 the appropriate license tax and fees.
69 (b) The department may authorize dealer and fleet specialty
70 license plates. With the permission of the sponsoring specialty
71 license plate organization, a dealer or fleet company may
72 purchase specialty license plates to be used on dealer and fleet
73 vehicles.
74 (c) Notwithstanding s. 320.08058, a dealer or fleet
75 specialty license plate shall include the letters “DLR” or “FLT”
76 on the right side of the license plate. Dealer and fleet
77 specialty license plates must be ordered directly through the
78 department.
79 (4) The following license plate annual use fees shall be
80 collected for the appropriate specialty license plates:
81 (ee) American Red Cross license plate, $25.
82 (eee) Donate Organs-Pass It On license plate, $25.
83 (qqq) St. Johns River license plate, $25.
84 (rrr) Hispanic Achievers license plate, $25.
85 (bbbb) Ducks Unlimited license plate, $25.
86 (cccc) Auburn University license plate, $50.
87 (dddd) Play Ball license plate, $25.
88 (eeee) America the Beautiful license plate, $25.
89 (ffff) Protect Pollinators license plate, $25.
90 (gggg) Florida Native license plate, $25.

117 (c) A person issued a specialty license plate that has been
118 discontinued by the department may keep the discontinued
119 specialty license plate for the remainder of the 10-year license
120 plate replacement period and must pay all other applicable
121 registration fees. However, such person is exempt from paying
122 the applicable specialty license plate fee under subsection (4)
123 for the remainder of the 10-year license plate replacement
124 period.
125 (d) If the department discontinues issuance of a specialty
126 license plate, all annual use fees held or collected by the
127 department shall be distributed within 180 days after the date
128 the specialty license plate is discontinued. Of those fees, the
129 department shall retain an amount sufficient to defray the
130 applicable administrative and inventory closeout costs
131 associated with discontinuance of the plate. The remaining funds
132 shall be distributed to the specified organization or
133 organizations as provided in s. 320.08058.
134 (e) If an organization that is the intended recipient of
135 the funds pursuant to s. 320.08058 no longer exists, the
136 department shall deposit any undisbursed funds into the Highway
137 Safety Operating Trust Fund.
138 (f) Notwithstanding paragraph (a), on January 1 of each
139 year, the department shall discontinue the specialty license
140 plate with the fewest number of plates in circulation over the
141 previous 24 months. A warning letter shall be mailed to the
142 sponsoring organization following the first month in which the
143 total number of valid specialty license plate registrations is
144 the fewest in circulation over the previous 24 months.
145 (10)(a) A specialty license plate annual use fee collected
146 and distributed under this chapter, or any interest earned from
147 those fees, may not be used for commercial or for-profit
148 activities nor for general or administrative expenses, except as
149 authorized by s. 320.08058 or to pay the cost of the audit or
150 report required by s. 320.08062(1). The fees and any interest
151 earned from the fees may be expended only for use in this state
152 unless the annual use fee is derived from the sale of United
153 States Armed Forces and veterans-related specialty license
154 plates pursuant to paragraphs (4)(d), (bb), (kk), (iii), and
155 (uuu) (ll), (kkk), and (yyy) and s. 320.0891 or out-of-state
156 college or university license plates pursuant to paragraphs
157 (4)(cccc), (iiii), and (bbbbb).
158 Section 23. Effective October 1, 2020, paragraph (a) of
159 subsection (8) of section 320.08056, Florida Statutes, is
160 amended to read:
161 320.08056 Specialty license plates.—
162 (8)(a) The department must discontinue the issuance of an
163 approved specialty license plate if the number of valid
164 specialty plate registrations falls below 3,000 1,000 plates for
165 at least 12 consecutive months. A warning letter shall be mailed
166 to the sponsoring organization following the first month in
167 which the total number of valid specialty plate registrations is
168 below 3,000 1,000 plates. This paragraph does not apply to
169 collegiate license plates established under s. 320.08058(3),
170 license plates of institutions in and entities of the State
171 University System, specialty license plates that have statutory
172 eligibility limitations for purchase, or Florida Professional
173 Sports Team License plates established under s. 320.08058(9).
174 Section 20. Present subsections (32) through (56), present
175 subsections (58) through (68), and present subsections (71)
176 through (83) of section 320.08058, Florida Statutes, are
177 redesignated as subsections (31) through (55), subsections (56)
178 through (66), and (67) through (79), respectively, paragraph (a)
179 of subsection (7), present subsections (31) and (57), paragraph
180 (b) of present subsection (66), present subsections (69) and
181 (70), and paragraph (b) of present subsection (80) of that
182 section are amended, and new subsections (80) through (83) and
183 subsections (84) through (109) are added to that section, to
184 read:
185 320.08058 Specialty license plates.—
186 (7) SPECIAL OLYMPICS FLORIDA LICENSE PLATES.—
187 (a) Special Olympics Florida license plates must contain
188 the official Special Olympics Florida logo and must bear a
189 design and colors that are approved by the department. The word
190 “Florida” must be centered at the top bottom of the plate, and
191 the words “Be a Fan” “Everyone Wins” must be centered at the
192 bottom top of the plate.
193 (31) AMERICAN RED CROSS LICENSE PLATES.—
194 (a) Notwithstanding the provisions of s. 320.08053, the
195 department shall develop an American Red Cross license plate as
196 provided in this section. The word “Florida” must appear at the
197 top of the plate, and the words “American Red Cross” must appear
198 at the bottom of the plate.
199 (b) The department shall retain all revenues from the sale
200 of such plates until all startup costs for developing and
201 issuing the plates have been recovered. Thereafter, 50 percent
202 of the annual use fees shall be distributed to the American Red
203 Cross Chapter of Central Florida, with statistics on sales of
204 license plates, which are tabulated by county. The American Red
205 Cross Chapter of Central Florida must distribute to each of the
206 chapters in this state the moneys received from sales in the
207 counties covered by the respective chapters, which moneys must
208 be used for education and disaster relief in Florida. Fifty
209 percent of the annual use fees shall be distributed
210 proportionately to the three statewide approved poison control
211 centers for purposes of combating bioterrorism and other poison
212 related purposes.
213 (57) DONATE ORGANS-PASS IT ON LICENSE PLATES.—
214 (a) The department shall develop a Donate Organs-Pass It On
215 license plate as provided in this section. The word “Florida”
216 must appear at the top of the plate, and the words “Donate
217 Organs-Pass It On” must appear at the bottom of the plate.
218 (b) The annual use fees shall be distributed to Transplant
219 Foundation, Inc., and shall use up to 10 percent of the proceeds
220 from the annual use fee for marketing and administrative costs
221 that are directly associated with the management and
222 distribution of the proceeds. The remaining proceeds shall be
223 used to provide statewide grants for patient services, including
224 preoperative, rehabilitative, and housing assistance; organ
225 donor education and awareness programs; and statewide medical
226 research.
227 (64)(66) IN GOD WE TRUST LICENSE PLATES.—
228 (b) The license plate annual use fees shall be distributed
229 to the In God We Trust Foundation, Inc., which may use up to 10
230 percent of the proceeds to offset administrative costs,
231 promotion, and marketing of the license plate directly
232 associated with the operations of the foundation. The remaining
233 proceeds may be used to address the needs of the military
234 community and the public safety community; provide educational
235 grants and scholarships to foster self-reliance and stability in
236 Florida’s youth; and provide education in to fund educational
237 scholarships for the children of Florida residents who are
238 members of the United States Armed Forces, the National Guard,
239 and the United States Armed Forces Reserve and for the children
240 of public safety employees who have died in the line of duty who
241 are not covered by existing state law. Funds shall also be
242 distributed to other s. 501(c)(3) organizations that may apply
243 for grants and scholarships and to provide educational grants to
244 public and private schools regarding to promote the historical
245 and religious significance of religion in American and Florida
246 history. The In God We Trust Foundation, Inc., shall create an
247 advisory council comprised of persons with knowledge in these
248 program areas to make funding recommendations distribute the
249 license plate annual use fees in the following manner:
250 1. The In God We Trust Foundation, Inc., shall retain all
251 revenues from the sale of such plates until all startup costs
252 for developing and establishing the plate have been recovered.
