       Senator Baxley moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 323 - 379
    4  and insert:
    5         Section 8. Paragraph (a) of subsection (8) and subsection
    6  (11) of section 1002.37, Florida Statutes, are amended to read:
    7         1002.37 The Florida Virtual School.—
    8         (8)(a) The Florida Virtual School may provide full-time and
    9  part-time instruction for students in kindergarten through grade
   10  12. To receive part-time instruction in kindergarten through
   11  grade 5, a student must meet at least one of the eligibility
   12  criteria in s. 1002.455(2).
   13         (11)The Auditor General shall conduct an operational audit
   14  of the Florida Virtual School, including Florida Virtual School
   15  Global. The scope of the audit shall include, but not be limited
   16  to, the administration of responsibilities relating to
   17  personnel; procurement and contracting; revenue production;
   18  school funds, including internal funds; student enrollment
   19  records; franchise agreements; information technology
   20  utilization, assets, and security; performance measures and
   21  standards; and accountability. The final report on the audit
   22  shall be submitted to the President of the Senate and the
   23  Speaker of the House of Representatives no later than January
   24  31, 2014.
   25         Section 9. Section 1002.455, Florida Statutes, is amended
   26  to read:
   27         1002.455 Student eligibility for K-12 virtual instruction.—
   28         (1)All students, including home education and private
   29  school students, are eligible to participate in any of the
   30  following A student may participate in virtual instruction in
   31  the school district in which he or she resides if the student
   32  meets the eligibility criteria in subsection (2).
   33         (2)A student is eligible to participate in virtual
   34  instruction if:
   35         (a)The student spent the prior school year in attendance
   36  at a public school in the state and was enrolled and reported by
   37  the school district for funding during October and February for
   38  purposes of the Florida Education Finance Program surveys;
   39         (b)The student is a dependent child of a member of the
   40  United States Armed Forces who was transferred within the last
   41  12 months to this state from another state or from a foreign
   42  country pursuant to a permanent change of station order;
   43         (c)The student was enrolled during the prior school year
   44  in a virtual instruction program under s. 1002.45 or a full-time
   45  Florida Virtual School program under s. 1002.37(8)(a);
   46         (d)The student has a sibling who is currently enrolled in
   47  a virtual instruction program and the sibling was enrolled in
   48  that program at the end of the prior school year;
   49         (e)The student is eligible to enter kindergarten or first
   50  grade; or
   51         (f)The student is eligible to enter grades 2 through 5 and
   52  is enrolled full-time in a school district virtual instruction
   53  program, virtual charter school, or the Florida Virtual School.
   54         (3)The virtual instruction options for which this
   55  eligibility section applies include:
   56         (1)(a) School district operated part-time or full-time
   57  kindergarten through grade 12 virtual instruction programs under
   58  s. 1002.45 s. 1002.45(1)(b) for students enrolled in the school
   59  district.
   60         (2)(b) Full-time virtual charter school instruction
   61  authorized under s. 1002.33 to students within the school
   62  district or to students in other school districts throughout the
   63  state pursuant to s. 1002.31.
   64         (3)(c) Virtual courses offered in the course code directory
   65  to students within the school district or to students in other
   66  school districts throughout the state pursuant to s. 1003.498.
   67         (4)Florida Virtual School instructional services
   68  authorized under s. 1002.37.
   69         Section 10. Paragraphs (b), (d), and (f) of subsection (3)
   70  and subsections (4), (7), and (9) of section 1003.4282, Florida
   71  Statutes, are amended to read:
   72         1003.4282 Requirements for a standard high school diploma.—
   73         (3) STANDARD HIGH SCHOOL DIPLOMA; COURSE AND ASSESSMENT
   74  REQUIREMENTS.—
   75         (b) Four credits in mathematics.—A student must earn one
   76  credit in Algebra I and one credit in Geometry. A student’s
   77  performance on the statewide, standardized Algebra I end-of
   78  course (EOC) assessment constitutes 30 percent of the student’s
   79  final course grade. A student must pass the statewide,
   80  standardized Algebra I EOC assessment, or earn a comparative
   81  score, in order to earn a standard high school diploma. A
   82  student must take one statewide, standardized Mathematics
   83  assessment in high school which must be Algebra I, Geometry, or
   84  Algebra II. A student’s performance on the statewide,
   85  standardized assessment Geometry EOC assessment constitutes 30
   86  percent of the student’s final course grade. If the state
   87  administers a statewide, standardized Algebra II assessment, a
   88  student selecting Algebra II must take the assessment, and the
   89  student’s performance on the assessment constitutes 30 percent
   90  of the student’s final course grade. A student who earns an
   91  industry certification for which there is a statewide college
   92  credit articulation agreement approved by the State Board of
   93  Education may substitute the certification for one mathematics
   94  credit. Substitution may occur for up to two mathematics
   95  credits, except for Algebra I and Geometry.
