Section 316.87, Florida Statutes, is amended to 7 read: 8 316.87 Nonemergency medical transportation services.— 9 (1) To ensure the availability of nonemergency medical 10 transportation services throughout the state, a provider 11 licensed by the county or operating under a permit issued by the 12 county may not be required to use a vehicle that is larger than 13 needed to transport the number of persons being transported or 14 that is inconsistent with the medical condition of the 15 individuals receiving the nonemergency medical transportation 16 services. This section does not apply to the procurement, 17 contracting, or provision of paratransit transportation 18 services, directly or indirectly, by a county or an authority, 19 pursuant to the Americans with Disabilities Act of 1990, as 20 amended. 21 (2)(a) Subject to state and federal Medicaid requirements, 22 Medicaid nonemergency transportation services may be provided to 23 a Medicaid beneficiary by a transportation network company 24 selected by a Medicaid managed care plan, a transportation 25 broker under contract with a Medicaid managed care plan, or a 26 transportation broker under direct contract with the Agency for 27 Health Care Administration. The Agency for Health Care 28 Administration shall update the Non-Emergency Transportation 29 Services Coverage Policy pursuant this subsection by October 1, 30 2018. Requirements for transportation network companies and 31 transportation network company drivers shall not exceed the 32 provisions of s. 627.748, except as necessary to conform to 33 federal Medicaid transportation requirements administered by the 34 Agency for Health Care Administration. 35 (b) This subsection may not be construed to expand or limit 36 the existing transportation benefit provided to Medicaid 37 beneficiaries, or to create a right for any transportation 38 network company to enter into a contract with a Medicaid managed 39 care plan or transportation broker. 40 41 ================= T I T L E A M E N D M E N T ================ 42 And the title is amended as follows: 43 Delete line 2982 44 and insert: 45 technology solutions for certain purposes; amending s. 46 316.87, F.S.; authorizing Medicaid nonemergency 47 transportation services to be provided to a Medicaid 48 beneficiary by a certain transportation network 49 company or transportation broker; authorizing the 50 Agency for Health Care Administration to update the 51 Non-Emergency Transportation Services Coverage Policy 52 by a specified date; providing that the requirements 53 for transportation network companies and 54 transportation network company drivers may not exceed 55 the provisions of a specified provision, except as 56 necessary to conform to federal Medicaid 57 transportation requirements administered by the 58 agency; providing construction; amending s.