253 2. Ten percent of the funds received by the In God We Trust
254 Foundation, Inc., shall be expended for administrative costs,
255 promotion, and marketing of the license plate directly
256 associated with the operations of the In God We Trust
257 Foundation, Inc.
258 3. All remaining funds shall be expended by the In God We
259 Trust Foundation, Inc., for programs.
260 (69) ST. JOHNS RIVER LICENSE PLATES.—
261 (a) The department shall develop a St. Johns River license
262 plate as provided in this section. The St. Johns River license
263 plates must bear the colors and design approved by the
264 department. The word “Florida” must appear at the top of the
265 plate, and the words “St. Johns River” must appear at the bottom
266 of the plate.
267 (b) The requirements of s. 320.08053 must be met prior to
268 the issuance of the plate. Thereafter, the license plate annual
269 use fees shall be distributed to the St. Johns River Alliance,
270 Inc., a s. 501(c)(3) nonprofit organization, which shall
271 administer the fees as follows:
272 1. The St. Johns River Alliance, Inc., shall retain the
273 first $60,000 of the annual use fees as direct reimbursement for
274 administrative costs, startup costs, and costs incurred in the
275 development and approval process. Thereafter, up to 10 percent
276 of the annual use fee revenue may be used for administrative
277 costs directly associated with education programs, conservation,
278 research, and grant administration of the organization, and up
279 to 10 percent may be used for promotion and marketing of the
280 specialty license plate.
281 2. At least 30 percent of the fees shall be available for
282 competitive grants for targeted community-based or county-based
283 research or projects for which state funding is limited or not
284 currently available. The remaining 50 percent shall be directed
285 toward community outreach and access programs. The competitive
286 grants shall be administered and approved by the board of
287 directors of the St. Johns River Alliance, Inc. A grant advisory
288 committee shall be composed of six members chosen by the St.
289 Johns River Alliance board members.
290 3. Any remaining funds shall be distributed with the
291 approval of and accountability to the board of directors of the
292 St. Johns River Alliance, Inc., and shall be used to support
293 activities contributing to education, outreach, and springs
294 conservation.
295 4. Effective July 1, 2014, the St. Johns River license
296 plate will shift into the presale voucher phase, as provided in
297 s. 320.08053(2)(b). The St. Johns River Alliance, Inc., shall
298 have 24 months to record a minimum of 1,000 sales of the license
299 plates. Sales include existing active plates and vouchers sold
300 subsequent to July 1, 2014. During the voucher period, new
301 plates may not be issued, but existing plates may be renewed.
302 If, at the conclusion of the 24-month presale period, the
303 requirement of a minimum of 1,000 sales has been met, the
304 department shall resume normal distribution of the St. Johns
305 River specialty plate. If, after 24 months, the minimum of 1,000
306 sales has not been met, the department shall discontinue the
307 development and issuance of the plate. This subparagraph is
308 repealed June 30, 2016.
309 (70) HISPANIC ACHIEVERS LICENSE PLATES.—
310 (a) Notwithstanding the requirements of s. 320.08053, the
311 department shall develop a Hispanic Achievers license plate as
312 provided in this section. The plate must bear the colors and
313 design approved by the department. The word “Florida” must
314 appear at the top of the plate, and the words “Hispanic
315 Achievers” must appear at the bottom of the plate.
316 (b) The proceeds from the license plate annual use fee
317 shall be distributed to National Hispanic Corporate Achievers,
318 Inc., a nonprofit corporation under s. 501(c)(3) of the Internal
319 Revenue Code, to fund grants to nonprofit organizations to
320 operate programs and provide scholarships and for marketing the
321 Hispanic Achievers license plate. National Hispanic Corporate
322 Achievers, Inc., shall establish a Hispanic Achievers Grant
323 Council that shall provide recommendations for statewide grants
324 from available Hispanic Achievers license plate proceeds to
325 nonprofit organizations for programs and scholarships for
326 Hispanic and minority Floridians. National Hispanic Corporate
327 Achievers, Inc., shall also establish a Hispanic Achievers
328 License Plate Fund. Moneys in the fund shall be used by the
329 grant council as provided in this paragraph. All funds received
330 under this subsection must be used in this state.
331 (c) National Hispanic Corporate Achievers, Inc., may retain
332 all proceeds from the annual use fee until documented startup
333 costs for developing and establishing the plate have been
334 recovered. Thereafter, the proceeds from the annual use fee
335 shall be used as follows:
336 1. Up to 5 percent of the proceeds may be used for the cost
337 of administration of the Hispanic Achievers License Plate Fund,
338 the Hispanic Achievers Grant Council, and related matters.
339 2. Funds may be used as necessary for annual audit or
340 compliance affidavit costs.
341 3. Up to 20 percent of the proceeds may be used to market
342 and promote the Hispanic Achievers license plate.
343 4. Twenty-five percent of the proceeds shall be used by the
344 Hispanic Corporate Achievers, Inc., located in Seminole County,
345 for grants.
346 5. The remaining proceeds shall be available to the
347 Hispanic Achievers Grant Council to award grants for services,
348 programs, or scholarships for Hispanic and minority individuals
349 and organizations throughout Florida. All grant recipients must
350 provide to the Hispanic Achievers Grant Council an annual
351 program and financial report regarding the use of grant funds.
352 Such reports must be available to the public.
353 (d) Effective July 1, 2014, the Hispanic Achievers license
354 plate will shift into the presale voucher phase, as provided in
355 s. 320.08053(2)(b). National Hispanic Corporate Achievers, Inc.,
356 shall have 24 months to record a minimum of 1,000 sales. Sales
357 include existing active plates and vouchers sold subsequent to
358 July 1, 2014. During the voucher period, new plates may not be
359 issued, but existing plates may be renewed. If, at the
360 conclusion of the 24-month presale period, the requirement of a
361 minimum of 1,000 sales has been met, the department shall resume
362 normal distribution of the Hispanic Achievers license plate. If,
363 after 24 months, the minimum of 1,000 sales has not been met,
364 the department shall discontinue the Hispanic Achievers license
365 plate. This subsection is repealed June 30, 2016.
366 (76)(80) FALLEN LAW ENFORCEMENT OFFICERS LICENSE PLATES.—
367 (b) The annual use fees shall be distributed to the Police
368 and Kids Foundation, Inc., which may use up to a maximum of 10
369 percent of the proceeds for marketing to promote and market the
370 plate. All remaining proceeds shall be distributed to and used
371 by the Police and Kids Foundation, Inc., for its operations,
372 activities, programs, and projects The remainder of the proceeds
373 shall be used by the Police and Kids Foundation, Inc., to invest
374 and reinvest, and the interest earnings shall be used for the
375 operation of the Police and Kids Foundation, Inc.
