       The Committee on Children, Families, and Elder Affairs (Broxson)
       recommended the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 1480 and 1481
    4  insert:
    5         Section 44. Subsection (2) of section 633.314, Florida
    6  Statutes, is amended to read:
    7         633.314 Sale or use of certain types of fire extinguishers
    8  prohibited; penalty.—
    9         (2) It is unlawful for any person, directly or through an
   10  agent, to sell, offer for sale, or give in this state any make,
   11  type, or model of fire extinguisher, either new or used, unless
   12  such make, type, or model of extinguisher has first been tested
   13  and is currently approved or listed by Underwriters
   14  Laboratories, Inc., Factory Mutual Laboratories, Inc., or
   15  another testing laboratory recognized by the State Fire Marshal
   16  as nationally recognized in accordance with procedures adopted
   17  by rule, taking into account the laboratory’s facilities,
   18  procedures, use of nationally recognized standards, and any
   19  other criteria reasonably calculated to reach an informed
   20  determination, and unless such extinguisher carries an
   21  Underwriters Laboratories, Inc., or manufacturer’s serial
   22  number. Such serial number must shall be permanently affixed
   23  stamped on the manufacturer’s identification and instruction
   24  plate.
