12 requiring the Department of Highway Safety and Motor
13 Vehicles to develop certain specialty license plates;
14 providing for distribution and use of fees collected
15 from the sale of the plates; amending s. 320.08062,
16 F.S.; directing the Department of Highway Safety and
17 Motor Vehicles to audit certain organizations that
18 receive funds from the sale of specialty license
19 plates; amending s. 320.0842, F.S.; providing for
20 issuance of a license plate to residents who qualify
21 for a free license plate as a veteran who uses a
22 wheelchair and for a certain Purple Heart license
23 plate; requiring certain wording and symbols on the
24 plate; providing that the plate entitles the resident
25 to specified privileges; requiring the eligible
26 applicant to be identified on the registration
27 certificate if more than one registrant is listed;
28 amending s. 320.089, F.S.; creating a special license
29 plate for recipients of the Bronze Star medal;
30 providing parameters for the design of the plate;
31 requiring the likeness of the Prisoner of War Medal to
32 appear on the Ex-POW license plate; making technical
33 changes; providing effective dates.

35 Be It Enacted by the Legislature of the State of Florida:
36
37 Section 1. Section 320.08053, Florida Statutes, is amended
38 to read:
39 320.08053 Establishment of Requirements for requests to
40 establish specialty license plates.—
41 (1) If a specialty license plate requested by an
42 organization is approved by law, the organization must submit
43 the proposed art design for the specialty license plate to the
44 department, in a medium prescribed by the department, as soon as
45 practicable, but no later than 60 days after the act approving
46 the specialty license plate becomes a law.
47 (2)(a) Within 120 days following the specialty license
48 plate becoming law, the department shall establish a method to
49 issue a specialty license plate voucher to allow for the presale
50 of the specialty license plate. The processing fee as prescribed
51 in s. 320.08056, the service charge and branch fee as prescribed
52 in s. 320.04, and the annual use fee as prescribed in s.
53 320.08056 shall be charged for the voucher. All other applicable
54 fees shall be charged at the time of issuance of the license
55 plates.
56 (b) Within 24 months after the presale specialty license
57 plate voucher is established, the approved specialty license
58 plate organization must record with the department a minimum of
59 3,000 1,000 voucher sales before manufacture of the license
60 plate may begin commence. If, at the conclusion of the 24-month
61 presale period, the minimum sales requirement has requirements
62 have not been met, the specialty plate is deauthorized and the
63 department shall discontinue development of the plate and
64 discontinue issuance of the presale vouchers. Upon
65 deauthorization of the license plate, a purchaser of the license
66 plate voucher may use the annual use fee collected as a credit
67 towards any other specialty license plate or apply for a refund
68 on a form prescribed by the department.
69 Section 2. Paragraphs (ffff) through (tttt) are added to
70 subsection (4) of section 320.08056, Florida Statutes, and
71 paragraphs (c), (d), and (e) are added to subsection (8) of that
72 section, to read:
73 320.08056 Specialty license plates.—
74 (4) The following license plate annual use fees shall be
75 collected for the appropriate specialty license plates:
76 (ffff) Ducks Unlimited license plate, $25.
77 (gggg) Sun Sea Smiles license plate, $25.
78 (hhhh) Alpha Phi Alpha Fraternity license plate, $25.
79 (iiii) Omega Psi Phi Fraternity license plate, $25.
80 (jjjj) Kappa Alpha Psi Fraternity license plate, $25.
81 (kkkk) Phi Beta Sigma Fraternity license plate, $25.
82 (llll) Zeta Phi Beta Sorority license plate, $25.
83 (mmmm) Delta Sigma Theta Sorority license plate, $25.
84 (nnnn) Alpha Kappa Alpha Sorority license plate, $25.
85 (oooo) Sigma Gamma Rho Sorority license plate, $25.
86 (pppp) Dan Marino Foundation license plate, $25.
87 (qqqq) Florida State Beekeepers Association license plate,
88 $25.

93 (c) A person issued a specialty license plate that has been
94 discontinued by the department may keep the discontinued
95 specialty license plate for the remainder of the 10-year license
96 plate replacement period and must pay all other applicable
97 registration fees. However, such person is exempt from paying
98 the applicable specialty license plate fee under subsection (4)
99 for the remainder of the 10-year license plate replacement
100 period.
101 (d) If the department discontinues issuance of a specialty
102 license plate, all annual use fees held or collected by the
103 department shall be distributed within 180 days after the date
104 the specialty license plate is discontinued. Of those fees, the
105 department shall retain an amount sufficient to defray the
106 applicable administrative and inventory closeout costs
107 associated with discontinuance of the plate. The remaining funds
108 shall be distributed to the specified organization or
109 organizations as provided in s. 320.08058.