376 (80) DUCKS UNLIMITED LICENSE PLATES.—
377 (a) The department shall develop a Ducks Unlimited license
378 plate as provided in this section and s. 320.08053. Ducks
379 Unlimited license plates must bear the colors and design
380 approved by the department. The word “Florida” must appear at
381 the top of the plate, and the words “Conserving Florida
382 Wetlands” must appear at the bottom of the plate.
383 (b) The annual use fees from the sale of the plate shall be
384 distributed to Ducks Unlimited, Inc., a nonprofit corporation
385 under s. 501(c)(3) of the Internal Revenue Code, to be used as
386 follows:
387 1. Up to 5 percent may be used for administrative costs and
388 marketing of the plate.
389 2. A minimum of 95 percent shall be used in this state to
390 support the mission and efforts of Ducks Unlimited, Inc., for
391 the conservation, restoration, and management of Florida
392 wetlands and associated habitats for the benefit of waterfowl,
393 other wildlife, and people.
394 (81) AUBURN UNIVERSITY LICENSE PLATES.—
395 (a) The department shall develop an Auburn University
396 license plate as provided in this section and s. 320.08053. The
397 plate must bear the colors and design approved by the
398 department. The word “Florida” must appear at the top of the
399 plate, and the words “War Eagle” must appear at the bottom of
400 the plate.
401 (b) The Tampa Bay Auburn Club is the lead club on behalf of
402 the Auburn clubs in this state. The annual use fees from the
403 sale of the plate shall be distributed to the Tampa Bay Auburn
404 Club, together with statistics on sales of the license plates
405 tabulated by county. The Tampa Bay Auburn Club must distribute
406 to each of the state’s Auburn clubs on a pro-rata basis the
407 moneys received from sales in the regions within the respective
408 club’s area for the purpose of awarding scholarships to Florida
409 residents attending Auburn University. Students receiving these
410 scholarships must be eligible for the Florida Bright Futures
411 Scholarship Program pursuant to s. 1009.531 and shall use the
412 scholarship funds for tuition and other expenses related to
413 attending Auburn University.
414 (82) PLAY BALL LICENSE PLATES.—
415 (a) The department shall develop a Play Ball license plate
416 as provided in this section and s. 320.08053. Play Ball license
417 plates must bear the colors and design approved by the
418 department. The word “Florida” must appear at the top of the
419 plate, and the words “Play Ball” must appear at the bottom of
420 the plate.
421 (b) The license plate annual use fees shall be distributed
422 to American Dream Baseball, Inc., which may retain all proceeds
423 from the annual use fees until the startup costs for developing
424 and issuing the license plates have been recovered. Thereafter,
425 American Dream Baseball, Inc., may use the proceeds as follows:
426 1. A maximum of 10 percent may be used for administrative
427 costs of the organization associated with implementing the
428 programs funded by proceeds derived from sales of the specialty
429 license plate and for the promotion and marketing costs of the
430 license plate.
431 2. The remainder shall be used to fund the activities,
432 programs, and projects of American Dream Baseball, Inc.
433 (83) AMERICA THE BEAUTIFUL LICENSE PLATES.—
434 (a) The department shall develop an America The Beautiful
435 license plate as provided in this section and s. 320.08053. The
436 word “Florida” must appear at the top of the plate, and the
437 words “America The Beautiful” must appear on the plate.
438 (b) The annual use fees from the plate shall be distributed
439 to the America the Beautiful Fund as follows: 10 percent to
440 offset its administrative, marketing and promotion costs, and
441 the remaining 90 percent for projects and programs teaching
442 character, leadership, and service to Florida youth; provision
443 of well-being and assistance in the military community; outdoor
444 education advancing self-sufficiency; wildlife conservation
445 including imperiled and managed species; the maintenance of
446 historic or culturally important sites, buildings, structures,
447 or objects, and the development and modification of playgrounds,
448 recreational areas, or other outdoor amenities, including
449 disability access.
450 (84) PROTECT POLLINATORS LICENSE PLATES.—
451 (a) The department shall develop a Protect Pollinators
452 license plate as provided in this section and s. 320.08053. The
453 word “Florida” must appear at the top of the plate, and the
454 words “Protect Pollinators” must appear at the bottom of the
455 plate.
456 (b) The annual use fees from the sale of the plate shall be
457 distributed to the Florida Wildflower Foundation, Inc., which:
458 1. May use a maximum of 10 percent of the proceeds to
459 market, promote, and administer the Protect Pollinators plate.
460 2. Shall use the remainder of the proceeds to establish
461 pollinator wildflower habitats, fund pollinator education and
462 research programs, and promote awareness of pollinators,
463 including butterflies, native bees and honeybees, hummingbirds,
464 bats, and hundreds of other insects and animal pollinator
465 species, and their importance to Florida agricultural success
466 and the security of the food supply.
467 (85) FLORIDA NATIVE LICENSE PLATES.—
468 (a) The department shall develop a Florida Native license
469 plate as provided in this section and s. 320.08053. The word
470 “Florida” must appear at the top of the plate, and the word
471 “Native” must appear at the bottom of the plate. The plate must
472 contain a camouflage background that includes leaves, flowers,
473 or fronds of a minimum of 12 different Florida native plants.
474 (b) The annual use fees from the sale of the plate shall be
475 distributed to Florida Native Plant Society, a Florida nonprofit
476 corporation, which may use a maximum of 10 percent of such fees
477 for administrative costs and to market and promote the plate.
478 The balance of the fees shall be used by Florida Native Plant
479 Society, to fulfill the mission of the Florida Native Plant
480 Society, where 45 percent is dedicated to maintaining,
481 improving, and restoring public native species, hunting and
482 fishing habitats, and 45 percent is used to promote the
483 cultivation of Florida’s agricultural products through the
484 preservation of native noncrop plants to provide habitats for
485 pollinators and natural enemies to plant pests, and to provide
486 pollen and nectar and undisturbed habitats for bee nesting
487 throughout the growing season.
488 (86) DONATE LIFE FLORIDA LICENSE PLATES.—
489 (a) The department shall develop a Donate Life Florida
490 license plate as provided in this section and s. 320.08053. The
491 plate must bear the colors and design approved by the
492 department. The word “Florida” must appear at the top of the
493 plate, and the words “Donors Save Lives” must appear at the
494 bottom of the plate.
495 (b) The annual use fees from the sale of the plate shall be
496 distributed to Donate Life Florida, which may use up to 10
497 percent of the proceeds for marketing and administrative costs.
498 The remaining proceeds of the annual use fees shall be used by
499 the Donate Life Florida to educate Florida residents on the
500 importance of organ, tissue and eye donation and for the
501 continued maintenance of the Joshua Abbott Organ and Tissue
502 Donor Registry.
503 (87) UNIVERSITY OF ALABAMA LICENSE PLATES.—
504 (a) The department shall develop a University of Alabama
505 license plate as provided in this section and s. 320.08053. The
506 plate must bear the colors and design approved by the
507 department. The word “Florida” must appear at the top of the
508 plate, and the words “Roll Tide” must appear at the bottom of
509 the plate.
510 (b) Pensacola Bama Club is the lead club on behalf of the
511 University of Alabama State Alumni Association in this state.
512 The annual use fees from the sale of the plate shall be
513 distributed to Pensacola Bama Club, together with statistics on
514 sales of the license plates tabulated by county. Pensacola Bama
515 Club must distribute to each of the state’s University of
516 Alabama Booster Clubs on a pro-rata basis the moneys received
517 from sales in the regions within the respective club’s area for
518 the purpose of awarding scholarships to Florida residents
519 attending the University of Alabama. Students receiving these
520 scholarships must be eligible for the Florida Bright Futures
521 Scholarship Program pursuant to s. 1009.531 and shall use the
522 scholarship funds for tuition and other expenses related to
523 attending the University of Alabama.
