       Senator Farmer moved the following:
       
    1         Senate Amendment to Amendment (721942) (with title
    2  amendment)
    3  
    4         Between lines 1002 and 1003
    5  insert:
    6         Section 13. Subsection (8) is added to section 403.859,
    7  Florida Statutes, to read:
    8         403.859 Prohibited acts.—The following acts and the causing
    9  thereof are prohibited and are violations of this act:
   10         (8) The injection of fluids into a geologic formation that
   11  is above or below or a part of the Floridan Aquifer system or
   12  the Biscayne Aquifer when such injection is for the purpose of
   13  propagating fractures in or dissolving rock formations to
   14  increase production at an oil or gas well by improving the flow
   15  of hydrocarbons from the formation into the wellbore. However,
   16  this subsection does not apply when such injection is performed
   17  only for one or more of the following purposes:
   18         (a) Routine well cleanout work or maintenance.
   19         (b) Routine treatment for the purpose of removal of rock
   20  formation damage due to drilling or other well construction
   21  activity.
   22         (c) Any bottom hole pressure survey.
   23         (d) Any routine activity that does not affect the integrity
   24  of the well or the rock formation.
   25         (e) The removal of scale or precipitate from well
   26  preparations, casing, or tubing.
   27         (f) A gravel pack treatment that does not exceed the
   28  formation fracture gradient.
   29         Section 14. Subsection (1) of section 403.860, Florida
   30  Statutes, is amended to read:
   31         403.860 Penalties and remedies.—
   32         (1) A fine, not to exceed $5,000 for each day in which a
   33  violation occurs, may be imposed by a court of competent
   34  jurisdiction on any person who violates s. 403.859(1), (2), (4),
   35  (5), or (6), or (8).

   40  insert:
   41         amending s. 403.859, F.S.; prohibiting certain
   42         hydraulic fracturing in specified geologic formations;
   43         providing exceptions; amending s. 403.860, F.S.;
   44         providing a penalty for such unlawful hydraulic
   45         fracturing;
