    1                        A bill to be entitled                      
    2         An act relating to body cameras; amending s. 943.1718,
    3         F.S.; requiring law enforcement agencies that permit
    4         law enforcement officers to wear body cameras to
    5         establish policies and procedures that include a
    6         provision permitting a law enforcement officer using a
    7         body camera to review body camera footage before
    8         taking certain actions; providing an exception;
    9         providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsection (2) of section 943.1718, Florida
   14  Statutes, is amended to read:
   15         943.1718 Body cameras; policies and procedures.—
   16         (2) A law enforcement agency that permits its law
   17  enforcement officers to wear body cameras shall establish
   18  policies and procedures addressing the proper use, maintenance,
   19  and storage of body cameras and the data recorded by body
   20  cameras. The policies and procedures must include:
   21         (a) General guidelines for the proper use, maintenance, and
   22  storage of body cameras.
   23         (b) Any limitations on which law enforcement officers are
   24  permitted to wear body cameras.
   25         (c) Any limitations on law-enforcement-related encounters
   26  and activities in which law enforcement officers are permitted
   27  to wear body cameras.
   28         (d) A provision permitting a law enforcement officer using
   29  a body camera to review the recorded footage from the body
   30  camera, upon his or her own initiative or request, before
   31  writing a report or providing a statement regarding an event
   32  arising within the scope of his or her official duties. Any such
   33  provision may not apply to an officer’s inherent duty to
   34  immediately disclose information necessary to secure an active
   35  crime scene or to identify suspects or witnesses.
   36         (e)(d) General guidelines for the proper storage,
   37  retention, and release of audio and video data recorded by body
   38  cameras.
   39         Section 2. This act shall take effect July 1, 2017.