110 (e) If an organization that is the intended recipient of
111 the funds pursuant to s. 320.08058 no longer exists, the
112 department shall deposit any undisbursed funds into the Highway
113 Safety Operating Trust Fund.
114 Section 3. Effective October 1, 2020, paragraph (a) of
115 subsection (8) of section 320.08056, Florida Statutes, is
116 amended to read:
117 320.08056 Specialty license plates.—
118 (8)(a) The department must discontinue the issuance of an
119 approved specialty license plate if the number of valid
120 specialty plate registrations falls below 3,000 1,000 plates for
121 at least 12 consecutive months. A warning letter shall be mailed
122 to the sponsoring organization following the first month in
123 which the total number of valid specialty plate registrations is
124 below 3,000 1,000 plates. This paragraph does not apply to
125 collegiate license plates established under s. 320.08058(3),
126 license plates of institutions in and entities of the State
127 University System, specialty license plates that have statutory
128 eligibility limitations for purchase, or Florida Professional
129 Sports Team License plates established under s. 320.08058(9).
130 Section 4. Paragraph (a) of subsection (7) and paragraph
131 (b) of subsection (80) of section 320.08058, Florida Statutes,
132 are amended and subsections (84) through (98) are added to that
133 section, to read:
134 320.08058 Specialty license plates.—
135 (7) SPECIAL OLYMPICS FLORIDA LICENSE PLATES.—
136 (a) Special Olympics Florida license plates must contain
137 the official Special Olympics Florida logo and must bear a
138 design and colors that are approved by the department. The word
139 “Florida” must be centered at the top bottom of the plate, and
140 the words “Be a Fan” “Everyone Wins” must be centered at the
141 bottom top of the plate.
142 (80) FALLEN LAW ENFORCEMENT OFFICERS LICENSE PLATES.—
143 (b) The annual use fees shall be distributed to the Police
144 and Kids Foundation, Inc., which may use up to a maximum of 10
145 percent of the proceeds for marketing to promote and market the
146 plate. All remaining proceeds shall be distributed to and used
147 by the Police and Kids Foundation, Inc., for its operations,
148 activities, programs, and projects The remainder of the proceeds
149 shall be used by the Police and Kids Foundation, Inc., to invest
150 and reinvest, and the interest earnings shall be used for the
151 operation of the Police and Kids Foundation, Inc.
152 (84) DUCKS UNLIMITED LICENSE PLATES.—
153 (a) The department shall develop a Ducks Unlimited license
154 plate as provided in this section and s. 320.08053. Ducks
155 Unlimited license plates must bear the colors and design
156 approved by the department. The word “Florida” must appear at
157 the top of the plate, and the words “Conserving Florida
158 Wetlands” must appear at the bottom of the plate.
159 (b) The annual use fees from the sale of the plate shall be
160 distributed to Ducks Unlimited, Inc., a nonprofit corporation
161 under s. 501(c)(3) of the Internal Revenue Code, to be used as
162 follows:
163 1. Up to 5 percent may be used for administrative costs and
164 marketing of the plate.
165 2. A minimum of 95 percent shall be used in this state to
166 support the mission and efforts of Ducks Unlimited, Inc., for
167 the conservation, restoration, and management of Florida
168 wetlands and associated habitats for the benefit of waterfowl,
169 other wildlife, and people.
170 (85) SUN SEA SMILES LICENSE PLATES.—
171 (a) The department shall develop a Sun Sea Smiles license
172 plate as provided in this section and s. 320.08053. The plate
173 must bear the colors and design approved by the department. The
174 word “Florida” must appear at the top of the plate, and the
175 words “Sun Sea Smiles” must appear at the bottom of the plate.
176 (b) The annual use fees from the sale of the plate shall be
177 distributed as follows:
178 1. Five percent shall be distributed to the Florida
179 Caribbean Charitable Foundation, Inc., to be used only for
180 marketing of the Sun Sea Smiles license plate.
181 2. An additional 30 percent shall be distributed to the
182 Florida Caribbean Charitable Foundation, Inc. Of this amount, up
183 to 5 percent may be used for administrative expenses, and the
184 remainder shall be used as follows:
185 a. Sixty percent shall be used for a college scholarship
186 program.
187 b. Fifteen percent shall be used to promote health and
188 wellness for residents in this state who are of Caribbean
189 descent.
190 c. Twenty-five percent shall be used to promote awareness
191 of Caribbean culture within this state.
192 3. Twenty percent shall be distributed to the American
193 Friends of Jamaica, Inc., a charitable, not-for-profit
194 organization under s. 501(c)(3) of the Internal Revenue Code
195 registered with the Department of Agriculture and Consumer
196 Services and incorporated in New York, to be used as grants to
197 promote social and community development among residents of this
198 state. Of this amount, up to 5 percent may be used for
199 administrative and marketing expenses.
200 4. Ten percent shall be distributed to Haitian Neighborhood
201 Center Sant La, Inc., to be used to promote social and community
202 development. Of this amount, up to 5 percent may be used for
203 administrative expenses.
204 5. Ten percent shall be distributed to Fanm Ayisyen nan
205 Miyami, Inc., to be used to promote social and community
206 development. Of this amount, up to 10 percent may be used for
207 administrative expenses.
208 6. Twenty percent shall be distributed to Greater Caribbean
209 American Cultural Coalition, Inc., to be used to promote
210 awareness of Caribbean culture within this state. Of this
211 amount, up to 5 percent may be used for administrative expenses.
