following:

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Section 320.08053, Florida Statutes, is amended
6 to read:
7 320.08053 Establishment of Requirements for requests to
8 establish specialty license plates.—
9 (1) If a specialty license plate requested by an
10 organization is approved by law, the organization must submit
11 the proposed art design for the specialty license plate to the
12 department, in a medium prescribed by the department, as soon as
13 practicable, but no later than 60 days after the act approving
14 the specialty license plate becomes a law.
15 (2)(a) Within 120 days following the specialty license
16 plate becoming law, the department shall establish a method to
17 issue a specialty license plate voucher to allow for the presale
18 of the specialty license plate. The processing fee as prescribed
19 in s. 320.08056, the service charge and branch fee as prescribed
20 in s. 320.04, and the annual use fee as prescribed in s.
21 320.08056 shall be charged for the voucher. All other applicable
22 fees shall be charged at the time of issuance of the license
23 plates.
24 (b) Within 24 months after the presale specialty license
25 plate voucher is established, the approved specialty license
26 plate organization must record with the department a minimum of
27 3,000 1,000 voucher sales before manufacture of the license
28 plate may begin commence. If, at the conclusion of the 24-month
29 presale period, the minimum sales requirement has requirements
30 have not been met, the specialty plate is deauthorized and the
31 department shall discontinue development of the plate and
32 discontinue issuance of the presale vouchers. Upon
33 deauthorization of the license plate, a purchaser of the license
34 plate voucher may use the annual use fee collected as a credit
35 towards any other specialty license plate or apply for a refund
36 on a form prescribed by the department.
37 (3)(a) If the Legislature has approved 125 or more
38 specialty license plates, the department may not make any new
39 specialty license plates available for design, presale, or
40 issuance until a sufficient number of plates are discontinued
41 pursuant to s. 320.08056(8) such that the number of plates being
42 issued is reduced to fewer than 125.
43 (b) New specialty license plates that have been approved by
44 law but are awaiting issuance under paragraph (a) shall be
45 issued in the order they appear in s. 320.08056(4). All other
46 provisions of this section must also be met before a plate is
47 issued.
48 Section 2. Present paragraphs (ff) through (ddd), present
49 paragraphs (fff) through (ppp), present paragraphs (sss) through
50 (eeee) of subsection (4) of section 320.08056, Florida Statutes,
51 are redesignated as paragraphs (ee) through (ccc), paragraphs
52 (ddd) through (nnn), and paragraphs (ooo) through (aaaa),
53 respectively, and present paragraphs (ee), (eee), (qqq), and
54 (rrr) of that subsection are amended, and new paragraphs (bbbb)
55 through (eeee) and paragraphs (ffff) through (bbbbb) are added
56 to that subsection, to read:
57 320.08056 Specialty license plates.—
58 (4) The following license plate annual use fees shall be
59 collected for the appropriate specialty license plates:
60 (ee) American Red Cross license plate, $25.
61 (eee) Donate Organs-Pass It On license plate, $25.
62 (qqq) St. Johns River license plate, $25.
63 (rrr) Hispanic Achievers license plate, $25.
64 (bbbb) Ducks Unlimited license plate, $25.
65 (cccc) Play Ball license plate, $25.
66 (dddd) America the Beautiful license plate, $25.
67 (eeee) Protect Pollinators plate, $25.
68 (ffff) Florida Native license plate, $25.
69 (gggg) Donate Life Florida license plate, $25.

93 (c) A person issued a specialty license plate that has been
94 discontinued by the department may keep the discontinued
95 specialty license plate for the remainder of the 10-year license
96 plate replacement period and must pay all other applicable
97 registration fees. However, such person is exempt from paying
98 the applicable specialty license plate fee under subsection (4)
99 for the remainder of the 10-year license plate replacement
100 period.
101 (d) If the department discontinues issuance of a specialty
102 license plate, all annual use fees held or collected by the
103 department shall be distributed within 180 days after the date
104 the specialty license plate is discontinued. Of those fees, the
105 department shall retain an amount sufficient to defray the
106 applicable administrative and inventory closeout costs
107 associated with discontinuance of the plate. The remaining funds
108 shall be distributed to the specified organization or
109 organizations as provided in s. 320.08058.
110 (e) If an organization that is the intended recipient of
111 the funds pursuant to s. 320.08058 no longer exists, the
112 department shall deposit any undisbursed funds into the Highway
113 Safety Operating Trust Fund.
114 (f) Notwithstanding paragraph (a), on January 1 of each
115 year, the department shall discontinue the specialty license
116 plate with the fewest number of plates in circulation over the
117 previous 24 months. A warning letter shall be mailed to the
118 sponsoring organization following the first month in which the
119 total number of valid specialty license plate registrations is
120 the fewest in circulation over the previous 24 months.
121 (10)(a) A specialty license plate annual use fee collected
122 and distributed under this chapter, or any interest earned from
123 those fees, may not be used for commercial or for-profit
124 activities nor for general or administrative expenses, except as
125 authorized by s. 320.08058 or to pay the cost of the audit or
126 report required by s. 320.08062(1). The fees and any interest
127 earned from the fees may be expended only for use in this state
128 unless the annual use fee is derived from the sale of United
129 States Armed Forces and veterans-related specialty license
130 plates pursuant to paragraphs (4)(d), (bb), (kk), (iii), and
131 (uuu) (ll), (kkk), and (yyy) and s. 320.0891 or out-of-state
132 college or university license plates pursuant to paragraphs
133 (4)(wwww) and (bbbbb).
134 Section 3. Effective October 1, 2020, paragraph (a) of
135 subsection (8) of section 320.08056, Florida Statutes, is
136 amended to read:
137 320.08056 Specialty license plates.—
138 (8)(a) The department must discontinue the issuance of an
139 approved specialty license plate if the number of valid
140 specialty plate registrations falls below 3,000 1,000 plates for
141 at least 12 consecutive months. A warning letter shall be mailed
142 to the sponsoring organization following the first month in
143 which the total number of valid specialty plate registrations is
144 below 3,000 1,000 plates. This paragraph does not apply to
145 collegiate license plates established under s. 320.08058(3),
146 license plates of institutions in and entities of the State
147 University System, specialty license plates that have statutory
148 eligibility limitations for purchase, or Florida Professional
149 Sports Team License plates established under s. 320.08058(9).
150 Section 4. Present subsections (32) through (56), present
151 subsections (58) through (68), and present subsections (71)
152 through (83) of section 320.08058, Florida Statutes, are
153 redesignated as subsections (31) through (55), subsections (56)
154 through (66), and (67) through (79), respectively, paragraph (a)
155 of subsection (7), present subsections (31) and (57), paragraph
156 (b) of present subsection (66), present subsections (69) and
157 (70), and paragraph (b) of present subsection (80) of that
158 section are amended, and new subsections (80) through (83) and
159 subsections (84) through (106) are added to that section, to
160 read:
161 320.08058 Specialty license plates.—
162 (7) SPECIAL OLYMPICS FLORIDA LICENSE PLATES.—
163 (a) Special Olympics Florida license plates must contain
164 the official Special Olympics Florida logo and must bear a
165 design and colors that are approved by the department. The word
166 “Florida” must be centered at the top bottom of the plate, and
167 the words “Be a Fan” “Everyone Wins” must be centered at the
168 bottom top of the plate.
