       Senator Farmer moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 68 and 69
    4  insert:
    5         Section 2. Section 790.0655, Florida Statutes, is amended
    6  to read:
    7         790.0655 Purchase and delivery of firearms handguns;
    8  mandatory waiting period; exceptions; penalties.—
    9         (1)(a) There shall be a mandatory 3-day waiting period,
   10  which shall be 3 days, excluding weekends and legal holidays,
   11  between the purchase and the delivery at retail of a firearm any
   12  handgun. “Purchase” means the transfer of money or other
   13  valuable consideration to the retailer. “Handgun” means a
   14  firearm capable of being carried and used by one hand, such as a
   15  pistol or revolver. “Retailer” means and includes every person
   16  engaged in the business of making sales at retail or for
   17  distribution, or use, or consumption, or storage to be used or
   18  consumed in this state, as defined in s. 212.02(13).
   19         (b) Records of firearm handgun sales must be available for
   20  inspection by any law enforcement agency, as defined in s.
   21  934.02, during normal business hours.
   22         (2) The 3-day waiting period does shall not apply in the
   23  following circumstances:
   24         (a) When a firearm handgun is being purchased by a holder
   25  of a concealed weapons permit as defined in s. 790.06.
   26         (b) To a trade-in of another firearm handgun.
   27         (3) It is a felony of the third degree, punishable as
   28  provided in s. 775.082, s. 775.083, or s. 775.084:
   29         (a) For any retailer, or any employee or agent of a
   30  retailer, to deliver a firearm handgun before the expiration of
   31  the 3-day waiting period, subject to the exceptions provided in
   32  subsection (2).
   33         (b) For a purchaser to obtain delivery of a firearm handgun
   34  by fraud, false pretense, or false representation.