212 7. Five percent shall be distributed to Little Haiti
213 Optimist Foundation, Inc., to be used to promote awareness of
214 Caribbean culture and youth development within this state. Of
215 this amount, up to 5 percent may be used for administrative
216 expenses.
217 (86) ALPHA PHI ALPHA FRATERNITY LICENSE PLATES.—
218 (a) The department shall develop an Alpha Phi Alpha
219 Fraternity license plate as provided in this section and s.
220 320.08053. The plate must bear the colors and design approved by
221 the department. The word “Florida” must appear at the top of the
222 plate, and the name of the fraternity must appear at the bottom
223 of the plate.
224 (b) The annual use fees from the sale of the plate shall be
225 distributed as follows:
226 1. Ten percent shall be distributed to the Florida
227 Federation of Alpha Chapters, Inc., and used solely for
228 marketing of the Alpha Phi Alpha Fraternity license plate.
229 2. Eighty-five percent shall be distributed to the Florida
230 Federation of Alpha Chapters, Inc., and used to promote
231 community awareness and action through educational, economic,
232 and cultural service activities within Florida.
233 3. Five percent shall be distributed to the United Negro
234 College Fund, Inc., to be used for college scholarships for
235 Florida residents attending Florida’s historically black
236 colleges and universities.
237 (87) OMEGA PSI PHI FRATERNITY LICENSE PLATES.—
238 (a) The department shall develop an Omega Psi Phi
239 Fraternity license plate as provided in this section and s.
240 320.08053. The plate must bear the colors and design approved by
241 the department. The word “Florida” must appear at the top of the
242 plate, and the name of the fraternity must appear at the bottom
243 of the plate.
244 (b) The annual use fees from the sale of the plate shall be
245 distributed as follows:
246 1. Ten percent shall be distributed to the State of Florida
247 Omega Friendship Foundation, Inc., and used solely for marketing
248 of the Omega Psi Phi Fraternity license plate.
249 2. Eighty-five percent shall be distributed to the State of
250 Florida Omega Friendship Foundation, Inc., and used to promote
251 community awareness and action through educational, economic,
252 and cultural service activities within Florida.
253 3. Five percent shall be distributed to the United Negro
254 College Fund, Inc., to be used for college scholarships for
255 Florida residents attending Florida’s historically black
256 colleges and universities.
257 (88) KAPPA ALPHA PSI FRATERNITY LICENSE PLATES.—
258 (a) The department shall develop a Kappa Alpha Psi
259 Fraternity license plate as provided in this section and s.
260 320.08053. The plate must bear the colors and design approved by
261 the department. The word “Florida” must appear at the top of the
262 plate, and the name of the fraternity must appear at the bottom
263 of the plate.
264 (b) The annual use fees from the sale of the plate shall be
265 distributed as follows:
266 1. Ten percent shall be distributed to the Southern
267 Province of Kappa Alpha Psi Foundation, Inc., and used solely
268 for marketing of the Kappa Alpha Psi Fraternity license plate.
269 2. Eighty-five percent shall be distributed to the Southern
270 Province of Kappa Alpha Psi Foundation, Inc., and used to
271 promote community awareness and action through educational,
272 economic, and cultural service activities within Florida.
273 3. Five percent shall be distributed to the United Negro
274 College Fund, Inc., to be used for college scholarships for
275 Florida residents attending Florida’s historically black
276 colleges and universities.
277 (89) PHI BETA SIGMA FRATERNITY LICENSE PLATES.—
278 (a) The department shall develop a Phi Beta Sigma
279 Fraternity license plate as provided in this section and s.
280 320.08053. The plate must bear the colors and design approved by
281 the department. The word “Florida” must appear at the top of the
282 plate, and the name of the fraternity must appear at the bottom
283 of the plate.
284 (b) The annual use fees from the sale of the plate shall be
285 distributed as follows:
286 1. Ten percent shall be distributed to TMB Charitable
287 Foundation, Inc., and used solely for marketing of the Phi Beta
288 Sigma Fraternity license plate.
289 2. Eighty-five percent shall be distributed to TMB
290 Charitable Foundation, Inc., and used to promote community
291 awareness and action through educational, economic, and cultural
292 service activities within Florida.
293 3. Five percent shall be distributed to the United Negro
294 College Fund, Inc., to be used for college scholarships for
295 Florida residents attending Florida’s historically black
296 colleges and universities.
297 (90) ZETA PHI BETA SORORITY LICENSE PLATES.—
298 (a) The department shall develop a Zeta Phi Beta Sorority
299 license plate as provided in this section and s. 320.08053. The
300 plate must bear the colors and design approved by the
301 department. The word “Florida” must appear at the top of the
302 plate, and the name of the sorority must appear at the bottom of
303 the plate.
304 (b) The annual use fees from the sale of the plate shall be
305 distributed as follows:
306 1. Ten percent shall be distributed to Florida Pearls,
307 Inc., and used solely for marketing of the Zeta Phi Beta
308 Sorority license plate.
309 2. Eighty-five percent shall be distributed to Florida
310 Pearls, Inc., and used to promote community awareness and action
311 through educational, economic, and cultural service activities
312 within Florida.