169 (31) AMERICAN RED CROSS LICENSE PLATES.—
170 (a) Notwithstanding the provisions of s. 320.08053, the
171 department shall develop an American Red Cross license plate as
172 provided in this section. The word “Florida” must appear at the
173 top of the plate, and the words “American Red Cross” must appear
174 at the bottom of the plate.
175 (b) The department shall retain all revenues from the sale
176 of such plates until all startup costs for developing and
177 issuing the plates have been recovered. Thereafter, 50 percent
178 of the annual use fees shall be distributed to the American Red
179 Cross Chapter of Central Florida, with statistics on sales of
180 license plates, which are tabulated by county. The American Red
181 Cross Chapter of Central Florida must distribute to each of the
182 chapters in this state the moneys received from sales in the
183 counties covered by the respective chapters, which moneys must
184 be used for education and disaster relief in Florida. Fifty
185 percent of the annual use fees shall be distributed
186 proportionately to the three statewide approved poison control
187 centers for purposes of combating bioterrorism and other poison
188 related purposes.
189 (57) DONATE ORGANS-PASS IT ON LICENSE PLATES.—
190 (a) The department shall develop a Donate Organs-Pass It On
191 license plate as provided in this section. The word “Florida”
192 must appear at the top of the plate, and the words “Donate
193 Organs-Pass It On” must appear at the bottom of the plate.
194 (b) The annual use fees shall be distributed to Transplant
195 Foundation, Inc., and shall use up to 10 percent of the proceeds
196 from the annual use fee for marketing and administrative costs
197 that are directly associated with the management and
198 distribution of the proceeds. The remaining proceeds shall be
199 used to provide statewide grants for patient services, including
200 preoperative, rehabilitative, and housing assistance; organ
201 donor education and awareness programs; and statewide medical
202 research.
203 (64)(66) IN GOD WE TRUST LICENSE PLATES.—
204 (b) The license plate annual use fees shall be distributed
205 to the In God We Trust Foundation, Inc., which may use up to 10
206 percent of the proceeds to offset administrative costs,
207 promotion, and marketing of the license plate directly
208 associated with the operations of the foundation. The remaining
209 proceeds may be used to address the needs of the military
210 community and the public safety community; provide educational
211 grants and scholarships to foster self-reliance and stability in
212 Florida’s youth; and provide education in to fund educational
213 scholarships for the children of Florida residents who are
214 members of the United States Armed Forces, the National Guard,
215 and the United States Armed Forces Reserve and for the children
216 of public safety employees who have died in the line of duty who
217 are not covered by existing state law. Funds shall also be
218 distributed to other s. 501(c)(3) organizations that may apply
219 for grants and scholarships and to provide educational grants to
220 public and private schools regarding to promote the historical
221 and religious significance of religion in American and Florida
222 history. The In God We Trust Foundation, Inc., shall create an
223 advisory council comprised of persons with knowledge in these
224 program areas to make funding recommendations distribute the
225 license plate annual use fees in the following manner:
226 1. The In God We Trust Foundation, Inc., shall retain all
227 revenues from the sale of such plates until all startup costs
228 for developing and establishing the plate have been recovered.
229 2. Ten percent of the funds received by the In God We Trust
230 Foundation, Inc., shall be expended for administrative costs,
231 promotion, and marketing of the license plate directly
232 associated with the operations of the In God We Trust
233 Foundation, Inc.
234 3. All remaining funds shall be expended by the In God We
235 Trust Foundation, Inc., for programs.
236 (69) ST. JOHNS RIVER LICENSE PLATES.—
237 (a) The department shall develop a St. Johns River license
238 plate as provided in this section. The St. Johns River license
239 plates must bear the colors and design approved by the
240 department. The word “Florida” must appear at the top of the
241 plate, and the words “St. Johns River” must appear at the bottom
242 of the plate.
243 (b) The requirements of s. 320.08053 must be met prior to
244 the issuance of the plate. Thereafter, the license plate annual
245 use fees shall be distributed to the St. Johns River Alliance,
246 Inc., a s. 501(c)(3) nonprofit organization, which shall
247 administer the fees as follows:
248 1. The St. Johns River Alliance, Inc., shall retain the
249 first $60,000 of the annual use fees as direct reimbursement for
250 administrative costs, startup costs, and costs incurred in the
251 development and approval process. Thereafter, up to 10 percent
252 of the annual use fee revenue may be used for administrative
253 costs directly associated with education programs, conservation,
254 research, and grant administration of the organization, and up
255 to 10 percent may be used for promotion and marketing of the
256 specialty license plate.
257 2. At least 30 percent of the fees shall be available for
258 competitive grants for targeted community-based or county-based
259 research or projects for which state funding is limited or not
260 currently available. The remaining 50 percent shall be directed
261 toward community outreach and access programs. The competitive
262 grants shall be administered and approved by the board of
263 directors of the St. Johns River Alliance, Inc. A grant advisory
264 committee shall be composed of six members chosen by the St.
265 Johns River Alliance board members.
266 3. Any remaining funds shall be distributed with the
267 approval of and accountability to the board of directors of the
268 St. Johns River Alliance, Inc., and shall be used to support
269 activities contributing to education, outreach, and springs
270 conservation.
271 4. Effective July 1, 2014, the St. Johns River license
272 plate will shift into the presale voucher phase, as provided in
273 s. 320.08053(2)(b). The St. Johns River Alliance, Inc., shall
274 have 24 months to record a minimum of 1,000 sales of the license
275 plates. Sales include existing active plates and vouchers sold
276 subsequent to July 1, 2014. During the voucher period, new
277 plates may not be issued, but existing plates may be renewed.
278 If, at the conclusion of the 24-month presale period, the
279 requirement of a minimum of 1,000 sales has been met, the
280 department shall resume normal distribution of the St. Johns
281 River specialty plate. If, after 24 months, the minimum of 1,000
282 sales has not been met, the department shall discontinue the
283 development and issuance of the plate. This subparagraph is
284 repealed June 30, 2016.
285 (70) HISPANIC ACHIEVERS LICENSE PLATES.—
286 (a) Notwithstanding the requirements of s. 320.08053, the
287 department shall develop a Hispanic Achievers license plate as
288 provided in this section. The plate must bear the colors and
289 design approved by the department. The word “Florida” must
290 appear at the top of the plate, and the words “Hispanic
291 Achievers” must appear at the bottom of the plate.
292 (b) The proceeds from the license plate annual use fee
293 shall be distributed to National Hispanic Corporate Achievers,
294 Inc., a nonprofit corporation under s. 501(c)(3) of the Internal
295 Revenue Code, to fund grants to nonprofit organizations to
296 operate programs and provide scholarships and for marketing the
297 Hispanic Achievers license plate. National Hispanic Corporate
298 Achievers, Inc., shall establish a Hispanic Achievers Grant
299 Council that shall provide recommendations for statewide grants
300 from available Hispanic Achievers license plate proceeds to
301 nonprofit organizations for programs and scholarships for
302 Hispanic and minority Floridians. National Hispanic Corporate
303 Achievers, Inc., shall also establish a Hispanic Achievers
304 License Plate Fund. Moneys in the fund shall be used by the
305 grant council as provided in this paragraph. All funds received
306 under this subsection must be used in this state.
307 (c) National Hispanic Corporate Achievers, Inc., may retain
308 all proceeds from the annual use fee until documented startup
309 costs for developing and establishing the plate have been
310 recovered. Thereafter, the proceeds from the annual use fee
311 shall be used as follows:
312 1. Up to 5 percent of the proceeds may be used for the cost
313 of administration of the Hispanic Achievers License Plate Fund,
314 the Hispanic Achievers Grant Council, and related matters.