   96         (d) Three credits in social studies.—A student must earn
   97  one credit in United States History; one credit in World
   98  History; one-half credit in economics, which must include
   99  financial literacy; and one-half credit in United States
  100  Government. The United States History EOC assessment constitutes
  101  30 percent of the student’s final course grade.
  102         (f) One credit in physical education.—Physical education
  103  must include the integration of health. Participation in an
  104  interscholastic sport at the junior varsity or varsity level for
  105  two full seasons shall satisfy the one-credit requirement in
  106  physical education if the student passes a competency test on
  107  personal fitness with a score of “C” or better. The competency
  108  test on personal fitness developed by the Department of
  109  Education must be used. A district school board may not require
  110  that the one credit in physical education be taken during the
  111  9th grade year. Completion of one semester with a grade of “C”
  112  or better in a marching band class, in a physical activity class
  113  that requires participation in marching band activities as an
  114  extracurricular activity, or in a dance class shall satisfy one
  115  half credit in physical education or one-half credit in
  116  performing arts. This credit may not be used to satisfy the
  117  personal fitness requirement or the requirement for adaptive
  118  physical education under an individual education plan (IEP) or
  119  504 plan. Completion of 2 years in a Reserve Officer Training
  120  Corps (R.O.T.C.) class, a significant component of which is
  121  drills, shall satisfy the one-credit requirement in physical
  122  education and the one-credit requirement in performing arts.
  123  This credit may not be used to satisfy the personal fitness
  124  requirement or the requirement for adaptive physical education
  125  under an IEP or 504 plan.
  126         (4) ONLINE COURSE REQUIREMENT.—At least one course within
  127  the 24 credits required under this section must be completed
  128  through online or blended learning.
  129         (a) An online course taken in grade 6, grade 7, or grade 8
  130  fulfills the requirements of this subsection. The requirement is
  131  met through an online course offered by the Florida Virtual
  132  School, a virtual education provider approved by the State Board
  133  of Education, a high school, or an online dual enrollment
  134  course. A student who is enrolled in a full-time or part-time
  135  virtual instruction program under s. 1002.45 meets the
  136  requirement.
  137         (b) A district school board or a charter school governing
  138  board, as applicable, may allow a student offer students the
  139  following options to satisfy the online or blended learning
  140  course requirements of this subsection by completing:
  141         1.Completion of a course in which the a student earns a
  142  nationally recognized industry certification in information
  143  technology that is identified on the CAPE Industry Certification
  144  Funding List pursuant to s. 1008.44 or passing passage of the
  145  information technology certification examination without
  146  enrolling enrollment in or completing completion of the
  147  corresponding course or courses, as applicable.
  148         2.Passage of an online content assessment, without
  149  enrollment in or completion of the corresponding course or
  150  courses, as applicable, by which the student demonstrates skills
  151  and competency in locating information and applying technology
  152  for instructional purposes.

  154  For purposes of this subsection, a school district may not
  155  require a student to take the online or blended learning course
  156  outside the school day or in addition to a student’s courses for
  157  a given semester. This subsection does not apply to a student
  158  who has an individual education plan under s. 1003.57 which
  159  indicates that an online or blended learning course would be
  160  inappropriate or to an out-of-state transfer student who is
  161  enrolled in a Florida high school and has 1 academic year or
  162  less remaining in high school.

  178         amending s. 1003.4282, F.S.; revising the requirements
  179         for a standard high school diploma; removing a
  180         requirement that a student participating in an
  181         interscholastic sport pass a competency test on
  182         personal fitness to satisfy the physical education
  183         credit requirement for high school graduation;
  184         revising the options that a district school board or
  185         charter school governing board may offer for a student