313 3. Five percent shall be distributed to the United Negro
314 College Fund, Inc., to be used for college scholarships for
315 Florida residents attending Florida’s historically black
316 colleges and universities.
317 (91) DELTA SIGMA THETA SORORITY LICENSE PLATES.—
318 (a) The department shall develop a Delta Sigma Theta
319 Sorority license plate as provided in this section and s.
320 320.08053. The plate must bear the colors and design approved by
321 the department. The word “Florida” must appear at the top of the
322 plate, and the name of the sorority must appear at the bottom of
323 the plate.
324 (b) The annual use fees from the sale of the plate shall be
325 distributed as follows:
326 1. Ten percent shall be distributed to the Delta Research
327 and Educational Foundation, Inc., and used solely for marketing
328 of the Delta Sigma Theta Sorority license plate.
329 2. Eighty-five percent shall be distributed to the Delta
330 Research and Educational Foundation, Inc., and used to promote
331 community awareness and action through educational, economic,
332 and cultural service activities within Florida.
333 3. Five percent shall be distributed to the United Negro
334 College Fund, Inc., to be used for college scholarships for
335 Florida residents attending Florida’s historically black
336 colleges and universities.
337 (92) ALPHA KAPPA ALPHA SORORITY LICENSE PLATES.—
338 (a) The department shall develop an Alpha Kappa Alpha
339 Sorority license plate as provided in this section and s.
340 320.08053. The plate must bear the colors and design approved by
341 the department. The word “Florida” must appear at the top of the
342 plate, and the name of the sorority must appear at the bottom of
343 the plate.
344 (b) The annual use fees from the sale of the plate shall be
345 distributed as follows:
346 1. Ten percent shall be distributed to the Alpha Kappa
347 Alpha Educational Advancement Foundation, Inc., and used solely
348 for marketing of the Alpha Kappa Alpha Sorority license plate.
349 2. Eighty-five percent shall be distributed to the Alpha
350 Kappa Alpha Educational Advancement Foundation, Inc., and used
351 to promote community awareness and action through educational,
352 economic, and cultural service activities within Florida.
353 3. Five percent shall be distributed to the United Negro
354 College Fund, Inc., to be used for college scholarships for
355 Florida residents attending Florida’s historically black
356 colleges and universities.
357 (93) SIGMA GAMMA RHO SORORITY LICENSE PLATES.—
358 (a) The department shall develop a Sigma Gamma Rho Sorority
359 license plate as provided in this section and s. 320.08053. The
360 plate must bear the colors and design approved by the
361 department. The word “Florida” must appear at the top of the
362 plate, and the name of the sorority must appear at the bottom of
363 the plate.
364 (b) The annual use fees from the sale of the plate shall be
365 distributed as follows:
366 1. Ten percent shall be distributed to the Sigma Gamma Rho
367 Sorority National Education Fund, Inc., and used solely for
368 marketing of the Sigma Gamma Rho Sorority license plate.
369 2. Eighty-five percent shall be distributed to the Sigma
370 Gamma Rho Sorority National Education Fund, Inc., and used to
371 promote community awareness and action through educational,
372 economic, and cultural service activities within Florida.
373 3. Five percent shall be distributed to the United Negro
374 College Fund, Inc., to be used for college scholarships for
375 Florida residents attending Florida’s historically black
376 colleges and universities.
377 (94) DAN MARINO FOUNDATION LICENSE PLATES.—
378 (a) The department shall develop a Dan Marino Foundation
379 license plate as provided in this section and s. 320.08053. Dan
380 Marino Foundation license plates must bear the colors and design
381 approved by the department. The word “Florida” must appear at
382 the top of the plate, and the words “Marino Campus” must appear
383 at the bottom of the plate.
384 (b) The annual use fees from the sale of the plate shall be
385 distributed to the Dan Marino Foundation, Inc., a Florida
386 nonprofit corporation, which may use up to 10 percent of such
387 fees for administrative costs and marketing of the plate. The
388 remainder of the fees shall be used by the Dan Marino
389 Foundation, Inc., to assist Floridians with developmental
390 disabilities to become employed, independent, and productive,
391 and to promote and fund educational scholarships and awareness
392 of these services.
393 (95) FLORIDA STATE BEEKEEPERS ASSOCIATION LICENSE PLATES.—
394 (a) The department shall develop a Florida State Beekeepers
395 Association license plate as provided in this section and s.
396 320.08053. The plate must bear the colors and design approved by
397 the department. The word “Florida” must appear at the top of the
398 plate, and the words “Save the Bees” must appear at the bottom
399 of the plate.
400 (b) The annual use fees shall be distributed to the Florida
401 State Beekeepers Association, a Florida nonprofit corporation.
402 The Florida State Beekeepers Association may use up to 18
403 percent of the annual use fees for:
404 1. Direct reimbursement for administrative costs, startup
405 costs, and costs incurred in the development and approval
406 process of the license plate. All vendors associated with the
407 administrative costs shall be selected by competitive bid.