315 2. Funds may be used as necessary for annual audit or
316 compliance affidavit costs.
317 3. Up to 20 percent of the proceeds may be used to market
318 and promote the Hispanic Achievers license plate.
319 4. Twenty-five percent of the proceeds shall be used by the
320 Hispanic Corporate Achievers, Inc., located in Seminole County,
321 for grants.
322 5. The remaining proceeds shall be available to the
323 Hispanic Achievers Grant Council to award grants for services,
324 programs, or scholarships for Hispanic and minority individuals
325 and organizations throughout Florida. All grant recipients must
326 provide to the Hispanic Achievers Grant Council an annual
327 program and financial report regarding the use of grant funds.
328 Such reports must be available to the public.
329 (d) Effective July 1, 2014, the Hispanic Achievers license
330 plate will shift into the presale voucher phase, as provided in
331 s. 320.08053(2)(b). National Hispanic Corporate Achievers, Inc.,
332 shall have 24 months to record a minimum of 1,000 sales. Sales
333 include existing active plates and vouchers sold subsequent to
334 July 1, 2014. During the voucher period, new plates may not be
335 issued, but existing plates may be renewed. If, at the
336 conclusion of the 24-month presale period, the requirement of a
337 minimum of 1,000 sales has been met, the department shall resume
338 normal distribution of the Hispanic Achievers license plate. If,
339 after 24 months, the minimum of 1,000 sales has not been met,
340 the department shall discontinue the Hispanic Achievers license
341 plate. This subsection is repealed June 30, 2016.
342 (76)(80) FALLEN LAW ENFORCEMENT OFFICERS LICENSE PLATES.—
343 (b) The annual use fees shall be distributed to the Police
344 and Kids Foundation, Inc., which may use up to a maximum of 10
345 percent of the proceeds for marketing to promote and market the
346 plate. All remaining proceeds shall be distributed to and used
347 by the Police and Kids Foundation, Inc., for its operations,
348 activities, programs, and projects The remainder of the proceeds
349 shall be used by the Police and Kids Foundation, Inc., to invest
350 and reinvest, and the interest earnings shall be used for the
351 operation of the Police and Kids Foundation, Inc.
352 (80) DUCKS UNLIMITED LICENSE PLATES.—
353 (a) The department shall develop a Ducks Unlimited license
354 plate as provided in this section and s. 320.08053. Ducks
355 Unlimited license plates must bear the colors and design
356 approved by the department. The word “Florida” must appear at
357 the top of the plate, and the words “Conserving Florida
358 Wetlands” must appear at the bottom of the plate.
359 (b) The annual use fees from the sale of the plate shall be
360 distributed to Ducks Unlimited, Inc., a nonprofit corporation
361 under s. 501(c)(3) of the Internal Revenue Code, to be used as
362 follows:
363 1. Up to 5 percent may be used for administrative costs and
364 marketing of the plate.
365 2. A minimum of 95 percent shall be used in this state to
366 support the mission and efforts of Ducks Unlimited, Inc., for
367 the conservation, restoration, and management of Florida
368 wetlands and associated habitats for the benefit of waterfowl,
369 other wildlife, and people.
370 (81) PLAY BALL LICENSE PLATES.—
371 (a) The department shall develop a Play Ball license plate
372 as provided in this section and s. 320.08053. Play Ball license
373 plates must bear the colors and design approved by the
374 department. The word “Florida” must appear at the top of the
375 plate, and the words “Play Ball” must appear at the bottom of
376 the plate.
377 (b) The license plate annual use fees shall be distributed
378 to American Dream Baseball, Inc., which may retain all proceeds
379 from the annual use fees until the startup costs for developing
380 and issuing the license plates have been recovered. Thereafter,
381 American Dream Baseball, Inc., may use the proceeds as follows:
382 1. A maximum of 10 percent may be used for administrative
383 costs of the organization associated with implementing the
384 programs funded by proceeds derived from sales of the specialty
385 license plate and for the promotion and marketing costs of the
386 license plate.
387 2. The remainder shall be used to fund the activities,
388 programs, and projects of American Dream Baseball, Inc.
389 (82) AMERICA THE BEAUTIFUL LICENSE PLATES.—
390 (a) The department shall develop an America The Beautiful
391 license plate as provided in this section and s. 320.08053. The
392 word “Florida” must appear at the top of the plate, and the
393 words “America The Beautiful” must appear on the plate.
394 (b) The annual use fees from the plate shall be distributed
395 to the America the Beautiful Fund as follows: 10 percent to
396 offset its administrative, marketing and promotion costs, and
397 the remaining 85 percent for projects and programs teaching
398 character, leadership, and service to Florida youth; provision
399 of well-being and assistance in the military community; outdoor
400 education advancing self-sufficiency; wildlife conservation
401 including imperiled and managed species; the maintenance of
402 historic or culturally important sites, buildings, structures,
403 or objects, and the development and modification of playgrounds,
404 recreational areas, or other outdoor amenities, including
405 disability access.
406 (83) PROTECT POLLINATORS PLATES.—
407 (a) The department shall develop a Protect Pollinators
408 license plate as provided in this section and s. 320.08053. The
409 word “Florida” must appear at the top of the plate, and the
410 words “Protect Pollinators” must appear at the bottom of the
411 plate.
412 (b) The annual use fees from the sale of the plate shall be
413 distributed to the Florida Wildflower Foundation, Inc., which:
414 1. May use a maximum of 10 percent of the proceeds to
415 market, promote, and administer the Protect Pollinators plate.
416 2. Shall use the remainder of the proceeds to establish
417 pollinator wildflower habitats, fund pollinator education and
418 research programs, and promote awareness of pollinators,
419 including butterflies, native bees and honeybees, hummingbirds,
420 bats, and hundreds of other insects and animal pollinator
421 species, and their importance to Florida agricultural success
422 and the security of the food supply.
423 (84) FLORIDA NATIVE LICENSE PLATES.—
424 (a) The department shall develop a Florida Native license
425 plate as provided in this section and s. 320.08053. The word
426 “Florida” must appear at the top of the plate, and the word
427 “Native” must appear at the bottom of the plate. The plate must
428 contain a camouflage background that includes leaves, flowers,
429 or fronds of a minimum of 12 different Florida native plants.
430 (b)1. The department shall retain all annual use fees from
431 the sale of the plate until all startup costs for developing and
432 issuing the plate have been recovered.
433 2. Thereafter, the annual use fees from the sale of the
434 plate shall be distributed to Florida Native Plant Society, a
435 Florida nonprofit corporation, which may use a maximum of 10
436 percent of such fees for administrative costs and to market and
437 promote the plate. The balance of the fees shall be used by
438 Florida Native Plant Society, to fulfill the mission of the
439 Florida Native Plant Society, where 45 percent is dedicated to
440 maintaining, improving, and restoring public native species,
441 hunting and fishing habitats, and 45 percent is used to promote
442 the cultivation of Florida’s agricultural products through the
443 preservation of native noncrop plants to provide habitats for
444 pollinators and natural enemies to plant pests, and to provide
445 pollen and nectar and undisturbed habitats for bee nesting
446 throughout the growing season.
447 (85) DONATE LIFE FLORIDA LICENSE PLATES.—
448 (a) The department shall develop a Donate Life Florida
449 license plate as provided in this section and s. 320.08053. The
450 plate must bear the colors and design approved by the
451 department. The word “Florida” must appear at the top of the
452 plate, and the words “Donors Saves Lives” must appear at the
453 bottom of the plate.
