Florida Senate - 2018 SB 374 By Senator Young 18-00088B-18 2018374__ 1 A bill to be entitled 2 An act relating to fantasy contests; creating s. 3 546.13, F.S.; defining terms; prohibiting certain 4 fantasy contests; exempting fantasy contests from 5 certain regulations; providing an effective date. 6 7 Be It Enacted by the Legislature of the State of Florida: 8 9 Section 1. Section 546.13, Florida Statutes, is created to 10 read: 11 546.13 Fantasy contests and fantasy contest operators.— 12 (1) DEFINITIONS.—As used in this section, the term: 13 (a) “Entry fee” means cash or a cash equivalent that is 14 required to be paid by a participant to a fantasy contest 15 operator in order to participate in a fantasy contest. 16 (b) “Fantasy contest” means a fantasy or simulated game or 17 contest in which: 18 1. The fantasy contest operator is not a participant in the 19 game or contest; 20 2. The value of all prizes and awards offered to winning 21 participants is established and made known to the participants 22 in advance of the contest; 23 3. All winning outcomes reflect the relative knowledge and 24 skill of the participants and are determined predominantly by 25 accumulated statistical results of the performance of 26 individuals, including athletes in the case of sporting events; 27 and 28 4. No winning outcome is based on the score, point spread, 29 or any performance or performances of any single actual team or 30 combination of such teams or solely on any single performance of 31 an individual athlete or player in any single actual event. 32 (c) “Fantasy contest operator” means a person or an entity 33 that offers fantasy contests with an entry fee for a cash prize 34 or award. The term does not include an individual who serves as 35 the commissioner of no more than 10 fantasy contests in a 36 calendar year. 37 (2) PROHIBITION.—A fantasy contest operator may not offer 38 fantasy contests based on the performances of participants in 39 collegiate, high school, or youth athletics. 40 (3) EXEMPTIONS.—A fantasy contest is not subject to 41 regulation by the Department of Business and Professional 42 Regulation and is not subject to s. 849.01, s. 849.08, s. 43 849.09, s. 849.11, s. 849.14, or s. 849.25. 44 Section 2. This act shall take effect October 1, 2018.