408 2. Promotion and marketing costs of the license plate.
409 (c) The remaining funds shall be distributed to the Florida
410 State Beekeepers Association and shall be used to raise
411 awareness of the importance of beekeeping to Florida agriculture
412 by funding honeybee research, education, outreach, and
413 husbandry. The Florida State Beekeepers Association board of
414 managers must approve and is accountable for all such
415 expenditures.
416 (96) ORLANDO UNITED LICENSE PLATES.—
417 (a) The department shall develop an Orlando United license
418 plate as provided in this section and s. 320.08053. The plate
419 must bear the colors and design approved by the department. The
420 word “Florida” must appear at the top of the plate, and the
421 words “Orlando United” must appear at the bottom of the plate.
422 (b) The annual use fees from the sale of the plate shall be
423 distributed as follows:
424 1. Seven percent shall be distributed to the Mental Health
425 Association of Central Florida, Inc., to be used for marketing
426 of the license plate.
427 2. Thirty-one percent shall be distributed to the Mental
428 Health Association of Central Florida, Inc. Of this amount, up
429 to 5 percent may be used for administrative expenses, and the
430 remainder shall be used to offer free personalized counseling to
431 any person affected by the shooting at the Pulse nightclub in
432 Orlando, Florida, on June 12, 2016.
433 3. Thirty-one percent shall be distributed to the Hispanic
434 Federation, Inc., a charitable, not-for-profit organization
435 under s. 501(c)(3) of the Internal Revenue Code registered with
436 the Department of Agriculture and Consumer Services and
437 incorporated in New York. Of this amount, up to 5 percent may be
438 used for administrative expenses, and the remainder shall be
439 used to offer free personalized counseling to any person
440 affected by the shooting at the Pulse nightclub in Orlando,
441 Florida, on June 12, 2016, through the Proyecto Somos Orlando
442 campaign operated by the Hispanic Federation, Inc.
443 4. Thirty-one percent shall be distributed to Two Spirit
444 Health Services, Inc. Of this amount, up to 5 percent may be
445 used for administrative expenses, and the remainder shall be
446 used to offer free personalized counseling to any person
447 affected by the shooting at the Pulse nightclub in Orlando,
448 Florida, on June 12, 2016.
449 (97) ETHICAL ECOTOURISM LICENSE PLATES.—
450 (a) The department shall develop an Ethical Ecotourism
451 license plate as provided in this section and s. 320.08053. The
452 word “Florida” must appear at the top of the plate, and words
453 that are approved by the department must appear at the bottom of
454 the plate.
455 (b) The annual use fees from the sale of the plate shall be
456 distributed equally between the Florida Society for Ethical
457 Ecotourism and Paddle Florida, Inc., each of which may use up to
458 10 percent of the proceeds for administrative costs and
459 marketing of the plate. The balance of the annual use fees shall
460 be used by the Florida Society for Ethical Ecotourism to provide
461 environmental education and awareness that encourages behaviors
462 that contribute to the sustainability of Florida’s natural
463 ecosystems and resources and Paddle Florida, Inc., to raise
464 awareness about water conservation, wildlife preservation,
465 restoration of springs, and protection of waterways in this
466 state.
467 (98) ROTARY LICENSE PLATES.—
468 (a) The department shall develop a Rotary license plate as
469 provided in this section and s. 320.08053. The plate must bear
470 the colors and design approved by the department. The word
471 “Florida” must appear at the top of the plate, and the word
472 “Rotary” must appear on the bottom of the plate. The license
473 plate must bear the Rotary International wheel emblem.
474 (b) The annual use fees shall be distributed to the
475 Community Foundation of Tampa Bay, Inc., to distribute as
476 follows:
477 1. Up to 10 percent for administrative costs and for
478 marketing of the plate.
479 2. Ten percent to Rotary’s Camp Florida for direct support
480 to all programs and services provided to special needs children
481 who attend the camp.
482 3. The remainder shall be distributed, proportionally based
483 on sales, to each Rotary district in the state in support of
484 Rotary youth programs in Florida.
485 Section 5. Section 320.08062, Florida Statutes, is amended
486 to read:
487 320.08062 Audits and attestations required; annual use fees
488 of specialty license plates.—
489 (1)(a) All organizations that receive annual use fee
490 proceeds from the department are responsible for ensuring that
491 proceeds are used in accordance with ss. 320.08056 and

493 (b) Any organization not subject to audit pursuant to s.
494 215.97 shall annually attest, under penalties of perjury, that
495 such proceeds were used in compliance with ss. 320.08056 and
496 320.08058. The attestation shall be made annually in a form and
497 format determined by the department. In addition, the department
498 shall audit any such organization every 2 years to ensure
499 proceeds have been used in compliance with ss. 320.08056 and
500 320.08058.
501 (c) Any organization subject to audit pursuant to s. 215.97
502 shall submit an audit report in accordance with rules
503 promulgated by the Auditor General. The annual attestation shall
504 be submitted to the department for review within 9 months after
505 the end of the organization’s fiscal year.