454 (b) The annual use fees from the sale of the plate shall be
455 distributed to Donate Life Florida, which may use up to 10
456 percent of the proceeds for marketing and administrative costs.
457 The remaining proceeds of the annual use fees shall be used by
458 the Donate Life Florida to educate Florida residents on the
459 importance of organ, tissue and eye donation and for the
460 continued maintenance of the Joshua Abbott Organ and Tissue
461 Donor Registry.
462 (86) SUN SEA SMILES LICENSE PLATES.—
463 (a) The department shall develop a Sun Sea Smiles license
464 plate as provided in this section and s. 320.08053. The plate
465 must bear the colors and design approved by the department. The
466 word “Florida” must appear at the top of the plate, and the
467 words “Sun Sea Smiles” must appear at the bottom of the plate.
468 (b) The annual use fees from the sale of the plate shall be
469 distributed as follows:
470 1. Five percent shall be distributed to the Florida
471 Caribbean Charitable Foundation, Inc., to be used only for
472 marketing of the Sun Sea Smiles license plate.
473 2. An additional 30 percent shall be distributed to the
474 Florida Caribbean Charitable Foundation, Inc. Of this amount, up
475 to 5 percent may be used for administrative expenses, and the
476 remainder shall be used as follows:
477 a. Sixty percent shall be used for a college scholarship
478 program.
479 b. Fifteen percent shall be used to promote health and
480 wellness for residents in this state who are of Caribbean
481 descent.
482 c. Twenty-five percent shall be used to promote awareness
483 of Caribbean culture within this state.
484 3. Twenty percent shall be distributed to the American
485 Friends of Jamaica, Inc., a charitable, not-for-profit
486 organization under s. 501(c)(3) of the Internal Revenue Code
487 registered with the Department of Agriculture and Consumer
488 Services and incorporated in New York, to be used as grants to
489 promote social and community development among residents of this
490 state. Of this amount, up to 5 percent may be used for
491 administrative and marketing expenses.
492 4. Ten percent shall be distributed to Haitian Neighborhood
493 Center Sant La, Inc., to be used to promote social and community
494 development. Of this amount, up to 5 percent may be used for
495 administrative expenses.
496 5. Ten percent shall be distributed to Fanm Ayisyen nan
497 Miyami, Inc., to be used to promote social and community
498 development. Of this amount, up to 10 percent may be used for
499 administrative expenses.
500 6. Twenty percent shall be distributed to Greater Caribbean
501 American Cultural Coalition, Inc., to be used to promote
502 awareness of Caribbean culture within this state. Of this
503 amount, up to 5 percent may be used for administrative expenses.
504 7. Five percent shall be distributed to Little Haiti
505 Optimist Foundation, Inc., to be used to promote awareness of
506 Caribbean culture and youth development within this state. Of
507 this amount, up to 5 percent may be used for administrative
508 expenses.
509 (87) OMEGA PSI PHI FRATERNITY LICENSE PLATES.—
510 (a) The department shall develop an Omega Psi Phi
511 Fraternity license plate as provided in this section and s.
512 320.08053. The plate must bear the colors and design approved by
513 the department. The word “Florida” must appear at the top of the
514 plate, and the words “Omega Psi Phi” must appear at the bottom
515 of the plate.
516 (b) The annual use fees from the sale of the plate shall be
517 distributed to the State of Florida Omega Friendship Foundation,
518 Inc., to be used as follows:
519 1. Five percent shall be used solely for marketing of the
520 Omega Psi Phi Fraternity license plate.
521 2. Ninety-five percent shall be used for college
522 scholarships for residents of the state attending historically
523 black colleges and universities in the state.
524 (88) DELTA SIGMA THETA SORORITY LICENSE PLATES.—
525 (a) The department shall develop a Delta Sigma Theta
526 Sorority license plate as provided in this section and s.
527 320.08053. The plate must bear the colors and design approved by
528 the department. The word “Florida” must appear at the top of the
529 plate, and the words “Delta Sigma Theta” must appear at the
530 bottom of the plate.
531 (b) The annual use fees from the sale of the plate shall be
532 distributed to the Delta Research and Educational Foundation,
533 Inc., to be used as follows:
534 1. Five percent shall be used solely for marketing of the
535 Delta Sigma Theta Sorority license plate.
536 2. Ninety-five percent shall be used for college
537 scholarships for residents of the state attending historically
538 black colleges and universities in the state.
539 (89) SIGMA GAMMA RHO SORORITY LICENSE PLATES.—
540 (a) The department shall develop a Sigma Gamma Rho Sorority
541 license plate as provided in this section and s. 320.08053. The
542 plate must bear the colors and design approved by the
543 department. The word “Florida” must appear at the top of the
544 plate, and the words “Sigma Gamma Rho” must appear at the bottom
545 of the plate.
546 (b) The annual use fees from the sale of the plate shall be
547 distributed to the Department of Education to be used for the
548 Mary McLeod Bethune Scholarship Program in accordance with s.
549 1009.73.
550 (90) KAPPA ALPHA PSI FRATERNITY LICENSE PLATES.—
551 (a) The department shall develop a Kappa Alpha Psi
552 Fraternity license plate as provided in this section and s.
553 320.08053. The plate must bear the colors and design approved by
554 the department. The word “Florida” must appear at the top of the
555 plate, and the words “Kappa Alpha Psi” must appear at the bottom
556 of the plate.
557 (b) The annual use fees from the sale of the plate shall be
558 distributed to the Southern Province of Kappa Alpha Psi
559 Foundation, Inc., to be used as follows:
560 1. Five percent shall be used solely for marketing of the
561 Kappa Alpha Psi Fraternity license plate.
562 2. Ninety-five percent shall be used for college
563 scholarships for residents of the state attending historically
564 black colleges and universities in the state.
565 (91) ALPHA KAPPA ALPHA SORORITY LICENSE PLATES.—
566 (a) The department shall develop an Alpha Kappa Alpha
567 Sorority license plate as provided in this section and s.
568 320.08053. The plate must bear the colors and design approved by
569 the department. The word “Florida” must appear at the top of the
570 plate, and the words “Alpha Kappa Alpha” must appear at the
571 bottom of the plate.
572 (b) The annual use fees from the sale of the plate shall be
573 distributed to the Alpha Kappa Alpha Educational Advancement
574 Foundation, Inc., to be used as follows:
575 1. Five percent shall be used solely for marketing of the
576 Alpha Kappa Alpha Sorority license plate.
577 2. Ninety-five percent shall be used for college
578 scholarships for residents of the state attending historically
579 black colleges and universities in the state.
580 (92) ALPHA PHI ALPHA FRATERNITY LICENSE PLATES.—
581 (a) The department shall develop an Alpha Phi Alpha
582 Fraternity license plate as provided in this section and s.
583 320.08053. The plate must bear the colors and design approved by
584 the department. The word “Florida” must appear at the top of the
585 plate, and the words “Alpha Phi Alpha” must appear at the bottom
586 of the plate.
587 (b) The annual use fees from the sale of the plate shall be
588 distributed to the Department of Education to be used for the Jc
589 Rawls-Ffac Foundation, Inc.
590 (93) ZETA PHI BETA SORORITY LICENSE PLATES.—
591 (a) The department shall develop a Zeta Phi Beta Sorority
592 license plate as provided in this section and s. 320.08053. The
593 plate must bear the colors and design approved by the
594 department. The word “Florida” must appear at the top of the
595 plate, and the words “Zeta Phi Beta” must appear at the bottom
596 of the plate.
