Floor: C 03/08/2018 03:31 PM . 03/09/2018 09:45 PM ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Steube moved the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 22 - 35 4 and insert: 5 conduct a mass shooting or an act of terrorism; punishment; 6 exemption from liability.— 7 (1) Any person who writes or composes and also sends or 8 procures the sending of any letter, inscribed communication, or 9 electronic communication, whether such letter or communication 10 be signed or anonymous, to any person, containing a threat to 11 kill or to do bodily injury to the person to whom such letter or 12 communication is sent, or a threat to kill or do bodily injury 13 to any member of the family of the person to whom such letter or 14 communication is sent, or any person who makes, posts, or 15 transmits a threat in a writing or other record, including an 16 electronic record, to conduct a mass shooting or an act of 17 terrorism, in any manner that would allow another person to view 18 the threat, commits a felony of the second degree, punishable as 19 provided in s. 775.082, s. 775.083, or s. 775.084. 20 (2) This section does not impose liability on a provider of 21 an interactive computer service, communications services as 22 defined in s. 202.11, a commercial mobile service, or an 23 information service, including, but not limited to, an Internet 24 service provider or a hosting service provider, if it provides 25 the transmission, storage, or caching of electronic 26 communications or messages of others or provides another related 27 telecommunications service, commercial mobile radio service, or 28 information service for use by another person who violates this 29 section. This exemption from liability is consistent with and in 30 addition to any liability exemption provided under 47 U.S.C. s. 31 230. 32 33 ================= T I T L E A M E N D M E N T ================ 34 And the title is amended as follows: 35 Delete lines 4 - 10 36 and insert: 37 F.S.; prohibiting a person from making, posting, or 38 transmitting a threat to conduct a mass shooting or an 39 act of terrorism in a writing or other record in any 40 manner that would allow another person to view the 41 threat; providing criminal penalties; exempting 42 certain providers of services from liability amending 43 s. 921.0022, F.S.; conforming a provision to changes 44 made by the act; reenacting ss.
