Subsection (3) and paragraph (b) of subsection 6 (4) of section 339.175, Florida Statutes, are amended to read: 7 339.175 Metropolitan planning organization.— 8 (3) VOTING MEMBERSHIP.— 9 (a)1. Except as provided in subparagraph 2., the voting 10 membership of an M.P.O. shall consist of at least 5 but not more 11 than 25 apportioned members, with the exact number determined on 12 an equitable geographic-population ratio basis, based on an 13 agreement among the affected units of general-purpose local 14 government and the Governor, as required by federal regulations. 15 In accordance with 23 U.S.C. s. 134, the Governor may also allow 16 M.P.O. members who represent municipalities to alternate with 17 representatives from other municipalities within the 18 metropolitan planning area which do not have members on the 19 M.P.O. With the exception of instances in which all of the 20 county commissioners in a single-county M.P.O. are members of 21 the M.P.O. governing board, county commissioners shall compose 22 at least one-third of the M.P.O. governing board membership. A 23 multicounty M.P.O. may satisfy this requirement by any 24 combination of county commissioners from each of the counties 25 constituting the M.P.O. Voting members shall be elected 26 officials of general-purpose local governments, one of whom may 27 represent a group of general-purpose local governments through 28 an entity created by an M.P.O. for that purpose. An M.P.O. may 29 include, as part of its apportioned voting members, a member of 30 a statutorily authorized planning board, an official of an 31 agency that operates or administers a major mode of 32 transportation, or an official of Space Florida.As used in this33section, the term “elected officials of a general-purpose local34government” excludes constitutional officers, including35sheriffs, tax collectors, supervisors of elections, property36appraisers, clerks of the court, and similar types of officials.37 County commissioners shall compose not less than 20 percent of 38 the M.P.O. membership if an official of an agency that operates 39 or administers a major mode of transportation has been appointed 40 to an M.P.O. 41 42 ================= T I T L E A M E N D M E N T ================ 43 And the title is amended as follows: 44 Delete lines 216 - 225 45 and insert: 46 339.175, F.S.; providing voting membership 47 requirements for certain metropolitan planning 48 organizations designated on or after a specified date; 49 revising provisions relating to the reapportionment of 50 members; requiring metropolitan planning organizations 51 to comply with certain provisions by a specified date; 52 amending s.