597 (b) The annual use fees from the sale of the plate shall be
598 distributed to the Department of Education to be used for the
599 Mary McLeod Bethune Scholarship Program in accordance with s.
600 1009.73.
601 (94) PHI BETA SIGMA FRATERNITY LICENSE PLATES.—
602 (a) The department shall develop a Phi Beta Sigma
603 Fraternity license plate as provided in this section and s.
604 320.08053. The plate must bear the colors and design approved by
605 the department. The word “Florida” must appear at the top of the
606 plate, and the words “Phi Beta Sigma” must appear at the bottom
607 of the plate.
608 (b) The annual use fees from the sale of the plate shall be
609 distributed to the Department of Education to be used for the
610 Mary McLeod Bethune Scholarship Program in accordance with s.
611 1009.73.
612 (95) IOTA PHI THETA FRATERNITY LICENSE PLATES.—
613 (a) The department shall develop an Iota Phi Theta
614 Fraternity license plate as provided in this section and s.
615 320.08053. The plate must bear the colors and design approved by
616 the department. The word “Florida” must appear at the top of the
617 plate, and the words “Iota Phi Theta” must appear at the bottom
618 of the plate.
619 (b) The annual use fees from the sale of the plate shall be
620 distributed to the Department of Education to be used for the
621 Mary McLeod Bethune Scholarship Program in accordance with s.
622 1009.73.
623 (96) DAN MARINO FOUNDATION LICENSE PLATES.—
624 (a) The department shall develop a Dan Marino Foundation
625 license plate as provided in this section and s. 320.08053. Dan
626 Marino Foundation license plates must bear the colors and design
627 approved by the department. The word “Florida” must appear at
628 the top of the plate, and the words “Marino Campus” must appear
629 at the bottom of the plate.
630 (b) The annual use fees from the sale of the plate shall be
631 distributed to the Dan Marino Foundation, Inc., a Florida
632 nonprofit corporation, which may use up to 10 percent of such
633 fees for administrative costs and marketing of the plate. The
634 remainder of the fees shall be used by the Dan Marino
635 Foundation, Inc., to assist Floridians with developmental
636 disabilities to become employed, independent, and productive,
637 and to promote and fund educational scholarships and awareness
638 of these services.
639 (97) FLORIDA STATE BEEKEEPERS ASSOCIATION LICENSE PLATES.—
640 (a) The department shall develop a Florida State Beekeepers
641 Association license plate as provided in this section and s.
642 320.08053. The plate must bear the colors and design approved by
643 the department. The word “Florida” must appear at the top of the
644 plate, and the words “Save the Bees” must appear at the bottom
645 of the plate.
646 (b) The annual use fees shall be distributed to the Florida
647 State Beekeepers Association, a Florida nonprofit corporation.
648 The Florida State Beekeepers Association may use up to 18
649 percent of the annual use fees for:
650 1. Direct reimbursement for administrative costs, startup
651 costs, and costs incurred in the development and approval
652 process of the license plate. All vendors associated with the
653 administrative costs shall be selected by competitive bid.
654 2. Promotion and marketing costs of the license plate.
655 (c) The remaining funds shall be distributed to the Florida
656 State Beekeepers Association and shall be used to raise
657 awareness of the importance of beekeeping to Florida agriculture
658 by funding honeybee research, education, outreach, and
659 husbandry. The Florida State Beekeepers Association board of
660 managers must approve and is accountable for all such
661 expenditures.
662 (98) ORLANDO UNITED LICENSE PLATES.—
663 (a) The department shall develop an Orlando United license
664 plate as provided in this section and s. 320.08053. The plate
665 must bear the colors and design approved by the department. The
666 word “Florida” must appear at the top of the plate, and the
667 words “Orlando United” must appear at the bottom of the plate.
668 (b) The annual use fees from the sale of the plate shall be
669 distributed as follows:
670 1. Seven percent shall be distributed to the Mental Health
671 Association of Central Florida, Inc., to be used for marketing
672 of the license plate.
673 2. Thirty-one percent shall be distributed to the Mental
674 Health Association of Central Florida, Inc. Of this amount, up
675 to 5 percent may be used for administrative expenses, and the
676 remainder shall be used to offer free personalized counseling to
677 any person affected by the shooting at the Pulse nightclub in
678 Orlando, Florida, on June 12, 2016.
679 3. Thirty-one percent shall be distributed to the Hispanic
680 Federation, Inc., a charitable, not-for-profit organization
681 under s. 501(c)(3) of the Internal Revenue Code registered with
682 the Department of Agriculture and Consumer Services and
683 incorporated in New York. Of this amount, up to 5 percent may be
684 used for administrative expenses, and the remainder shall be
685 used to offer free personalized counseling to any person
686 affected by the shooting at the Pulse nightclub in Orlando,
687 Florida, on June 12, 2016, through the Proyecto Somos Orlando
688 campaign operated by the Hispanic Federation, Inc.
689 4. Thirty-one percent shall be distributed to Two Spirit
690 Health Services, Inc. Of this amount, up to 5 percent may be
691 used for administrative expenses, and the remainder shall be
692 used to offer free personalized counseling to any person
693 affected by the shooting at the Pulse nightclub in Orlando,
694 Florida, on June 12, 2016.
695 (99) ETHICAL ECOTOURISM LICENSE PLATES.—
696 (a) The department shall develop an Ethical Ecotourism
697 license plate as provided in this section and s. 320.08053. The
698 word “Florida” must appear at the top of the plate, and words
699 that are approved by the department must appear at the bottom of
700 the plate.
701 (b) The annual use fees from the sale of the plate shall be
702 distributed equally between the Florida Society for Ethical
703 Ecotourism and Paddle Florida, Inc., each of which may use up to
704 10 percent of the proceeds for administrative costs and
705 marketing of the plate. The balance of the annual use fees shall
706 be used by the Florida Society for Ethical Ecotourism to provide
707 environmental education and awareness that encourages behaviors
708 that contribute to the sustainability of Florida’s natural
709 ecosystems and resources and Paddle Florida, Inc., to raise
710 awareness about water conservation, wildlife preservation,
711 restoration of springs, and protection of waterways in this
712 state.
713 (100) ROTARY LICENSE PLATES.—
714 (a) The department shall develop a Rotary license plate as
715 provided in this section and s. 320.08053. The plate must bear
716 the colors and design approved by the department. The word
717 “Florida” must appear at the top of the plate, and the word
718 “Rotary” must appear on the bottom of the plate. The license
719 plate must bear the Rotary International wheel emblem.
720 (b) The annual use fees shall be distributed to the
721 Community Foundation of Tampa Bay, Inc., to distribute as
722 follows:
723 1. Up to 10 percent for administrative costs and for
724 marketing of the plate.
725 2. Ten percent to Rotary’s Camp Florida for direct support
726 to all programs and services provided to special needs children
727 who attend the camp.
728 3. The remainder shall be distributed, proportionally based
729 on sales, to each Rotary district in the state in support of
730 Rotary youth programs in Florida.
731 (101) AUBURN UNIVERSITY LICENSE PLATES.—
732 (a) The department shall develop an Auburn University
733 license plate as provided in this section and s. 320.08053. The
734 plate must bear the colors and design approved by the
735 department. The word “Florida” must appear at the top of the
736 plate, and the words “War Eagle” must appear at the bottom of
737 the plate.