524 (88) OMEGA PSI PHI FRATERNITY LICENSE PLATES.—
525 (a) The department shall develop an Omega Psi Phi
526 Fraternity license plate as provided in this section and s.
527 320.08053. The plate must bear the colors and design approved by
528 the department. The word “Florida” must appear at the top of the
529 plate, and the words “Omega Psi Phi” must appear at the bottom
530 of the plate.
531 (b) The annual use fees from the sale of the plate shall be
532 distributed to the State of Florida Omega Friendship Foundation,
533 Inc., to be used as follows:
534 1. Five percent shall be used solely for marketing of the
535 Omega Psi Phi Fraternity license plate.
536 2. Ninety-five percent shall be used for college
537 scholarships for residents of the state attending historically
538 black colleges and universities in the state.
539 (89) DELTA SIGMA THETA SORORITY LICENSE PLATES.—
540 (a) The department shall develop a Delta Sigma Theta
541 Sorority license plate as provided in this section and s.
542 320.08053. The plate must bear the colors and design approved by
543 the department. The word “Florida” must appear at the top of the
544 plate, and the words “Delta Sigma Theta” must appear at the
545 bottom of the plate.
546 (b) The annual use fees from the sale of the plate shall be
547 distributed to the Delta Research and Educational Foundation,
548 Inc., to be used as follows:
549 1. Five percent shall be used solely for marketing of the
550 Delta Sigma Theta Sorority license plate.
551 2. Ninety-five percent shall be used for college
552 scholarships for residents of the state attending historically
553 black colleges and universities in the state.
554 (90) SIGMA GAMMA RHO SORORITY LICENSE PLATES.—
555 (a) The department shall develop a Sigma Gamma Rho Sorority
556 license plate as provided in this section and s. 320.08053. The
557 plate must bear the colors and design approved by the
558 department. The word “Florida” must appear at the top of the
559 plate, and the words “Sigma Gamma Rho” must appear at the bottom
560 of the plate.
561 (b) The annual use fees from the sale of the plate shall be
562 distributed to the Department of Education to be used for the
563 Mary McLeod Bethune Scholarship Program in accordance with s.
564 1009.73.
565 (91) KAPPA ALPHA PSI FRATERNITY LICENSE PLATES.—
566 (a) The department shall develop a Kappa Alpha Psi
567 Fraternity license plate as provided in this section and s.
568 320.08053. The plate must bear the colors and design approved by
569 the department. The word “Florida” must appear at the top of the
570 plate, and the words “Kappa Alpha Psi” must appear at the bottom
571 of the plate.
572 (b) The annual use fees from the sale of the plate shall be
573 distributed to the Southern Province of Kappa Alpha Psi
574 Foundation, Inc., to be used as follows:
575 1. Five percent shall be used solely for marketing of the
576 Kappa Alpha Psi Fraternity license plate.
577 2. Ninety-five percent shall be used for college
578 scholarships for residents of the state attending historically
579 black colleges and universities in the state.
580 (92) ALPHA KAPPA ALPHA SORORITY LICENSE PLATES.—
581 (a) The department shall develop an Alpha Kappa Alpha
582 Sorority license plate as provided in this section and s.
583 320.08053. The plate must bear the colors and design approved by
584 the department. The word “Florida” must appear at the top of the
585 plate, and the words “Alpha Kappa Alpha” must appear at the
586 bottom of the plate.
587 (b) The annual use fees from the sale of the plate shall be
588 distributed to the Alpha Kappa Alpha Educational Advancement
589 Foundation, Inc., to be used as follows:
590 1. Five percent shall be used solely for marketing of the
591 Alpha Kappa Alpha Sorority license plate.
592 2. Ninety-five percent shall be used for college
593 scholarships for residents of the state attending historically
594 black colleges and universities in the state.
595 (93) ALPHA PHI ALPHA FRATERNITY LICENSE PLATES.—
596 (a) The department shall develop an Alpha Phi Alpha
597 Fraternity license plate as provided in this section and s.
598 320.08053. The plate must bear the colors and design approved by
599 the department. The word “Florida” must appear at the top of the
600 plate, and the words “Alpha Phi Alpha” must appear at the bottom
601 of the plate.
602 (b) The annual use fees from the sale of the plate shall be
603 distributed to the Department of Education to be used for the Jc
604 Rawls-Ffac Foundation, Inc.
605 (94) ZETA PHI BETA SORORITY LICENSE PLATES.—
606 (a) The department shall develop a Zeta Phi Beta Sorority
607 license plate as provided in this section and s. 320.08053. The
608 plate must bear the colors and design approved by the
609 department. The word “Florida” must appear at the top of the
610 plate, and the words “Zeta Phi Beta” must appear at the bottom
611 of the plate.
612 (b) The annual use fees from the sale of the plate shall be
613 distributed to the Department of Education to be used for the
614 Mary McLeod Bethune Scholarship Program in accordance with s.
615 1009.73.
616 (95) PHI BETA SIGMA FRATERNITY LICENSE PLATES.—
617 (a) The department shall develop a Phi Beta Sigma
618 Fraternity license plate as provided in this section and s.
619 320.08053. The plate must bear the colors and design approved by
620 the department. The word “Florida” must appear at the top of the
621 plate, and the words “Phi Beta Sigma” must appear at the bottom
622 of the plate.
623 (b) The annual use fees from the sale of the plate shall be
624 distributed to the Department of Education to be used for the
625 Mary McLeod Bethune Scholarship Program in accordance with s.
626 1009.73.
627 (96) IOTA PHI THETA FRATERNITY LICENSE PLATES.—
628 (a) The department shall develop an Iota Phi Theta
629 Fraternity license plate as provided in this section and s.
630 320.08053. The plate must bear the colors and design approved by
631 the department. The word “Florida” must appear at the top of the
632 plate, and the words “Iota Phi Theta” must appear at the bottom
633 of the plate.
634 (b) The annual use fees from the sale of the plate shall be
635 distributed to the Department of Education to be used for the
636 Mary McLeod Bethune Scholarship Program in accordance with s.
637 1009.73.
638 (97) DAN MARINO FOUNDATION LICENSE PLATES.—
639 (a) The department shall develop a Dan Marino Foundation
640 license plate as provided in this section and s. 320.08053. Dan
641 Marino Foundation license plates must bear the colors and design
642 approved by the department. The word “Florida” must appear at
643 the top of the plate, and the words “Marino Campus” must appear
644 at the bottom of the plate.
645 (b) The annual use fees from the sale of the plate shall be
646 distributed to the Dan Marino Foundation, Inc., a Florida
647 nonprofit corporation, which may use up to 10 percent of such
648 fees for administrative costs and marketing of the plate. The
649 remainder of the fees shall be used by the Dan Marino
650 Foundation, Inc., to assist Floridians with developmental
651 disabilities to become employed, independent, and productive,
652 and to promote and fund educational scholarships and awareness
653 of these services.
654 (98) FLORIDA STATE BEEKEEPERS ASSOCIATION LICENSE PLATES.—
655 (a) The department shall develop a Florida State Beekeepers
656 Association license plate as provided in this section and s.
657 320.08053. The plate must bear the colors and design approved by
658 the department. The word “Florida” must appear at the top of the
659 plate, and the words “Save the Bees” must appear at the bottom
660 of the plate.
661 (b) The annual use fees shall be distributed to the Florida
662 State Beekeepers Association, a Florida nonprofit corporation.
663 The Florida State Beekeepers Association may use up to 18
664 percent of the annual use fees for:
665 1. Direct reimbursement for administrative costs, startup
666 costs, and costs incurred in the development and approval
667 process of the license plate. All vendors associated with the
668 administrative costs shall be selected by competitive bid.
