       Senator Simmons moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 1726 and 1727
    4  insert:
    5         Section 37. Subsection (2) of section 338.222, Florida
    6  Statutes, is amended to read:
    7         338.222 Department of Transportation sole governmental
    8  entity to acquire, construct, or operate turnpike projects;
    9  exception.—
   10         (2) The department may, but is not required to, contract
   11  with any local governmental entity as defined in s. 334.03(13)
   12  for the design, right-of-way acquisition, transfer, purchase,
   13  sale, acquisition, or other conveyance of the ownership,
   14  operation, maintenance, or construction of any turnpike project
   15  which the Legislature has approved. Local governmental entities
   16  may negotiate and contract with the department for the design,
   17  right-of-way acquisition, transfer, purchase, sale, acquisition,
   18  or other conveyance of the ownership, operation, maintenance, or
   19  and construction of any section of the turnpike project within
   20  areas of their respective jurisdictions or within counties with
   21  which they have interlocal agreements.