738 (b) The Tampa Bay Auburn Club is the lead club on behalf of
739 the Auburn clubs in this state. The annual use fees from the
740 sale of the plate shall be distributed to the Tampa Bay Auburn
741 Club, together with statistics on sales of the license plates
742 tabulated by county. The Tampa Bay Auburn Club must distribute
743 to each of the state’s Auburn clubs on a pro-rata basis the
744 moneys received from sales in the regions within the respective
745 club’s area for the purpose of awarding scholarships to Florida
746 residents attending Auburn University. Students receiving these
747 scholarships must be eligible for the Florida Bright Futures
748 Scholarship Program pursuant to s. 1009.531 and shall use the
749 scholarship funds for tuition and other expenses related to
750 attending Auburn University.
751 (102) BEAT CHILDHOOD CANCER LICENSE PLATES.—
752 (a) The department shall develop a Beat Childhood Cancer
753 license plate as provided in this section and s. 320.08053. The
754 plate must bear the colors and design approved by the
755 department. The word “Florida” must appear at the top of the
756 plate, and the words “Beat Childhood Cancer” must appear at the
757 bottom of the plate.
758 (b) The annual use fees from the sale of the plate shall be
759 distributed to Beat Nb, Inc., which may use up to 10 percent of
760 the proceeds for administrative costs directly associated with
761 the operation of the corporation and for marketing and promoting
762 the plate. The remaining proceeds shall be used by the
763 corporation to fund pediatric cancer treatment and research.
764 (103) AMERICAN EAGLE LICENSE PLATES.—
765 (a) The department shall develop an American Eagle license
766 plate as provided in this section and s. 320.08053. The plate
767 must bear the colors and design approved by the department. The
768 word “Florida” must appear at the top of the plate, and the
769 words “God Bless America” must appear at the bottom of the
770 plate.
771 (b) The annual use fees from the sale of the plate shall be
772 distributed to the American Eagle Foundation for deposit in the
773 foundation’s national endowment fund. Up to 10 percent of the
774 funds received may be used for administrative costs and
775 marketing of the plate. The American Eagle Foundation shall use
776 the remainder of the proceeds to fund public education programs,
777 rescue and care programs, and other conservation efforts in
778 Florida which benefit bald eagles.
779 (104) FLORIDA BAY FOREVER LICENSE PLATES.—
780 (a) The department shall develop a Florida Bay Forever
781 license plate as provided in this section and s. 320.08053. The
782 plate must bear the colors and design approved by the
783 department. The word “Florida” must appear at the top of the
784 plate, and the words “Florida Bay Forever” must appear at the
785 bottom of the plate.
786 (b) The annual use fees from the sale of the plate shall be
787 distributed to the Florida National Park Association, Inc.,
788 which may use up to 10 percent of the proceeds for
789 administrative costs and marketing of the plate. The remainder
790 of the funds shall be used to supplement the Everglades National
791 Park’s budgets and to support educational, interpretive,
792 historical, and scientific research relating to the Everglades
793 National Park.
794 (105) BONEFISH AND TARPON TRUST LICENSE PLATES.—
795 (a) The department shall develop a Bonefish and Tarpon
796 Trust license plate as provided in this section. The word
797 “Florida” must appear at the top of the plate, and the words
798 “Bonefish and Tarpon Trust” must appear at the bottom of the
799 plate.
800 (b) The annual use fees from the sale of the plate shall be
801 distributed to the Bonefish and Tarpon Trust, which:
802 1. May use a maximum of 10 percent of the proceeds to
803 promote and market the Bonefish and Tarpon Trust license plate.
804 2. Shall invest and reinvest the remainder of the proceeds
805 and use the interest thereon to conserve and enhance Florida
806 bonefish and tarpon fisheries and their respective environments
807 through stewardship, research, education, and advocacy.
808 (106) UNIVERSITY OF GEORGIA LICENSE PLATES.—
809 (a) The department shall develop a University of Georgia
810 license plate as provided in this section and s. 320.08053. The
811 plate must bear the colors and design approved by the
812 department. The word “Florida” must appear at the top of the
813 plate, and the words “The University of Georgia” must appear at
814 the bottom of the plate.
815 (b) The Georgia Bulldog Club of Jacksonville is the lead
816 club on behalf of the University of Georgia Booster Clubs in
817 this state. The annual use fees from the sale of the plate shall
818 be distributed to the Georgia Bulldog Club of Jacksonville,
819 together with statistics on sales of the license plates
820 tabulated by county. The Georgia Bulldog Club of Jacksonville
821 must distribute to each of the state’s University of Georgia
822 Booster Clubs on a pro-rata basis the moneys received from sales
823 in the regions within the respective club’s area for the purpose
824 of awarding scholarships to Florida residents attending the
825 University of Georgia. Students receiving these scholarships
826 must be eligible for the Florida Bright Futures Scholarship
827 Program pursuant to s. 1009.531 and shall use the scholarship
828 funds for tuition and other expenses related to attending the
829 University of Georgia.
830 Section 5. Section 320.08062, Florida Statutes, is amended
831 to read:
832 320.08062 Audits and attestations required; annual use fees
833 of specialty license plates.—
834 (1)(a) All organizations that receive annual use fee
835 proceeds from the department are responsible for ensuring that
836 proceeds are used in accordance with ss. 320.08056 and
837 320.08058.
838 (b) Any organization not subject to audit pursuant to s.
839 215.97 shall annually attest, under penalties of perjury, that
840 such proceeds were used in compliance with ss. 320.08056 and
841 320.08058. The attestation shall be made annually in a form and
842 format determined by the department. In addition, the department
843 shall audit any such organization every 2 years to ensure
844 proceeds have been used in compliance with ss. 320.08056 and
845 320.08058.
846 (c) Any organization subject to audit pursuant to s. 215.97
847 shall submit an audit report in accordance with rules
848 promulgated by the Auditor General. The annual attestation shall
849 be submitted to the department for review within 9 months after
850 the end of the organization’s fiscal year.
851 (2)(a) Within 120 days after receiving an organization’s
852 audit or attestation, the department shall determine which
853 recipients of revenues from specialty license plate annual use
854 fees have not complied with subsection (1). In determining
855 compliance, the department may commission an independent
856 actuarial consultant, or an independent certified public
857 accountant, who has expertise in nonprofit and charitable
858 organizations.
859 (b) The department must discontinue the distribution of
860 revenues to any organization failing to submit the required
861 documentation as required in subsection (1), but may resume
862 distribution of the revenues upon receipt of the required
863 information.
864 (c) If the department or its designee determines that an
865 organization has not complied or has failed to use the revenues
866 in accordance with ss. 320.08056 and 320.08058, the department
867 must discontinue the distribution of the revenues to the
868 organization. The department shall notify the organization of
869 its findings and direct the organization to make the changes
870 necessary in order to comply with this chapter. If the officers
871 of the organization sign an affidavit under penalties of perjury
872 stating that they acknowledge the findings of the department and
873 attest that they have taken corrective action and that the
874 organization will submit to a followup review by the department,
875 the department may resume the distribution of revenues.
876 (d) If an organization fails to comply with the
877 department’s recommendations and corrective actions as outlined
878 in paragraph (c), the revenue distributions shall be
879 discontinued until completion of the next regular session of the
880 Legislature. The department shall notify the President of the
881 Senate and the Speaker of the House of Representatives by the
882 first day of the next regular session of any organization whose
883 revenues have been withheld as a result of this paragraph. If
884 the Legislature does not provide direction to the organization
885 and the department regarding the status of the undistributed
886 revenues, the department shall deauthorize the plate and the
887 undistributed revenues shall be immediately deposited into the
888 Highway Safety Operating Trust Fund.
889 (3) The department or its designee has the authority to
890 examine all records pertaining to the use of funds from the sale
891 of specialty license plates.