669 2. Promotion and marketing costs of the license plate.
670 (c) The remaining funds shall be distributed to the Florida
671 State Beekeepers Association and shall be used to raise
672 awareness of the importance of beekeeping to Florida agriculture
673 by funding honeybee research, education, outreach, and
674 husbandry. The Florida State Beekeepers Association board of
675 managers must approve and is accountable for all such
676 expenditures.
677 (99) ORLANDO UNITED LICENSE PLATES.—
678 (a) The department shall develop an Orlando United license
679 plate as provided in this section and s. 320.08053. The plate
680 must bear the colors and design approved by the department. The
681 word “Florida” must appear at the top of the plate, and the
682 words “Orlando United” must appear at the bottom of the plate.
683 (b) The annual use fees from the sale of the plate shall be
684 distributed as follows:
685 1. Seven percent shall be distributed to the Mental Health
686 Association of Central Florida, Inc., to be used for marketing
687 of the license plate.
688 2. Thirty-one percent shall be distributed to the Mental
689 Health Association of Central Florida, Inc. Of this amount, up
690 to 5 percent may be used for administrative expenses, and the
691 remainder shall be used to offer free personalized counseling to
692 any person affected by the shooting at the Pulse nightclub in
693 Orlando, Florida, on June 12, 2016.
694 3. Thirty-one percent shall be distributed to the Hispanic
695 Federation, Inc., a charitable, not-for-profit organization
696 under s. 501(c)(3) of the Internal Revenue Code registered with
697 the Department of Agriculture and Consumer Services and
698 incorporated in New York. Of this amount, up to 5 percent may be
699 used for administrative expenses, and the remainder shall be
700 used to offer free personalized counseling to any person
701 affected by the shooting at the Pulse nightclub in Orlando,
702 Florida, on June 12, 2016, through the Proyecto Somos Orlando
703 campaign operated by the Hispanic Federation, Inc.
704 4. Thirty-one percent shall be distributed to Two Spirit
705 Health Services, Inc. Of this amount, up to 5 percent may be
706 used for administrative expenses, and the remainder shall be
707 used to offer free personalized counseling to any person
708 affected by the shooting at the Pulse nightclub in Orlando,
709 Florida, on June 12, 2016.
710 (100) ETHICAL ECOTOURISM LICENSE PLATES.—
711 (a) The department shall develop an Ethical Ecotourism
712 license plate as provided in this section and s. 320.08053. The
713 word “Florida” must appear at the top of the plate, and words
714 that are approved by the department must appear at the bottom of
715 the plate.
716 (b) The annual use fees from the sale of the plate shall be
717 distributed equally between the Florida Society for Ethical
718 Ecotourism and Paddle Florida, Inc., each of which may use up to
719 10 percent of the proceeds for administrative costs and
720 marketing of the plate. The balance of the annual use fees shall
721 be used by the Florida Society for Ethical Ecotourism to provide
722 environmental education and awareness that encourages behaviors
723 that contribute to the sustainability of Florida’s natural
724 ecosystems and resources and Paddle Florida, Inc., to raise
725 awareness about water conservation, wildlife preservation,
726 restoration of springs, and protection of waterways in this
727 state.
728 (101) ROTARY LICENSE PLATES.—
729 (a) The department shall develop a Rotary license plate as
730 provided in this section and s. 320.08053. The plate must bear
731 the colors and design approved by the department. The word
732 “Florida” must appear at the top of the plate, and the word
733 “Rotary” must appear on the bottom of the plate. The license
734 plate must bear the Rotary International wheel emblem.
735 (b) The annual use fees shall be distributed to the
736 Community Foundation of Tampa Bay, Inc., to distribute as
737 follows:
738 1. Up to 10 percent for administrative costs and for
739 marketing of the plate.
740 2. Ten percent to Rotary’s Camp Florida for direct support
741 to all programs and services provided to special needs children
742 who attend the camp.
743 3. The remainder shall be distributed, proportionally based
744 on sales, to each Rotary district in the state in support of
745 Rotary youth programs in Florida.
746 (102) BEAT CHILDHOOD CANCER LICENSE PLATES.—
747 (a) The department shall develop a Beat Childhood Cancer
748 license plate as provided in this section and s. 320.08053. The
749 plate must bear the colors and design approved by the
750 department. The word “Florida” must appear at the top of the
751 plate, and the words “Beat Childhood Cancer” must appear at the
752 bottom of the plate.
753 (b) The annual use fees from the sale of the plate shall be
754 distributed to Beat Nb, Inc., which may use up to 10 percent of
755 the proceeds for administrative costs directly associated with
756 the operation of the corporation and for marketing and promoting
757 the plate. The remaining proceeds shall be used by the
758 corporation to fund pediatric cancer treatment and research.
759 (103) AMERICAN EAGLE LICENSE PLATES.—
760 (a) The department shall develop an American Eagle license
761 plate as provided in this section and s. 320.08053. The plate
762 must bear the colors and design approved by the department. The
763 word “Florida” must appear at the top of the plate, and the
764 words “In God We Trust” must appear at the bottom of the plate.
765 (b) The annual use fees from the sale of the plate shall be
766 distributed to the American Eagle Foundation for deposit in the
767 foundation’s national endowment fund. Up to 10 percent of the
768 funds received may be used for administrative costs and
769 marketing of the plate. The American Eagle Foundation shall use
770 the remainder of the proceeds to fund public education programs,
771 rescue and care programs, and other conservation efforts in
772 Florida which benefit bald eagles.
773 (104) FLORIDA BAY FOREVER LICENSE PLATES.—
774 (a) The department shall develop a Florida Bay Forever
775 license plate as provided in this section and s. 320.08053. The
776 plate must bear the colors and design approved by the
777 department. The word “Florida” must appear at the top of the
778 plate, and the words “Florida Bay Forever” must appear at the
779 bottom of the plate.
780 (b) The annual use fees from the sale of the plate shall be
781 distributed to the Florida National Park Association, Inc.,
782 which may use up to 10 percent of the proceeds for
783 administrative costs and marketing of the plate. The remainder
784 of the funds shall be used to supplement the Everglades National
785 Park’s budgets and to support educational, interpretive,
786 historical, and scientific research relating to the Everglades
787 National Park.
788 (105) BONEFISH AND TARPON TRUST LICENSE PLATES.—
789 (a) The department shall develop a Bonefish and Tarpon
790 Trust license plate as provided in this section. The word
791 “Florida” must appear at the top of the plate, and the words
792 “Bonefish and Tarpon Trust” must appear at the bottom of the
793 plate.
794 (b) The annual use fees from the sale of the plate shall be
795 distributed to the Bonefish and Tarpon Trust, which:
796 1. May use a maximum of 10 percent of the proceeds to
797 promote and market the Bonefish and Tarpon Trust license plate.
798 2. The remainder of the proceeds shall be used to conserve
799 and enhance Florida bonefish and tarpon fisheries and their
800 respective environments through stewardship, research,
801 education, and advocacy.
802 (106) UNIVERSITY OF GEORGIA LICENSE PLATES.—
803 (a) The department shall develop a University of Georgia
804 license plate as provided in this section and s. 320.08053. The
805 plate must bear the colors and design approved by the
806 department. The word “Florida” must appear at the top of the
807 plate, and the words “The University of Georgia” must appear at
808 the bottom of the plate.
