2 An act relating to specialty license plates; amending
3 s. 320.08056, F.S.; deleting the annual use fee for
4 the Donate Organs-Pass It On license plate;
5 establishing an annual use fee for certain specialty
6 license plates; conforming cross-references; amending
7 s. 320.08058, F.S.; revising the design of the Special
8 Olympics Florida license plate; deleting the Donate
9 Organs-Pass It On license plate; revising the design
10 of the Lighthouse Association license plate; revising
11 the use of fees for the In God We Trust license
12 plates; revising the distribution of proceeds for the
13 Fallen Law Enforcement Officers license plate;
14 requiring the Department of Highway Safety and Motor
15 Vehicles to develop certain specialty license plates;
16 providing for distribution and use of fees collected
17 from the sale of such plates; providing an effective
18 date.

20 Be It Enacted by the Legislature of the State of Florida:
21
22 Section 1. Paragraph (eee) of subsection (4) of section
23 320.08056, Florida Statutes, is amended, present paragraphs
24 (fff) through (eeee) of that subsection are redesignated as
25 paragraphs (eee) through (dddd), respectively, a new paragraph
26 (eeee) and paragraphs (ffff) through (iiii) are added to that
27 subsection, and paragraph (a) of subsection (10) of that section
28 is amended, to read:
29 320.08056 Specialty license plates.—
30 (4) The following license plate annual use fees shall be
31 collected for the appropriate specialty license plates:
32 (eee) Donate Organs-Pass It On License Plate, $25.
33 (eeee) Ducks Unlimited license plate, $25.
34 (ffff) Dan Marino Campus license plate, $25.
35 (gggg) Donate Life Florida license plate, $25.
36 (hhhh) Florida State Beekeepers Association license plate,
37 $25.
38 (iiii) America the Beautiful license plate, $25.
39 (10)(a) A specialty license plate annual use fee collected
40 and distributed under this chapter, or any interest earned from
41 those fees, may not be used for commercial or for-profit
42 activities nor for general or administrative expenses, except as
43 authorized by s. 320.08058 or to pay the cost of the audit or
44 report required by s. 320.08062(1). The fees and any interest
45 earned from the fees may be expended only for use in this state
46 unless the annual use fee is derived from the sale of United
47 States Armed Forces and veterans-related specialty license
48 plates pursuant to paragraphs (4)(d), (bb), (ll), (jjj) (kkk),
49 and (xxx) (yyy) and s. 320.0891.
50 Section 2. Present subsections (58) through (83) of section
51 320.08058, Florida Statutes, are redesignated as subsections
52 (57) through (82), respectively, paragraph (a) of subsection
53 (7), subsection (57), paragraph (a) of present subsection (65),
54 paragraph (b) of present subsection (66), and paragraph (b) of
55 present subsection (80) are amended, and a new subsection (83)
56 and subsections (84) through (87) are added to that section, to
57 read:
58 320.08058 Specialty license plates.—
59 (7) SPECIAL OLYMPICS FLORIDA LICENSE PLATES.—
60 (a) Special Olympics Florida license plates must contain
61 the official Special Olympics Florida logo and must bear a
62 design and colors that are approved by the department. The word
63 “Florida” must be centered at the top bottom of the plate, and
64 the words “Be a Fan” “Everyone Wins” must be centered at the
65 bottom top of the plate.
66 (57) DONATE ORGANS-PASS IT ON LICENSE PLATES.—
67 (a) The department shall develop a Donate Organs-Pass It On
68 license plate as provided in this section. The word “Florida”
69 must appear at the top of the plate, and the words “Donate
70 Organs-Pass It On” must appear at the bottom of the plate.
71 (b) The annual use fees shall be distributed to Transplant
72 Foundation, Inc., and shall use up to 10 percent of the proceeds
73 from the annual use fee for marketing and administrative costs
74 that are directly associated with the management and
75 distribution of the proceeds. The remaining proceeds shall be
76 used to provide statewide grants for patient services, including
77 preoperative, rehabilitative, and housing assistance; organ
78 donor education and awareness programs; and statewide medical
79 research.
80 (64)(65) LIGHTHOUSE ASSOCIATION LICENSE PLATES.—
81 (a) The department shall develop a Lighthouse Association
82 license plate as provided in this section. The word “Florida”
83 must appear at the top of the plate, and the words
84 “SaveOurLighthouses.org Visit Our Lights” must appear at the
85 bottom of the plate.
86 (65)(66) IN GOD WE TRUST LICENSE PLATES.—
87 (b) The license plate annual use fees shall be distributed
88 to the In God We Trust Foundation, Inc., which may use a maximum
89 of 10 percent of the proceeds to offset marketing,
90 administration, and promotion, and the balance of the fees to
91 address the needs of the military community, the needs of the
92 public safety community, provide educational grants and
93 scholarships to foster self-reliance and stability in Florida’s
94 children, and provide education in public and private schools
95 regarding the historical significance of religion in American
96 and Florida history to fund educational scholarships for the
97 children of Florida residents who are members of the United
98 States Armed Forces, the National Guard, and the United States
99 Armed Forces Reserve and for the children of public safety
100 employees who have died in the line of duty who are not covered
101 by existing state law. Funds shall also be distributed to other
102 s. 501(c)(3) organizations that may apply for grants and
103 scholarships and to provide educational grants to public and
104 private schools to promote the historical and religious
105 significance of American and Florida history. The In God We
106 Trust Foundation, Inc., shall distribute the license plate
107 annual use fees in the following manner:
108 1. The In God We Trust Foundation, Inc., shall retain all
109 revenues from the sale of such plates until all startup costs
110 for developing and establishing the plate have been recovered.