892 Section 6. Subsection (5) is added to section 320.0842,
893 Florida Statutes, to read:
894 320.0842 Free motor vehicle license plates to veterans who
895 use wheelchairs.—
896 (5) An owner or lessee of a motor vehicle who resides in
897 this state and qualifies for a license plate under this section
898 and a Purple Heart license plate under s. 320.089, upon
899 application to the department, shall be issued a license plate
900 stamped with the words “Combat-wounded Veteran” followed by the
901 serial number of the license plate and the international symbol
902 of accessibility. The license plate entitles the person to all
903 privileges afforded by a license plate issued under this
904 section. When more than one registrant is listed on the
905 registration issued under this section, the eligible applicant
906 shall be noted on the registration certificate.
907 Section 7. Subsection (7) is added to section 320.086,
908 Florida Statutes, to read:
909 320.086 Ancient or antique motor vehicles; horseless
910 carriage, antique, or historical license plates; former military
911 vehicles.—
912 (7) For purposes of this section, a trailer is considered a
913 motor vehicle.
914 Section 8. Section 320.0875, Florida Statutes, is created
915 to read:
916 320.0875 Purple Heart motorcycle special license plate.—
917 (1) Upon application to the department and payment of the
918 license tax for the motorcycle as provided in s. 320.08, a
919 resident of this state who owns or leases a motorcycle that is
920 not used for hire or commercial use shall be issued a Purple
921 Heart motorcycle special license plate if he or she provides
922 documentation acceptable to the department that he or she is a
923 recipient of the Purple Heart medal.
924 (2) The Purple Heart motorcycle special license plate shall
925 be stamped with the words “Combat-wounded Veteran” followed by
926 the serial number of the license plate. The Purple Heart
927 motorcycle special license plate may have the words “Purple
928 Heart” stamped on the plate and the likeness of the Purple Heart
929 medal appearing on the plate.
930 Section 9. Section 320.089, Florida Statutes, is amended to
931 read:
932 320.089 Veterans of the United States Armed Forces; members
933 of National Guard; survivors of Pearl Harbor; Purple Heart medal
934 recipients; active or retired United States Armed Forces
935 reservists; Combat Infantry Badge, Combat Medical Badge, or
936 Combat Action Badge recipients; Combat Action Ribbon recipients;
937 Air Force Combat Action Medal recipients; Distinguished Flying
938 Cross recipients; former prisoners of war; Korean War Veterans;
939 Vietnam War Veterans; Operation Desert Shield Veterans;
940 Operation Desert Storm Veterans; Operation Enduring Freedom
941 Veterans; Operation Iraqi Freedom Veterans; Women Veterans;
942 World War II Veterans; and Navy Submariners; Special license
943 plates for military servicemembers, veterans, and Pearl Harbor
944 Survivors; fee.—
945 (1)(a) Upon application to the department and payment of
946 the license tax for the vehicle as provided in s. 320.08, a
947 resident of the state who owns or leases Each owner or lessee of
948 an automobile or truck for private use or recreational vehicle
949 as specified in s. 320.08(9)(c) or (d), which is not used for
950 hire or commercial use, shall be issued a license plate pursuant
951 to the following if the applicant provides the department with
952 proof that he or she meets the qualifications listed in this
953 section for the applicable license plate:
954 1. A person released or discharged from any branch who is a
955 resident of the state and a veteran of the United States Armed
956 Forces shall be issued a license plate stamped with the words
957 “Veteran” or “Woman Veteran” followed by the serial number of
958 the license plate., a Woman Veteran,
959 2. A World War II Veteran shall be issued a license plate
960 stamped with the words “WWII Veteran” followed by the serial
961 number of the license plate.,
962 3. A Navy Submariner shall be issued a license plate
963 stamped with the words “Navy Submariner” followed by the serial
964 number of the license plate.,
965 4. An active or retired member of the Florida National
966 Guard shall be issued a license plate stamped with the words
967 “National Guard” followed by the serial number of the license
968 plate.
969 5. A member of the Pearl Harbor Survivors Association or
970 other person on active military duty in Pearl Harbor on December
971 7, 1941, shall be issued a license plate stamped with the words
972 “Pearl Harbor Survivor” followed by the serial number of the
973 license plate., a survivor of the attack on Pearl Harbor,
974 6. A recipient of the Purple Heart medal shall be issued a
975 license plate stamped with the words “Combat-wounded Veteran”
976 followed by the serial number of the license plate. The Purple
977 Heart plate may have the words “Purple Heart” stamped on the
978 plate and the likeness of the Purple Heart medal appearing on
979 the plate.,
980 7. An active or retired member of any branch of the United
981 States Armed Forces Reserve shall be issued a license plate
982 stamped with the words “U.S. Reserve” followed by the serial
983 number of the license plate.
984 8. A member of the Combat Infantrymen’s Association, Inc.,
985 or a recipient of the Combat Infantry Badge, Combat Medical
986 Badge, Combat Action Badge, Combat Action Ribbon, or Air Force
987 Combat Action Medal shall be issued a license plate stamped with
988 the words “Combat Infantry Badge,” “Combat Medical Badge,”
989 “Combat Action Badge,” “Combat Action Ribbon,” or “Air Force
990 Combat Action Medal,” as appropriate, and a likeness of the
991 related campaign badge, ribbon, or medal followed by the serial
992 number of the license plate.
993 9. A recipient of the, or Distinguished Flying Cross shall
994 be issued a license plate stamped with the words “Distinguished
995 Flying Cross” and a likeness of the Distinguished Flying Cross
996 followed by the serial number of the license plate.
997 10. A recipient of the Bronze Star shall be issued a
998 license plate stamped with the words “Bronze Star” and a
999 likeness of the Bronze Star Medal followed by the serial number
1000 of the license plate. A recipient of the Bronze Star with the
1001 “V” device shall be issued a license plate stamped with the
1002 words “Bronze Star” and a likeness of the Bronze Star Medal with
1003 the “V” device emblem followed by the serial number of the
1004 license plate, upon application to the department, accompanied
1005 by proof of release or discharge from any branch of the United
1006 States Armed Forces, proof of active membership or retired
1007 status in the Florida National Guard, proof of membership in the
1008 Pearl Harbor Survivors Association or proof of active military
1009 duty in Pearl Harbor on December 7, 1941, proof of being a
1010 Purple Heart medal recipient, proof of active or retired
1011 membership in any branch of the United States Armed Forces
1012 Reserve, or proof of membership in the Combat Infantrymen’s
1013 Association, Inc., proof of being a recipient of the Combat
1014 Infantry Badge, Combat Medical Badge, Combat Action Badge,
1015 Combat Action Ribbon, Air Force Combat Action Medal, or
1016 Distinguished Flying Cross, and upon payment of the license tax
1017 for the vehicle as provided in s. 320.08, shall be issued a
1018 license plate as provided by s. 320.06 which, in lieu of the
1019 serial numbers prescribed by s. 320.06, is stamped with the
1020 words “Veteran,” “Woman Veteran,” “WWII Veteran,” “Navy
1021 Submariner,” “National Guard,” “Pearl Harbor Survivor,” “Combat
1022 wounded veteran,” “U.S. Reserve,” “Combat Infantry Badge,”
1023 “Combat Medical Badge,” “Combat Action Badge,” “Combat Action
1024 Ribbon,” “Air Force Combat Action Medal,” or “Distinguished
1025 Flying Cross,” as appropriate, and a likeness of the related
1026 campaign medal or badge, followed by the serial number of the
1027 license plate. Additionally, the Purple Heart plate may have the
1028 words “Purple Heart” stamped on the plate and the likeness of
1029 the Purple Heart medal appearing on the plate.
