Florida Senate - 2017 SB 650 By Senator Book 32-00526-17 2017650__ 1 A bill to be entitled 2 An act relating to retail establishments and shopping 3 centers; creating s. 316.1966, F.S.; requiring certain 4 parking lots to contain a minimum amount of parking 5 spaces designated for use by expectant mothers, 6 subject to certain requirements; requiring the 7 Department of Transportation to establish requirements 8 for signage and markings for such parking spaces; 9 amending s. 383.015, F.S.; requiring certain retail 10 establishments and shopping centers to provide and 11 maintain breastfeeding areas; defining the term 12 “breastfeeding area”; providing an effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. Section 316.1966, Florida Statutes, is created 17 to read: 18 316.1966 Parking spaces for expectant mothers.— 19 (1) The parking lot of a retail establishment or shopping 20 center which contains more than 100 parking spaces must include 21 at least 1 parking space that is designated for use by expectant 22 mothers. Such a parking space must be located as closely as 23 possible to parking spaces designated for use by persons with 24 disabilities as provided in s. 553.5041; however, the location 25 of parking spaces designated for use by persons with 26 disabilities shall take precedence. 27 (2) The Department of Transportation shall establish 28 requirements for signage and markings used by the retail 29 establishment or shopping center to designate parking spaces for 30 use by expectant mothers as provided in subsection (1). 31 Section 2. Present subsection (2) of section 383.015, 32 Florida Statutes, is redesignated as subsection (3), and a new 33 subsection (2) is added to that section, to read: 34 383.015 Breastfeeding.—The breastfeeding of a baby is an 35 important and basic act of nurture which must be encouraged in 36 the interests of maternal and child health and family values, 37 and in furtherance of this goal: 38 (2) A retail establishment or shopping center having a 39 parking lot containing more than 100 parking spaces must provide 40 and maintain a breastfeeding area located in such establishment 41 or center. As used in this subsection, the term “breastfeeding 42 area” means a room or other location in a retail establishment 43 or shopping center which: 44 (a) Provides a location shielded from view and free from 45 intrusion by the public where a woman may breastfeed or express 46 breast milk; 47 (b) Has a door that can be locked; 48 (c) Includes a place to sit; 49 (d) Is readily accessible to and usable by persons with 50 disabilities, including persons who use wheelchairs, as required 51 under the Americans with Disabilities Act of 1990; and 52 (e) Is not located in a restroom or dressing room. 53 Section 3. This act shall take effect July 1, 2017.