809 (b) The Georgia Bulldog Club of Jacksonville is the lead
810 club on behalf of the University of Georgia Booster Clubs in
811 this state. The annual use fees from the sale of the plate shall
812 be distributed to the Georgia Bulldog Club of Jacksonville,
813 together with statistics on sales of the license plates
814 tabulated by county. The Georgia Bulldog Club of Jacksonville
815 must distribute to each of the state’s University of Georgia
816 Booster Clubs on a pro-rata basis the moneys received from sales
817 in the regions within the respective club’s area for the purpose
818 of awarding scholarships to Florida residents attending the
819 University of Georgia. Students receiving these scholarships
820 must be eligible for the Florida Bright Futures Scholarship
821 Program pursuant to s. 1009.531 and shall use the scholarship
822 funds for tuition and other expenses related to attending the
823 University of Georgia.
824 (107) SUPPORT OUR CONSTITUTION LICENSE PLATES.—
825 (a) The department shall develop a Support Our Constitution
826 license plate as provided in this section and s. 320.08053.
827 Support Our Constitution license plates must bear the colors and
828 design approved by the department. The word “Florida” must
829 appear at the top of the plate, and the words “Support Our
830 Constitution” must appear at the bottom of the plate.
831 (b) The annual use fees shall be distributed to The
832 Constitution Foundation, Inc. The Constitution Foundation, Inc.,
833 shall use the proceeds as follows:
834 1. A maximum of 10 percent may be used for administrative
835 costs of the organization and promotion and the marketing costs
836 of the license plate.
837 2. The remainder shall be used to fund the activities,
838 programs, projects, and mission of The Constitution Foundation,
839 Inc., to increase awareness and understanding of the United
840 States Constitution in Florida’s public schools, recruit and
841 train school leaders to make presentations in each school
842 district, and provide to each student, at no charge, learning
843 materials and a pocket Constitution.
844 (108) RONALD REAGAN LICENSE PLATES.—
845 (a) The department shall develop a Ronald Reagan license
846 plate as provided in this section and s. 320.08053. The plate
847 must bear the colors and design approved by the department. The
848 word “Florida” must appear at the top of the plate, and the
849 words “President Ronald Reagan” must appear at the bottom of the
850 plate.
851 (b) The annual use fees from the sale of the plate shall be
852 distributed to Florida Ronald Reagan Centennial, Inc., to be
853 used as follows:
854 1. Ten percent shall be used for marketing and
855 administrative costs.
856 2. Forty-five percent shall be distributed to the Florida
857 National Guard Foundation.
858 3. Forty-five percent shall be used to support ongoing
859 research of Alzheimer’s disease for the benefit of Florida
860 residents and their families who suffer from the disease.
861 (109) SUN SEA SMILES LICENSE PLATES.—
862 (a) The department shall develop a Sun Sea Smiles license
863 plate as provided in this section and s. 320.08053. The plate
864 must bear the colors and design approved by the department. The
865 word “Florida” must appear at the top of the plate, and the
866 words “Sun Sea Smiles” must appear at the bottom of the plate.
867 (b) The annual use fees from the sale of the plate shall be
868 distributed as follows:
869 1. Five percent shall be distributed to the Florida
870 Caribbean Charitable Foundation, Inc., to be used only for
871 marketing of the Sun Sea Smiles license plate.
872 2. An additional 15.83 percent shall be distributed to the
873 Florida Caribbean Charitable Foundation, Inc. Of this amount, up
874 to 5 percent may be used for administrative expenses, and the
875 remainder shall be used as follows:
876 a. Sixty percent shall be used for a college scholarship
877 program.
878 b. Fifteen percent shall be used to promote health and
879 wellness for residents in this state who are of Caribbean
880 descent.
881 c. Twenty-five percent shall be used to promote awareness
882 of Caribbean culture within this state.
883 3. 15.85 percent shall be distributed to the American
884 Friends of Jamaica, Inc., a charitable, nonprofit organization
885 under s. 501(c)(3) of the Internal Revenue Code registered with
886 the Department of Agriculture and Consumer Services and
887 incorporated in New York, to be used as grants to promote social
888 and community development among residents of this state. Of this
889 amount, up to 5 percent may be used for administrative and
890 marketing expenses.
891 4. 15.83 percent shall be distributed to Haitian
892 Neighborhood Center Sant La, Inc., to be used to promote social
893 and community development. Of this amount, up to 5 percent may
894 be used for administrative expenses.
895 5. 15.83 percent shall be distributed to Fanm Ayisyen nan
896 Miyami, Inc., to be used to promote social and community
897 development. Of this amount, up to 10 percent may be used for
898 administrative expenses.
899 6. 15.83 percent shall be distributed to Greater Caribbean
900 American Cultural Coalition, Inc., to be used to promote
901 awareness of Caribbean culture within this state. Of this
902 amount, up to 5 percent may be used for administrative expenses.
903 7. 15.83 percent shall be distributed to Little Haiti
904 Optimist Foundation, Inc., to be used to promote awareness of
905 Caribbean culture and youth development within this state. Of
906 this amount, up to 5 percent may be used for administrative
907 expenses.
908 Section 24. Section 320.08062, Florida Statutes, is amended
909 to read:
910 320.08062 Audits and attestations required; annual use fees
911 of specialty license plates.—
912 (1)(a) All organizations that receive annual use fee
913 proceeds from the department are responsible for ensuring that
914 proceeds are used in accordance with ss. 320.08056 and
915 320.08058.
916 (b) Any organization not subject to audit pursuant to s.
917 215.97 shall annually attest, under penalties of perjury, that
918 such proceeds were used in compliance with ss. 320.08056 and
919 320.08058. The attestation shall be made annually in a form and
920 format determined by the department. In addition, the department
921 shall audit any such organization every 2 years to ensure
922 proceeds have been used in compliance with ss. 320.08056 and
923 320.08058.
924 (c) Any organization subject to audit pursuant to s. 215.97
925 shall submit an audit report in accordance with rules
926 promulgated by the Auditor General. The annual attestation shall
927 be submitted to the department for review within 9 months after
928 the end of the organization’s fiscal year.
929 (2)(a) Within 120 days after receiving an organization’s
930 audit or attestation, the department shall determine which
931 recipients of revenues from specialty license plate annual use
932 fees have not complied with subsection (1). In determining
933 compliance, the department may commission an independent
934 actuarial consultant, or an independent certified public
935 accountant, who has expertise in nonprofit and charitable
936 organizations.
937 (b) The department must discontinue the distribution of
938 revenues to any organization failing to submit the required
939 documentation as required in subsection (1), but may resume
940 distribution of the revenues upon receipt of the required
941 information.
942 (c) If the department or its designee determines that an
943 organization has not complied or has failed to use the revenues
944 in accordance with ss. 320.08056 and 320.08058, the department
945 must discontinue the distribution of the revenues to the
946 organization. The department shall notify the organization of
947 its findings and direct the organization to make the changes
948 necessary in order to comply with this chapter. If the officers
949 of the organization sign an affidavit under penalties of perjury
950 stating that they acknowledge the findings of the department and
951 attest that they have taken corrective action and that the
952 organization will submit to a followup review by the department,
953 the department may resume the distribution of revenues.
954 (d) If an organization fails to comply with the
955 department’s recommendations and corrective actions as outlined
956 in paragraph (c), the revenue distributions shall be
957 discontinued until completion of the next regular session of the
958 Legislature. The department shall notify the President of the
959 Senate and the Speaker of the House of Representatives by the
960 first day of the next regular session of any organization whose
961 revenues have been withheld as a result of this paragraph. If
962 the Legislature does not provide direction to the organization
963 and the department regarding the status of the undistributed
964 revenues, the department shall deauthorize the plate and the
965 undistributed revenues shall be immediately deposited into the
966 Highway Safety Operating Trust Fund.
967 (3) The department or its designee has the authority to
968 examine all records pertaining to the use of funds from the sale
969 of specialty license plates.