1030 (b) Notwithstanding any other provision of law to the
1031 contrary, beginning with fiscal year 2002-2003 and annually
1032 thereafter, the first $100,000 in general revenue generated from
1033 the sale of license plates issued under this section shall be
1034 deposited into the Grants and Donations Trust Fund, as described
1035 in s. 296.38(2), to be used for the purposes established by law
1036 for that trust fund. Any additional general revenue generated
1037 from the sale of such plates shall be deposited into the State
1038 Homes for Veterans Trust Fund and used solely to construct,
1039 operate, and maintain domiciliary and nursing homes for
1040 veterans, subject to the requirements of chapter 216.
1041 (c) Any revenue generated from the sale of Woman Veteran
1042 license plates must be deposited into the Operations and
1043 Maintenance Trust Fund administered by the Department of
1044 Veterans’ Affairs pursuant to s. 20.375(3) and must be used
1045 solely for the purpose of creating and implementing programs to
1046 benefit women veterans.
1047 (d) Notwithstanding any provisions of law to the contrary,
1048 an applicant for a Pearl Harbor Survivor license plate or a
1049 Purple Heart license plate who also qualifies for a disabled
1050 veteran’s license plate under s. 320.084 shall be issued the
1051 appropriate special license plate without payment of the license
1052 tax imposed by s. 320.08.
1053 (2) Each owner or lessee of an automobile or truck for
1054 private use, a truck weighing not more than 7,999 pounds, or a
1055 recreational vehicle as specified in s. 320.08(9)(c) or (d),
1056 which is not used for hire or commercial use who is a resident
1057 of this state and who is a former prisoner of war, or his or her
1058 unremarried surviving spouse, upon application to the
1059 department, shall be issued a license plate as provided in s.
1060 320.06 which may have the words “Ex-POW”, stamped on the plate
1061 and the likeness of the Prisoner of War Medal with the words
1062 “Ex-POW” followed by the serial number. Each application shall
1063 be accompanied by proof that the applicant meets the
1064 qualifications specified in paragraph (a) or paragraph (b).
1065 (a) A citizen of the United States who served as a member
1066 of the Armed Forces of the United States or the armed forces of
1067 a nation allied with the United States who was held as a
1068 prisoner of war at such time as the Armed Forces of the United
1069 States were engaged in combat, or his or her unremarried
1070 surviving spouse, may be issued the special license plate
1071 provided for in this subsection without payment of the license
1072 tax imposed by s. 320.08.
1073 (b) A person who was serving as a civilian with the consent
1074 of the United States Government, or a person who was a member of
1075 the Armed Forces of the United States while he or she was not a
1076 United States citizen and was held as a prisoner of war when the
1077 Armed Forces of the United States were engaged in combat, or his
1078 or her unremarried surviving spouse, may be issued the special
1079 license plate provided for in this subsection upon payment of
1080 the license tax imposed by s. 320.08.
1081 (3) Each owner or lessee of an automobile or truck for
1082 private use, a truck weighing not more than 7,999 pounds, or a
1083 recreational vehicle as specified in s. 320.08(9)(c) or (d),
1084 which is not used for hire or commercial use who is a resident
1085 of this state and who is the unremarried surviving spouse of a
1086 recipient of the Purple Heart medal, upon application to the
1087 department accompanied by the payment of the required fees,
1088 shall be issued a license plate as provided in s. 320.06 which
1089 is stamped with the words “Purple Heart” and the likeness of the
1090 Purple Heart medal followed by the serial number. Each
1091 application shall be accompanied by proof that the applicant is
1092 the unremarried surviving spouse of a recipient of the Purple
1093 Heart medal.
1094 (4) The owner or lessee of an automobile or truck for
1095 private use, a truck weighing not more than 7,999 pounds, or a
1096 recreational vehicle as specified in s. 320.08(9)(c) or (d)
1097 which is not used for hire or commercial use who is a resident
1098 of this state and a current or former member of the United
1099 States Armed Forces who was deployed and served in Korea during
1100 the Korean War as defined in s. 1.01(14), upon application to
1101 the department accompanied by proof of active membership or
1102 former active duty status during the Korean War and payment of
1103 the license tax for the vehicle as provided in s. 320.08, shall
1104 be issued a license plate as provided by s. 320.06 which, in
1105 lieu of the registration license number prescribed by s. 320.06,
1106 is stamped with the words “Korean War Veteran” and a likeness of
1107 the Korean Service Medal, followed by the registration license
1108 number of the plate. Proof that the applicant was awarded the
1109 Korean Service Medal is sufficient to establish eligibility for
1110 the license plate.
1111 (5) The owner or lessee of an automobile or truck for
1112 private use, a truck weighing not more than 7,999 pounds, or a
1113 recreational vehicle as specified in s. 320.08(9)(c) or (d)
1114 which is not used for hire or commercial use who is a resident
1115 of this state and a current or former member of the United
1116 States military who was deployed and served in Vietnam during
1117 United States military deployment in Indochina, upon application
1118 to the department accompanied by proof of active membership or
1119 former active duty status during these operations and payment of
1120 the license tax for the vehicle as provided in s. 320.08, shall
1121 be issued a license plate as provided by s. 320.06 which, in
1122 lieu of the registration license number prescribed by s. 320.06,
1123 is stamped with the words “Vietnam War Veteran” and a likeness
1124 of the Vietnam Service Medal, followed by the registration
1125 license number of the plate. Proof that the applicant was
1126 awarded the Vietnam Service Medal is sufficient to establish
1127 eligibility for the license plate.
1128 (6) The owner or lessee of an automobile or truck for
1129 private use, a truck weighing not more than 7,999 pounds, or a
1130 recreational vehicle as specified in s. 320.08(9)(c) or (d)
1131 which is not used for hire or commercial use who is a resident
1132 of this state and a current or former member of the United
1133 States military who was deployed and served in Saudi Arabia,
1134 Kuwait, or another area of the Persian Gulf during Operation
1135 Desert Shield or Operation Desert Storm; in Afghanistan during
1136 Operation Enduring Freedom; or in Iraq during Operation Iraqi
1137 Freedom, upon application to the department accompanied by proof
1138 of active membership or former active duty status during one of
1139 these operations and payment of the license tax for the vehicle
1140 as provided in s. 320.08, shall be issued a license plate as
1141 provided by s. 320.06 which, in lieu of the registration license
1142 number prescribed by s. 320.06, is stamped with the words
1143 “Operation Desert Shield,” “Operation Desert Storm,” “Operation
1144 Enduring Freedom,” or “Operation Iraqi Freedom,” as appropriate,
1145 and a likeness of the related campaign medal followed by the
1146 registration license number of the plate. Proof that the
1147 applicant was awarded the Southwest Asia Service Medal, Iraq
1148 Campaign Medal, Afghanistan Campaign Medal, or Global War on
1149 Terrorism Expeditionary Medal is sufficient to establish
1150 eligibility for the appropriate license plate.
1151 Section 10. Except as otherwise expressly provided in this
1152 act, this act shall take effect October 1, 2017.
