Section 456.0495, Florida Statutes, is created 6 to read: 7 456.0495 Reporting adverse incidents occurring in out-of 8 hospital births.— 9 (1) A midwife licensed under chapter 467 or health care 10 provider, as applicable, shall report any adverse incident, as 11 defined by department rule, occurring as a result of an 12 attempted or completed, planned birthing center or out-of 13 hospital birth, along with a medical summary of events, to the 14 department within 15 days after the adverse incident occurs. 15 (2) The department shall adopt rules establishing 16 guidelines for reporting adverse incidents, including, but not 17 limited to: 18 (a) Maternal deaths that occur during delivery or within 42 19 days after delivery. 20 (b) Transfers of maternal patients to a hospital intensive 21 care unit. 22 (c) Maternal patients who experience hemorrhagic shock or 23 who require a transfusion of more than 4 units of blood or blood 24 products. 25 (d) Fetal or infant deaths, including stillbirths, 26 associated with obstetrical deliveries. 27 (e) Transfers of infants to a neonatal intensive care unit 28 due to a traumatic physical or neurological birth injury, 29 including any degree of a brachial plexus injury. 30 (f) Transfers of infants to a neonatal intensive care unit 31 within the first 72 hours after birth if the infant remains in 32 such unit for more than 72 hours. 33 34 ================= T I T L E A M E N D M E N T ================ 35 And the title is amended as follows: 36 Delete lines 2 - 3 37 and insert: 38 An act relating to health care practitioners; creating 39 s. 456.0495, F.S.; requiring licensed midwives and 40 health care providers to report adverse incidents to 41 the Department of Health within a certain period; 42 requiring the department to adopt rules establishing 43 guidelines for reporting specified adverse incidents; 44 amending s. 456.076, F.S.; revising
