Section 705.17, Florida Statutes, is amended to 6 read: 7 705.17 Exceptions.—SectionsThe provisions of ss.705.101 8 705.106 do not applyof this chapter shall not be appliedto any 9 personal property lost or abandoned on the campus of any 10 institution in the State University System;oron premises owned 11 or controlled by the operator of a public-use airport having 12 regularly scheduled international passenger service; or, if the 13 owner or operator of the premises elects to comply with s. 14 705.185, on any premises located within a theme park or 15 entertainment complex, as the term is defined in s. 509.013(9), 16 or operated as a zoo, a museum, or an aquarium or on any 17 premises of a public food service establishment or public 18 lodging establishment licensed under part I of chapter 509. 19 Section 2. Section 705.185, Florida Statutes, is created to 20 read: 21 705.185 Disposal of personal property lost or abandoned on 22 the premises of certain facilities.—Whenever any lost or 23 abandoned personal property is found on any premises located 24 within a theme park or entertainment complex, as the term is 25 defined in s. 509.013(9), or operated as a zoo, a museum, or an 26 aquarium; or on any premises of a public food service 27 establishment or public lodging establishment licensed under 28 part I of chapter 509, if the owner or operator of the premises 29 elects to comply with this section, any lost or abandoned 30 property must be delivered to the owner or operator of the 31 premises, who shall take charge of the property and make a 32 record of the date such property was found. If the property is 33 not claimed by the owner within 30 days after it is found, or a 34 longer period of time as may be deemed appropriate by the owner 35 or operator of the premises, the owner or operator of the 36 premises must dispose of the property or donate it to a 37 charitable institution that is exempt from federal income tax 38 under s. 501(c)(3) of the Internal Revenue Code for sale or 39 disposal as that charitable institution deems appropriate. The 40 rightful owner of the property may reclaim the property at any 41 time before the disposition, sale, or donation of the property 42 in accordance with this section and the established policies and 43 procedures of the owner or operator of the premises. 44 Section 3. This act shall take effect July 1, 2018. 45 46 ================= T I T L E A M E N D M E N T ================ 47 And the title is amended as follows: 48 Delete everything before the enacting clause 49 and insert: 50 A bill to be entitled 51 An act relating to lost or abandoned property; 52 amending s. 705.17, F.S.; providing that certain 53 provisions of ch. 705, F.S., do not apply to lost or 54 abandoned personal property on the premises of 55 specified facilities if certain conditions are met; 56 creating s. 705.185, F.S.; providing for the disposal 57 of lost or abandoned personal property found on the 58 premises of specified facilities; specifying 59 procedures for the disposal of such property; 60 authorizing the rightful owner to claim lost or 61 abandoned property at any time before its disposal; 62 providing an effective date.
