Section 316.87, Florida Statutes, is amended to 7 read: 8 316.87 Nonemergency medical transportation services.— 9 (1) To ensure the availability of nonemergency medical 10 transportation services throughout the state, a provider 11 licensed by the county or operating under a permit issued by the 12 county may not be required to use a vehicle that is larger than 13 needed to transport the number of persons being transported or 14 that is inconsistent with the medical condition of the 15 individuals receiving the nonemergency medical transportation 16 services. This section does not apply to the procurement, 17 contracting, or provision of paratransit transportation 18 services, directly or indirectly, by a county or an authority, 19 pursuant to the Americans with Disabilities Act of 1990, as 20 amended. 21 (2)(a) Notwithstanding any other provision of law, Medicaid 22 nonemergency medical transportation services may be provided to 23 a Medicaid beneficiary by a transportation network company. A 24 Medicaid beneficiary shall have the option to use the 25 transportation network company in the fulfillment of the 26 beneficiary’s Medicaid nonemergency transportation benefit, 27 unless a licensed medical professional determines that use of a 28 transportation network company to fulfill such benefit would be 29 contrary to a beneficiary’s health and safety. 30 (b) In providing such Medicaid nonemergency transportation 31 services, transportation network companies shall be governed by 32 s. 627.748. 33 (c) This subsection may not be construed to expand or limit 34 the existing transportation benefit provided to Medicaid 35 beneficiaries. 36 37 ================= T I T L E A M E N D M E N T ================ 38 And the title is amended as follows: 39 Delete line 1529 40 and insert: 41 solutions for specified purposes; amending s. 316.87, 42 F.S.; authorizing Medicaid nonemergency medical 43 transportation services to be provided to a Medicaid 44 beneficiary by a transportation network company; 45 requiring a Medicaid beneficiary to have the option to 46 use the transportation network company in the 47 fulfillment of the beneficiary’s Medicaid nonemergency 48 transportation benefit under certain circumstances; 49 requiring the transportation network companies to be 50 governed by a specified provision in providing such 51 Medicaid nonemergency transportation services; 52 providing construction; amending s. 319.141,