506 (2)(a) Within 120 days after receiving an organization’s
507 audit or attestation, the department shall determine which
508 recipients of revenues from specialty license plate annual use
509 fees have not complied with subsection (1). In determining
510 compliance, the department may commission an independent
511 actuarial consultant, or an independent certified public
512 accountant, who has expertise in nonprofit and charitable
513 organizations.
514 (b) The department must discontinue the distribution of
515 revenues to any organization failing to submit the required
516 documentation as required in subsection (1), but may resume
517 distribution of the revenues upon receipt of the required
518 information.
519 (c) If the department or its designee determines that an
520 organization has not complied or has failed to use the revenues
521 in accordance with ss. 320.08056 and 320.08058, the department
522 must discontinue the distribution of the revenues to the
523 organization. The department shall notify the organization of
524 its findings and direct the organization to make the changes
525 necessary in order to comply with this chapter. If the officers
526 of the organization sign an affidavit under penalties of perjury
527 stating that they acknowledge the findings of the department and
528 attest that they have taken corrective action and that the
529 organization will submit to a followup review by the department,
530 the department may resume the distribution of revenues.
531 (d) If an organization fails to comply with the
532 department’s recommendations and corrective actions as outlined
533 in paragraph (c), the revenue distributions shall be
534 discontinued until completion of the next regular session of the
535 Legislature. The department shall notify the President of the
536 Senate and the Speaker of the House of Representatives by the
537 first day of the next regular session of any organization whose
538 revenues have been withheld as a result of this paragraph. If
539 the Legislature does not provide direction to the organization
540 and the department regarding the status of the undistributed
541 revenues, the department shall deauthorize the plate and the
542 undistributed revenues shall be immediately deposited into the
543 Highway Safety Operating Trust Fund.
544 (3) The department or its designee has the authority to
545 examine all records pertaining to the use of funds from the sale
546 of specialty license plates.
547 Section 6. Subsection (5) is added to section 320.0842,
548 Florida Statutes, to read:
549 320.0842 Free motor vehicle license plates to veterans who
550 use wheelchairs.—
551 (5) An owner or lessee of a motor vehicle who resides in
552 this state and qualifies for a license plate under this section
553 and a Purple Heart license plate under s. 320.089, upon
554 application to the department, shall be issued a license plate
555 stamped with the term “Combat-wounded Veteran” followed by the
556 serial number of the license plate and the international symbol
557 of accessibility. The license plate entitles the person to all
558 privileges afforded by a license plate issued under this
559 section. When more than one registrant is listed on the
560 registration issued under this section, the eligible applicant
561 shall be noted on the registration certificate.
562 Section 7. Section 320.089, Florida Statutes, is amended to
563 read:
564 320.089 Veterans of the United States Armed Forces; members
565 of National Guard; survivors of Pearl Harbor; Purple Heart medal
566 recipients; active or retired United States Armed Forces
567 reservists; Combat Infantry Badge, Combat Medical Badge, or
568 Combat Action Badge recipients; Combat Action Ribbon recipients;
569 Air Force Combat Action Medal recipients; Distinguished Flying
570 Cross recipients; former prisoners of war; Korean War Veterans;
571 Vietnam War Veterans; Operation Desert Shield Veterans;
572 Operation Desert Storm Veterans; Operation Enduring Freedom
573 Veterans; Operation Iraqi Freedom Veterans; Women Veterans;
574 World War II Veterans; and Navy Submariners; Special license
575 plates for military servicemembers, veterans, and Pearl Harbor
576 Survivors; fee.—
577 (1)(a) Upon application to the department and payment of
578 the license tax for the vehicle as provided in s. 320.08, a
579 resident of the state who owns or leases Each owner or lessee of
580 an automobile or truck for private use or recreational vehicle
581 as specified in s. 320.08(9)(c) or (d), which is not used for
582 hire or commercial use, shall be issued a license plate pursuant
583 to the following if the applicant provides the department with
584 proof that he or she meets the qualifications listed in this
585 section for the applicable license plate:
586 1. A person released or discharged from any branch who is a
587 resident of the state and a veteran of the United States Armed
588 Forces shall be issued a license plate stamped with the words
589 “Veteran” or “Woman Veteran” followed by the serial number of
590 the license plate., a Woman Veteran,
591 2. A World War II Veteran shall be issued a license plate
592 stamped with the words “WWII Veteran” followed by the serial
593 number of the license plate.,
594 3. A Navy Submariner shall be issued a license plate
595 stamped with the words “Navy Submariner” followed by the serial
596 number of the license plate.,
597 4. An active or retired member of the Florida National
598 Guard shall be issued a license plate stamped with the words
599 “National Guard” followed by the serial number of the license
600 plate.