970 Section 25. Paragraph (b) of subsection (4) of section
971 320.08068, Florida Statutes, is amended to read:
972 320.08068 Motorcycle specialty license plates.—
973 (4) A license plate annual use fee of $20 shall be
974 collected for each motorcycle specialty license plate. Annual
975 use fees shall be distributed to The Able Trust as custodial
976 agent. The Able Trust may retain a maximum of 10 percent of the
977 proceeds from the sale of the license plate for administrative
978 costs. The Able Trust shall distribute the remaining funds as
979 follows:
980 (b) Twenty percent to Preserve Vision Prevent Blindness
981 Florida.
982 Section 26. Subsection (5) is added to section 320.0842,
983 Florida Statutes, to read:
984 320.0842 Free motor vehicle license plates to veterans who
985 use wheelchairs.—
986 (5) An owner or lessee of a motor vehicle who resides in
987 this state and qualifies for a license plate under this section
988 and a Purple Heart license plate under s. 320.089, upon
989 application to the department, shall be issued a license plate
990 stamped with the words “Combat-wounded Veteran” followed by the
991 serial number of the license plate and the international symbol
992 of accessibility. The license plate entitles the person to all
993 privileges afforded by a license plate issued under this
994 section. When more than one registrant is listed on the
995 registration issued under this section, the eligible applicant
996 shall be noted on the registration certificate.
997 Section 27. Section 320.0875, Florida Statutes, is created
998 to read:
999 320.0875 Purple Heart motorcycle special license plate.—
1000 (1) Upon application to the department and payment of the
1001 license tax for the motorcycle as provided in s. 320.08, a
1002 resident of this state who owns or leases a motorcycle that is
1003 not used for hire or commercial use shall be issued a Purple
1004 Heart motorcycle special license plate if he or she provides
1005 documentation acceptable to the department that he or she is a
1006 recipient of the Purple Heart medal.
1007 (2) The Purple Heart motorcycle special license plate shall
1008 be stamped with the words “Combat-wounded Veteran” followed by
1009 the serial number of the license plate. The Purple Heart
1010 motorcycle special license plate may have the words “Purple
1011 Heart” stamped on the plate and the likeness of the Purple Heart
1012 medal appearing on the plate.
1013 Section 28. Section 320.089, Florida Statutes, is amended
1014 to read:
1015 320.089 Veterans of the United States Armed Forces; members
1016 of National Guard; survivors of Pearl Harbor; Purple Heart medal
1017 recipients; active or retired United States Armed Forces
1018 reservists; Combat Infantry Badge, Combat Medical Badge, or
1019 Combat Action Badge recipients; Combat Action Ribbon recipients;
1020 Air Force Combat Action Medal recipients; Distinguished Flying
1021 Cross recipients; former prisoners of war; Korean War Veterans;
1022 Vietnam War Veterans; Operation Desert Shield Veterans;
1023 Operation Desert Storm Veterans; Operation Enduring Freedom
1024 Veterans; Operation Iraqi Freedom Veterans; Women Veterans;
1025 World War II Veterans; and Navy Submariners; Special license
1026 plates for military servicemembers, veterans, and Pearl Harbor
1027 Survivors; fee.—
1028 (1)(a) Upon application to the department and payment of
1029 the license tax for the vehicle as provided in s. 320.08, a
1030 resident of the state who owns or leases Each owner or lessee of
1031 an automobile or truck for private use or recreational vehicle
1032 as specified in s. 320.08(9)(c) or (d), which is not used for
1033 hire or commercial use, shall be issued a license plate pursuant
1034 to the following if the applicant provides the department with
1035 proof that he or she meets the qualifications listed in this
1036 section for the applicable license plate:
1037 1. A person released or discharged from any branch who is a
1038 resident of the state and a veteran of the United States Armed
1039 Forces shall be issued a license plate stamped with the words
1040 “Veteran” or “Woman Veteran” followed by the serial number of
1041 the license plate., a Woman Veteran,
1042 2. A World War II Veteran shall be issued a license plate
1043 stamped with the words “WWII Veteran” followed by the serial
1044 number of the license plate.,
1045 3. A Navy Submariner shall be issued a license plate
1046 stamped with the words “Navy Submariner” followed by the serial
1047 number of the license plate.,
1048 4. An active or retired member of the Florida National
1049 Guard shall be issued a license plate stamped with the words
1050 “National Guard” followed by the serial number of the license
1051 plate.
1052 5. A member of the Pearl Harbor Survivors Association or
1053 other person on active military duty in Pearl Harbor on December
1054 7, 1941, shall be issued a license plate stamped with the words
1055 “Pearl Harbor Survivor” followed by the serial number of the
1056 license plate., a survivor of the attack on Pearl Harbor,
1057 6. A recipient of the Purple Heart medal shall be issued a
1058 license plate stamped with the words “Combat-wounded Veteran”
1059 followed by the serial number of the license plate. The Purple
1060 Heart plate may have the words “Purple Heart” stamped on the
1061 plate and the likeness of the Purple Heart medal appearing on
1062 the plate.,
1063 7. An active or retired member of any branch of the United
1064 States Armed Forces Reserve shall be issued a license plate
1065 stamped with the words “U.S. Reserve” followed by the serial
1066 number of the license plate.
1067 8. A member of the Combat Infantrymen’s Association, Inc.,
1068 or a recipient of the Combat Infantry Badge, Combat Medical
1069 Badge, Combat Action Badge, Combat Action Ribbon, or Air Force
1070 Combat Action Medal shall be issued a license plate stamped with
1071 the words “Combat Infantry Badge,” “Combat Medical Badge,”
1072 “Combat Action Badge,” “Combat Action Ribbon,” or “Air Force
1073 Combat Action Medal,” as appropriate, and a likeness of the
1074 related campaign badge, ribbon, or medal followed by the serial
1075 number of the license plate.
1076 9. A recipient of the, or Distinguished Flying Cross shall
1077 be issued a license plate stamped with the words “Distinguished
1078 Flying Cross” and a likeness of the Distinguished Flying Cross
1079 followed by the serial number of the license plate.
1080 10. A recipient of the Bronze Star shall be issued a
1081 license plate stamped with the words “Bronze Star” and a
1082 likeness of the Bronze Star Medal followed by the serial number
1083 of the license plate. A recipient of the Bronze Star with the
1084 “V” device shall be issued a license plate stamped with the
1085 words “Bronze Star” and a likeness of the Bronze Star Medal with
1086 the “V” device emblem followed by the serial number of the
1087 license plate, upon application to the department, accompanied
1088 by proof of release or discharge from any branch of the United
1089 States Armed Forces, proof of active membership or retired
1090 status in the Florida National Guard, proof of membership in the
1091 Pearl Harbor Survivors Association or proof of active military
1092 duty in Pearl Harbor on December 7, 1941, proof of being a
1093 Purple Heart medal recipient, proof of active or retired
1094 membership in any branch of the United States Armed Forces
1095 Reserve, or proof of membership in the Combat Infantrymen’s
1096 Association, Inc., proof of being a recipient of the Combat
1097 Infantry Badge, Combat Medical Badge, Combat Action Badge,
1098 Combat Action Ribbon, Air Force Combat Action Medal, or
1099 Distinguished Flying Cross, and upon payment of the license tax
1100 for the vehicle as provided in s. 320.08, shall be issued a
1101 license plate as provided by s. 320.06 which, in lieu of the
1102 serial numbers prescribed by s. 320.06, is stamped with the
1103 words “Veteran,” “Woman Veteran,” “WWII Veteran,” “Navy
1104 Submariner,” “National Guard,” “Pearl Harbor Survivor,” “Combat
1105 wounded veteran,” “U.S. Reserve,” “Combat Infantry Badge,”
1106 “Combat Medical Badge,” “Combat Action Badge,” “Combat Action
1107 Ribbon,” “Air Force Combat Action Medal,” or “Distinguished
1108 Flying Cross,” as appropriate, and a likeness of the related
1109 campaign medal or badge, followed by the serial number of the
1110 license plate. Additionally, the Purple Heart plate may have the
1111 words “Purple Heart” stamped on the plate and the likeness of
1112 the Purple Heart medal appearing on the plate.
