    2         An act relating to prisoner medical services; creating
    3         s. 951.0325, F.S.; providing definitions; limiting
    4         compensation to health care providers that do not have
    5         contracts with the county or municipality operating a
    6         detention facility to provide prisoner medical
    7         services; limiting compensation to entities that
    8         provide emergency medical transportation services for
    9         prisoners if those entities do not have a contract
   10         with the county or municipality operating a detention
   11         facility; providing applicability; providing an
   12         effective date.
   13          
   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Section 951.0325, Florida Statutes, is created
   17  to read:
   18         951.0325Prisoner medical services.—
   19         (1)As used in this section, the term:
   20         (a)“Emergency medical transportation services” includes,
   21  but is not limited to, services rendered by ambulances,
   22  emergency medical services vehicles, and air ambulances as those
   23  terms are defined in s. 401.23.
   24         (b)“Health care provider” has the same meaning as provided
   25  in s. 766.105.
   26         (2)Compensation to a health care provider to provide
   27  prisoner medical services may not exceed 110 percent of the
   28  Medicare allowable rate if the health care provider does not
   29  have a contract to provide such services with the county or
   30  municipality operating the county or municipal detention
   31  facility that houses the prisoner. However, compensation to a
   32  health care provider may not exceed 125 percent of the Medicare
   33  allowable rate if:
   34         (a)The health care provider does not have a contract to
   35  provide medical services with the county or municipality that
   36  houses the prisoner; and
   37         (b)The health care provider reported a negative operating
   38  margin for the previous year to the Agency for Health Care
   39  Administration through hospital-audited financial data.
   40         (3)Compensation to an entity to provide emergency medical
   41  transportation services for a prisoner may not exceed 110
   42  percent of the Medicare allowable rate if the entity does not
   43  have a contract to provide such services with the county or
   44  municipality operating the county or municipal detention
   45  facility housing the prisoner.
   46         (4)This section does not apply to charges for medical
   47  services for prisoners provided at a hospital operated by the
   48  county or municipality.
   49         Section 2. This act shall take effect July 1, 2017.