601 5. A member of the Pearl Harbor Survivors Association or
602 other person on active military duty in Pearl Harbor on December
603 7, 1941, shall be issued a license plate stamped with the words
604 “Pearl Harbor Survivor” followed by the serial number of the
605 license plate., a survivor of the attack on Pearl Harbor,
606 6. A recipient of the Purple Heart medal shall be issued a
607 license plate stamped with the words “Combat-wounded Veteran”
608 followed by the serial number of the license plate. The Purple
609 Heart plate may have the words “Purple Heart” stamped on the
610 plate and the likeness of the Purple Heart medal appearing on
611 the plate.,
612 7. An active or retired member of any branch of the United
613 States Armed Forces Reserve shall be issued a license plate
614 stamped with the words “U.S. Reserve” followed by the serial
615 number of the license plate.
616 8. A member of the Combat Infantrymen’s Association, Inc.,
617 or a recipient of the Combat Infantry Badge, Combat Medical
618 Badge, Combat Action Badge, Combat Action Ribbon, or Air Force
619 Combat Action Medal shall be issued a license plate stamped with
620 the words “Combat Infantry Badge,” “Combat Medical Badge,”
621 “Combat Action Badge,” “Combat Action Ribbon,” or “Air Force
622 Combat Action Medal,” as appropriate, and a likeness of the
623 related campaign badge, ribbon, or medal followed by the serial
624 number of the license plate.
625 9. A recipient of the, or Distinguished Flying Cross shall
626 be issued a license plate stamped with the words “Distinguished
627 Flying Cross” and a likeness of the Distinguished Flying Cross
628 followed by the serial number of the license plate.
629 10. A recipient of the Bronze Star shall be issued a
630 license plate stamped with the term “Bronze Star” and a likeness
631 of the Bronze Star Medal followed by the serial number of the
632 license plate. A recipient of the Bronze Star with the “V”
633 device shall be issued a license plate stamped with the words
634 “Bronze Star” and a likeness of the Bronze Star Medal with the
635 “V” device emblem followed by the serial number of the license
636 plate, upon application to the department, accompanied by proof
637 of release or discharge from any branch of the United States
638 Armed Forces, proof of active membership or retired status in
639 the Florida National Guard, proof of membership in the Pearl
640 Harbor Survivors Association or proof of active military duty in
641 Pearl Harbor on December 7, 1941, proof of being a Purple Heart
642 medal recipient, proof of active or retired membership in any
643 branch of the United States Armed Forces Reserve, or proof of
644 membership in the Combat Infantrymen’s Association, Inc., proof
645 of being a recipient of the Combat Infantry Badge, Combat
646 Medical Badge, Combat Action Badge, Combat Action Ribbon, Air
647 Force Combat Action Medal, or Distinguished Flying Cross, and
648 upon payment of the license tax for the vehicle as provided in
649 s. 320.08, shall be issued a license plate as provided by s.
650 320.06 which, in lieu of the serial numbers prescribed by s.
651 320.06, is stamped with the words “Veteran,” “Woman Veteran,”
652 “WWII Veteran,” “Navy Submariner,” “National Guard,” “Pearl
653 Harbor Survivor,” “Combat-wounded veteran,” “U.S. Reserve,”
654 “Combat Infantry Badge,” “Combat Medical Badge,” “Combat Action
655 Badge,” “Combat Action Ribbon,” “Air Force Combat Action Medal,”
656 or “Distinguished Flying Cross,” as appropriate, and a likeness
657 of the related campaign medal or badge, followed by the serial
658 number of the license plate. Additionally, the Purple Heart
659 plate may have the words “Purple Heart” stamped on the plate and
660 the likeness of the Purple Heart medal appearing on the plate.
661 (b) Notwithstanding any other provision of law to the
662 contrary, beginning with fiscal year 2002-2003 and annually
663 thereafter, the first $100,000 in general revenue generated from
664 the sale of license plates issued under this section shall be
665 deposited into the Grants and Donations Trust Fund, as described
666 in s. 296.38(2), to be used for the purposes established by law
667 for that trust fund. Any additional general revenue generated
668 from the sale of such plates shall be deposited into the State
669 Homes for Veterans Trust Fund and used solely to construct,
670 operate, and maintain domiciliary and nursing homes for
671 veterans, subject to the requirements of chapter 216.
672 (c) Any revenue generated from the sale of Woman Veteran
673 license plates must be deposited into the Operations and
674 Maintenance Trust Fund administered by the Department of
675 Veterans’ Affairs pursuant to s. 20.375(3) and must be used
676 solely for the purpose of creating and implementing programs to
677 benefit women veterans.
678 (d) Notwithstanding any provisions of law to the contrary,
679 an applicant for a Pearl Harbor Survivor license plate or a
680 Purple Heart license plate who also qualifies for a disabled
681 veteran’s license plate under s. 320.084 shall be issued the
682 appropriate special license plate without payment of the license
683 tax imposed by s. 320.08.
684 (2) Each owner or lessee of an automobile or truck for
685 private use, a truck weighing not more than 7,999 pounds, or a
686 recreational vehicle as specified in s. 320.08(9)(c) or (d),
687 which is not used for hire or commercial use who is a resident
688 of this state and who is a former prisoner of war, or his or her
689 unremarried surviving spouse, upon application to the
690 department, shall be issued a license plate as provided in s.
