House Comm: RCS . 02/28/2018 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Appropriations (Young) recommended the following: 1 Senate Amendment 2 3 Delete lines 53 - 66 4 and insert: 5 (e) Collection of the impact fees may not be required to 6 occur earlier than the issuance of the building permit for the 7 property that is subject to the fee. 8 (f) The impact fees must be reasonably connected to, or 9 have a rational nexus with, the need for additional capital 10 facilities and the increased impact generated by the new 11 residential or commercial construction. 12 (g) The impact fees must be reasonably connected to, or 13 have a rational nexus with, the expenditures of the funds 14 collected and the benefits accruing to the new residential or 15 commercial construction. 16 (h) The local government must specifically earmark funds 17 collected pursuant to the impact fees for use in acquiring, 18 constructing, or improving capital facilities to benefit the new 19 users.