111 2. Ten percent of the funds received by the In God We Trust
112 Foundation, Inc., shall be expended for administrative costs,
113 promotion, and marketing of the license plate directly
114 associated with the operations of the In God We Trust
115 Foundation, Inc.
116 3. All remaining funds shall be expended by the In God We
117 Trust Foundation, Inc., for programs.
118 (79)(80) FALLEN LAW ENFORCEMENT OFFICERS LICENSE PLATES.—
119 (b) The annual use fees shall be distributed to the Police
120 and Kids Foundation, Inc., which may use up to a maximum of 10
121 percent of the proceeds for marketing to promote and market the
122 plate. All remaining proceeds shall be distributed to and used
123 by the Police and Kids Foundation, Inc., for its operations,
124 activities, programs, and projects The remainder of the proceeds
125 shall be used by the Police and Kids Foundation, Inc., to invest
126 and reinvest, and the interest earnings shall be used for the
127 operation of the Police and Kids Foundation, Inc.
128 (83) DUCKS UNLIMITED LICENSE PLATES.—
129 (a) The department shall develop a Ducks Unlimited license
130 plate as provided in this section and s. 320.08053. Ducks
131 Unlimited license plates must bear the colors and design
132 approved by the department. The word “Florida” must appear at
133 the top of the plate, and the words “Conserving Florida
134 Wetlands” must appear at the bottom of the plate.
135 (b) The annual use fees from the sale of the plate shall be
136 distributed to Ducks Unlimited, Inc., a nonprofit corporation
137 under s. 501(c)(3) of the Internal Revenue Code, to be used as
138 follows:
139 1. Up to 5 percent may be used for administrative costs and
140 marketing of the plate.
141 2. A minimum of 95 percent shall be used in this state to
142 support the mission and efforts of Ducks Unlimited, Inc., to
143 conserve, restore, and manage Florida wetlands and associated
144 habitats for the benefit of waterfowl, other wildlife, and
145 people.
146 (84) DAN MARINO CAMPUS LICENSE PLATES.—
147 (a) The department shall develop a Dan Marino Campus
148 license plate as provided in this section and s. 320.08053. The
149 plate must bear the colors and design approved by the
150 department. The word “Florida” must appear at the top of the
151 plate, and the words “Marino Campus” must appear at the bottom
152 of the plate.
153 (b) The annual use fees from the sale of the plate shall be
154 distributed to the Dan Marino Foundation, a Florida nonprofit
155 corporation, which may use up to 10 percent of such fees for
156 administrative costs and marketing of the plate. The balance of
157 the fees shall be used by the Dan Marino Foundation to assist
158 Floridians with developmental disabilities in becoming employed,
159 independent, and productive and to promote and fund education
160 scholarships and awareness of these services.
161 (85) DONATE LIFE FLORIDA LICENSE PLATES.—
162 (a) The department shall develop a Donate Life Florida
163 license plate as provided in this section and s. 320.08053. The
164 plate must bear the colors and design approved by the
165 department. The word “Florida” must appear at the top of the
166 plate, and the words “Donors Save Lives” must appear at the
167 bottom of the plate.
168 (b) The annual use fees from the sale of the plate shall be
169 distributed to Donate Life Florida, which may use up to 10
170 percent of the proceeds for marketing and administrative costs.
171 The remaining proceeds shall be used by Donate Life Florida to
172 educate Florida residents on the importance of organ, tissue,
173 and eye donation and for the continued maintenance of the Joshua
174 Abbott Organ and Tissue Donor Registry.
175 (86) FLORIDA STATE BEEKEEPERS ASSOCIATION LICENSE PLATES.—
176 (a) The department shall develop a Florida State Beekeepers
177 Association license plate as provided in s. 320.08053 and this
178 section. The plate must bear the colors and design approved by
179 the department. The word “Florida” must appear at the top of the
180 plate, and the words “Save the Bees” must appear at the bottom
181 of the plate.
182 (b) The annual use fees shall be distributed to the Florida
183 State Beekeepers Association, a Florida nonprofit corporation.
184 The Florida State Beekeepers Association may use up to 18
185 percent of the annual use fees for:
186 1. Direct reimbursement for administrative costs, startup
187 costs, and costs incurred in the development and approval
188 process of the license plate. All vendors associated with the
189 administrative costs shall be selected by competitive bid.
190 2. Promotion and marketing costs of the license plate.
191 (c) The remaining funds shall be distributed to the Florida
192 State Beekeepers Association and shall be used to raise
193 awareness of the importance of beekeeping to Florida agriculture
194 by funding honeybee research, education, outreach, and
195 husbandry. The Florida State Beekeepers Association board of
196 managers must approve and is accountable for all such
197 expenditures.
198 (87) AMERICA THE BEAUTIFUL LICENSE PLATES.—
199 (a) The department shall develop an America the Beautiful
200 license plate as provided in this section and s. 320.08053. The
201 word “Florida” must appear at the top of the plate, and the
202 words “America the Beautiful” must appear on the plate.
203 (b) The annual use fees from the plate shall be distributed
204 to the America the Beautiful Fund as follows: 15 percent to
205 offset administrative, marketing, and promotion costs, and the
206 remaining 85 percent for projects and programs teaching
207 character, leadership, and service to Florida youth; provision
208 of well-being and assistance in the military community; outdoor
209 education advancing self-sufficiency; wildlife conservation
210 including imperiled and managed species; the maintenance of
211 historic or culturally important sites, buildings, structures,
212 or objects; and the development and modification of playgrounds,
213 recreational areas, or other outdoor amenities, including
214 disability access.
215 Section 3. This act shall take effect October 1, 2018.