691 320.06 which may have the words “Ex-POW”, stamped on the plate
692 and the likeness of the Prisoner of War Medal with the words
693 “Ex-POW” followed by the serial number. Each application shall
694 be accompanied by proof that the applicant meets the
695 qualifications specified in paragraph (a) or paragraph (b).
696 (a) A citizen of the United States who served as a member
697 of the Armed Forces of the United States or the armed forces of
698 a nation allied with the United States who was held as a
699 prisoner of war at such time as the Armed Forces of the United
700 States were engaged in combat, or his or her unremarried
701 surviving spouse, may be issued the special license plate
702 provided for in this subsection without payment of the license
703 tax imposed by s. 320.08.
704 (b) A person who was serving as a civilian with the consent
705 of the United States Government, or a person who was a member of
706 the Armed Forces of the United States while he or she was not a
707 United States citizen and was held as a prisoner of war when the
708 Armed Forces of the United States were engaged in combat, or his
709 or her unremarried surviving spouse, may be issued the special
710 license plate provided for in this subsection upon payment of
711 the license tax imposed by s. 320.08.
712 (3) Each owner or lessee of an automobile or truck for
713 private use, a truck weighing not more than 7,999 pounds, or a
714 recreational vehicle as specified in s. 320.08(9)(c) or (d),
715 which is not used for hire or commercial use who is a resident
716 of this state and who is the unremarried surviving spouse of a
717 recipient of the Purple Heart medal, upon application to the
718 department accompanied by the payment of the required fees,
719 shall be issued a license plate as provided in s. 320.06 which
720 is stamped with the words “Purple Heart” and the likeness of the
721 Purple Heart medal followed by the serial number. Each
722 application shall be accompanied by proof that the applicant is
723 the unremarried surviving spouse of a recipient of the Purple
724 Heart medal.
725 (4) The owner or lessee of an automobile or truck for
726 private use, a truck weighing not more than 7,999 pounds, or a
727 recreational vehicle as specified in s. 320.08(9)(c) or (d)
728 which is not used for hire or commercial use who is a resident
729 of this state and a current or former member of the United
730 States Armed Forces who was deployed and served in Korea during
731 the Korean War as defined in s. 1.01(14), upon application to
732 the department accompanied by proof of active membership or
733 former active duty status during the Korean War and payment of
734 the license tax for the vehicle as provided in s. 320.08, shall
735 be issued a license plate as provided by s. 320.06 which, in
736 lieu of the registration license number prescribed by s. 320.06,
737 is stamped with the words “Korean War Veteran” and a likeness of
738 the Korean Service Medal, followed by the registration license
739 number of the plate. Proof that the applicant was awarded the
740 Korean Service Medal is sufficient to establish eligibility for
741 the license plate.
742 (5) The owner or lessee of an automobile or truck for
743 private use, a truck weighing not more than 7,999 pounds, or a
744 recreational vehicle as specified in s. 320.08(9)(c) or (d)
745 which is not used for hire or commercial use who is a resident
746 of this state and a current or former member of the United
747 States military who was deployed and served in Vietnam during
748 United States military deployment in Indochina, upon application
749 to the department accompanied by proof of active membership or
750 former active duty status during these operations and payment of
751 the license tax for the vehicle as provided in s. 320.08, shall
752 be issued a license plate as provided by s. 320.06 which, in
753 lieu of the registration license number prescribed by s. 320.06,
754 is stamped with the words “Vietnam War Veteran” and a likeness
755 of the Vietnam Service Medal, followed by the registration
756 license number of the plate. Proof that the applicant was
757 awarded the Vietnam Service Medal is sufficient to establish
758 eligibility for the license plate.
759 (6) The owner or lessee of an automobile or truck for
760 private use, a truck weighing not more than 7,999 pounds, or a
761 recreational vehicle as specified in s. 320.08(9)(c) or (d)
762 which is not used for hire or commercial use who is a resident
763 of this state and a current or former member of the United
764 States military who was deployed and served in Saudi Arabia,
765 Kuwait, or another area of the Persian Gulf during Operation
766 Desert Shield or Operation Desert Storm; in Afghanistan during
767 Operation Enduring Freedom; or in Iraq during Operation Iraqi
768 Freedom, upon application to the department accompanied by proof
769 of active membership or former active duty status during one of
770 these operations and payment of the license tax for the vehicle
771 as provided in s. 320.08, shall be issued a license plate as
772 provided by s. 320.06 which, in lieu of the registration license
773 number prescribed by s. 320.06, is stamped with the words
774 “Operation Desert Shield,” “Operation Desert Storm,” “Operation
775 Enduring Freedom,” or “Operation Iraqi Freedom,” as appropriate,
776 and a likeness of the related campaign medal followed by the
777 registration license number of the plate. Proof that the
778 applicant was awarded the Southwest Asia Service Medal, Iraq
779 Campaign Medal, Afghanistan Campaign Medal, or Global War on
780 Terrorism Expeditionary Medal is sufficient to establish
781 eligibility for the appropriate license plate.
782 Section 8. Except as otherwise expressly provided in this
783 act, this act shall take effect October 1, 2017.