1113 (b) Notwithstanding any other provision of law to the
1114 contrary, beginning with fiscal year 2002-2003 and annually
1115 thereafter, the first $100,000 in general revenue generated from
1116 the sale of license plates issued under this section shall be
1117 deposited into the Grants and Donations Trust Fund, as described
1118 in s. 296.38(2), to be used for the purposes established by law
1119 for that trust fund. Any additional general revenue generated
1120 from the sale of such plates shall be deposited into the State
1121 Homes for Veterans Trust Fund and used solely to construct,
1122 operate, and maintain domiciliary and nursing homes for
1123 veterans, subject to the requirements of chapter 216.
1124 (c) Any revenue generated from the sale of Woman Veteran
1125 license plates must be deposited into the Operations and
1126 Maintenance Trust Fund administered by the Department of
1127 Veterans’ Affairs pursuant to s. 20.375(3) and must be used
1128 solely for the purpose of creating and implementing programs to
1129 benefit women veterans.
1130 (d) Notwithstanding any provisions of law to the contrary,
1131 an applicant for a Pearl Harbor Survivor license plate or a
1132 Purple Heart license plate who also qualifies for a disabled
1133 veteran’s license plate under s. 320.084 shall be issued the
1134 appropriate special license plate without payment of the license
1135 tax imposed by s. 320.08.
1136 (2) Each owner or lessee of an automobile or truck for
1137 private use, a truck weighing not more than 7,999 pounds, or a
1138 recreational vehicle as specified in s. 320.08(9)(c) or (d),
1139 which is not used for hire or commercial use who is a resident
1140 of this state and who is a former prisoner of war, or his or her
1141 unremarried surviving spouse, upon application to the
1142 department, shall be issued a license plate as provided in s.
1143 320.06 which may have the words “Ex-POW”, stamped on the plate
1144 and the likeness of the Prisoner of War Medal with the words
1145 “Ex-POW” followed by the serial number. Each application shall
1146 be accompanied by proof that the applicant meets the
1147 qualifications specified in paragraph (a) or paragraph (b).
1148 (a) A citizen of the United States who served as a member
1149 of the Armed Forces of the United States or the armed forces of
1150 a nation allied with the United States who was held as a
1151 prisoner of war at such time as the Armed Forces of the United
1152 States were engaged in combat, or his or her unremarried
1153 surviving spouse, may be issued the special license plate
1154 provided for in this subsection without payment of the license
1155 tax imposed by s. 320.08.
1156 (b) A person who was serving as a civilian with the consent
1157 of the United States Government, or a person who was a member of
1158 the Armed Forces of the United States while he or she was not a
1159 United States citizen and was held as a prisoner of war when the
1160 Armed Forces of the United States were engaged in combat, or his
1161 or her unremarried surviving spouse, may be issued the special
1162 license plate provided for in this subsection upon payment of
1163 the license tax imposed by s. 320.08.
1164 (3) Each owner or lessee of an automobile or truck for
1165 private use, a truck weighing not more than 7,999 pounds, or a
1166 recreational vehicle as specified in s. 320.08(9)(c) or (d),
1167 which is not used for hire or commercial use who is a resident
1168 of this state and who is the unremarried surviving spouse of a
1169 recipient of the Purple Heart medal, upon application to the
1170 department accompanied by the payment of the required fees,
1171 shall be issued a license plate as provided in s. 320.06 which
1172 is stamped with the words “Purple Heart” and the likeness of the
1173 Purple Heart medal followed by the serial number. Each
1174 application shall be accompanied by proof that the applicant is
1175 the unremarried surviving spouse of a recipient of the Purple
1176 Heart medal.
1177 (4) The owner or lessee of an automobile or truck for
1178 private use, a truck weighing not more than 7,999 pounds, or a
1179 recreational vehicle as specified in s. 320.08(9)(c) or (d)
1180 which is not used for hire or commercial use who is a resident
1181 of this state and a current or former member of the United
1182 States Armed Forces who was deployed and served in Korea during
1183 the Korean War as defined in s. 1.01(14), upon application to
1184 the department accompanied by proof of active membership or
1185 former active duty status during the Korean War and payment of
1186 the license tax for the vehicle as provided in s. 320.08, shall
1187 be issued a license plate as provided by s. 320.06 which, in
1188 lieu of the registration license number prescribed by s. 320.06,
1189 is stamped with the words “Korean War Veteran” and a likeness of
1190 the Korean Service Medal, followed by the registration license
1191 number of the plate. Proof that the applicant was awarded the
1192 Korean Service Medal is sufficient to establish eligibility for
1193 the license plate.
1194 (5) The owner or lessee of an automobile or truck for
1195 private use, a truck weighing not more than 7,999 pounds, or a
1196 recreational vehicle as specified in s. 320.08(9)(c) or (d)
1197 which is not used for hire or commercial use who is a resident
1198 of this state and a current or former member of the United
1199 States military who was deployed and served in Vietnam during
1200 United States military deployment in Indochina, upon application
1201 to the department accompanied by proof of active membership or
1202 former active duty status during these operations and payment of
1203 the license tax for the vehicle as provided in s. 320.08, shall
1204 be issued a license plate as provided by s. 320.06 which, in
1205 lieu of the registration license number prescribed by s. 320.06,
1206 is stamped with the words “Vietnam War Veteran” and a likeness
1207 of the Vietnam Service Medal, followed by the registration
1208 license number of the plate. Proof that the applicant was
1209 awarded the Vietnam Service Medal is sufficient to establish
1210 eligibility for the license plate.
1211 (6) The owner or lessee of an automobile or truck for
1212 private use, a truck weighing not more than 7,999 pounds, or a
1213 recreational vehicle as specified in s. 320.08(9)(c) or (d)
1214 which is not used for hire or commercial use who is a resident
1215 of this state and a current or former member of the United
1216 States military who was deployed and served in Saudi Arabia,
1217 Kuwait, or another area of the Persian Gulf during Operation
1218 Desert Shield or Operation Desert Storm; in Afghanistan during
1219 Operation Enduring Freedom; or in Iraq during Operation Iraqi
1220 Freedom, upon application to the department accompanied by proof
1221 of active membership or former active duty status during one of
1222 these operations and payment of the license tax for the vehicle
1223 as provided in s. 320.08, shall be issued a license plate as
1224 provided by s. 320.06 which, in lieu of the registration license
1225 number prescribed by s. 320.06, is stamped with the words
1226 “Operation Desert Shield,” “Operation Desert Storm,” “Operation
1227 Enduring Freedom,” or “Operation Iraqi Freedom,” as appropriate,
1228 and a likeness of the related campaign medal followed by the
1229 registration license number of the plate. Proof that the
1230 applicant was awarded the Southwest Asia Service Medal, Iraq
1231 Campaign Medal, Afghanistan Campaign Medal, or Global War on
1232 Terrorism Expeditionary Medal is sufficient to establish
1233 eligibility for the appropriate license plate.
